HomeMy WebLinkAbout2020-206BFIRST AMENDMENT TO INDIAN RIVER COUNTY CARES ACT AGREEMENT THIS FIRST AMENDMENT TO INDIAN RIVER COUNTY CARES ACT AGREEMENT ("Amendment") is entered into as of the L day of M'COVOX , 2020 by and between Indian River County, a political subdivision of the State of Florida, whose address is 1801 27'h Street, Vero Beach, Florida, 32960 ("Recipient'), and United Way of Indian River Count, Inc. a Florida not-for-profit corporation, whose address is 1836 14th Ave., Vero Beach, FL 32960 (the "Subrecipient"). RECITALS WHEREAS, Recipient and Subrecipient entered into the Indian River County CARES Act Agreement, which set forth a scope of work for the use of CARES Act funds by the Subrecipient (the "Agreement'); and WHEREAS, the Recipient and Subrecipient wish to amend the Agreement to increase the funding in the Agreement from $975,000 to $1,675,000 and revise the initial scope of work to reflect the uses of the additional funding; and NOW THEREFORE, in consideration of the mutual undertakings herein and other good and valuable consideration, the receipt and adequacy of which is hereby acknowledged, the parties agree, as follows: 1. Recitals. The above recitals are true and correct and are incorporated herein. 2. Amendment of Section 18 (Payments). Section 18 of the Agreement is amended to read as follows: "18 (PAYMENTS) a. The Recipient will make a total disbursement to Subrecipient of up to $1,675,000, which will be made in installments. The first $975,000 shall be made in four separate disbursements of $243,750. Recipient will make an initial disbursement of $243,750 to Subrecipient within 14 days of the final execution of this Agreement. The additional $700,000 will be made in three separate disbursements of $233,333. In order to receive additional disbursements, the Subrecipient must file with the Recipient Grant Manager its request for reimbursement along with documentation that the disbursement had been fully spent and how the disbursement was used. Upon verification and approval by Recipient, the next disbursement will be made to Subrecipient. Page 1 of'3 3. Amendment of Section 31 (Scope of Work). Section 31 of the Agreement is amended to read as follows: "(31) SCOPE OF WORK The Sub recipient shall perform the tasks as identified and set forth in the _Revised Scope of Work, which is Revised Attachment A." 4. Attachment "A" to the Agreement shall be removed and replaced with Revised Attachment "A", which is attached to this Amendment. 5. Each area of funding would be associated with a need that has arisen as a direct result of COVID-19. • Broadband and other technology needs for families and nonprofits to provide and enhance distance learning & teleworking (e.g. — families with multiple children need multiple devices for schooling, nonprofits & volunteers mentoring children, etc.) • Mental Health needs are beginning to skyrocket. Areas of need include: expanding & enhancing telemedicine, cost of mental health visits, additions of mental health professionals, costs of behavioral health prescriptions, etc. • Legal assistance to renters and homeowners about to be displaced by landlords and financial institutions. • Upgrading and retrofitting facilities to more fully prevent the spread of COVID-19. Since mid-March, United Way's COVID-19 Community Response Fund has focused its funding in the following most critical areas (not an all-inclusive list). CARES Act funds will be used for these critical needs when our COVID-19 Fund monies are exhausted. • Food Supports (food banks & pantries, food delivery to seniors, emergency Meals on Wheels, food for the homeless and other food insecure populations, etc.) • Rental & mortgage assistance • Utility assistance • Special supports for children • Special supports for veterans • Child Care Scholarships for up to 2 months for those returning to work (150% to 300% of poverty) United Way will receive a 3% administrative fee for managing these CARES Act funds. NOTE: UWIRC would utilize an Unmet Needs Committee structure to research and prioritize needs, be part of the decision making process and review reports from those receiving CARES Act funding. P.O. Each area of funding would be associated with a need that has arisen as a direct result of COVID-19. • Broadband and other technology needs for families and nonprofits to provide and enhance distance learning & teleworking (e.g. — families with multiple children need multiple devices for schooling, nonprofits & volunteers mentoring children, etc.) • Mental Health needs are ever increasing. Areas of need include: expanding & enhancing telemedicine, cost of mental health visits, additions of mental health professionals, costs of behavioral health prescriptions, etc. • Upgrading and retrofitting nonprofit facilities to more fully prevent the spread of COVID-19. [e.g. —protective/dividing screens, thermometers, disinfectant foggers & sprayers, UV light systems for air purification & germicidal irradiation]. • Legal assistance to renters and homeowners about to be displaced by landlords and financial institutions. • Marketing and public awareness campaigns for the availability of CARES Act funding for rent, mortgage, utilities, mental health services, etc. • Rental, mortgage, utility assistance and food supports. NOTE: Expenses in these areas will be limited to no more than 50% of the $1,675,000 CARES Act funds Administrative Costs: • United Way will receive a 3% administrative fee for managing these CARES Act funds. • Additionally, United Way may direct up to 7% in administrative costs to its partner agencies who are processing rent, mortgage and utility requests. • Total administrative costs are not to exceed 10% of the CARES Act funds managed by United Way.
