PROCLAMATION
DESIGNATING SEAN SEXTON AS
THE POET LAUREATE OF INDIAN RIVER COUNTY, FLORIDA
WHEREAS, Sean Sexton is a third generation pioneer resident of Indian River County who has
been writing poetry for over 40 years, and is affectionately known as `The Cowboy Poet'; and,
WHEREAS, Sean Sexton is recognized throughout Florida and nationally for his many beautiful
and heartfelt poems fitting with the character and values of Indian River County including family,
neighbors, farm and ranch life, nature, and the passing of seasons; and,
WHEREAS, Sean Sexton has shared his poems to promote awareness of Indian River County
and the appreciation of poetry at neighborly gatherings, special occasions, public workshops, and
exhibits; and
WHEREAS, the Indian River County Poet Laureate is an honorary position and carries with it the
esteem and appreciation of the citizens of Indian River County; and,
WHEREAS, Indian River County may call upon its Poet Laureate to compose poems for County
occasions and other government events worthy of commemoration; and,
WHEREAS, the Laura (Riding) Jackson Foundation, a 501C3 organization, recommends the
Board of County Commissioners designate Sean Sexton as Indian River County's Poet Laureate.
NOW, THEREFORE, BE IT PROCLAIMED BY THE BOARD OF COUNTY COMMISSIONERS,
INDIAN RIVER COUNTY, FLORIDA with appreciation and admiration, on this day recognize Sean
Sexton as the Poet Laureate of Indian River County, Florida, effective September 1, 2020.

PROCLAMATION
RECOGNIZING OCTOBER, 2020, AS VAPING AWARENESS MONTH
WHEREAS, the federal government has declared youth e -cigarette use, or vaping, a nationwide
epidemic; and
WHEREAS, youth vaping has increased dramatically across the country and in Florida; and
WHEREAS, in 2019, one in three Florida high school students reported electronic vaping — an increase
compared to 2018, and 16.5 percent of Indian River County youth ages 11-17 currently use e -
cigarettes, which is higher than the State rate of 14.5 percent; and
WHEREAS, e -cigarettes are unsafe for kids, teens, and young adults; and
WHEREAS, e -cigarettes typically contain nicotine, which is a highly addictive chemical and the
developing youth brain is more vulnerable to its effects, including reduced impulse control, deficits in
attention and cognition, and mood disorders; and
WHEREAS, e -cigarette aerosol is not harmless water vapor and the aerosol that users breathe and
exhale from an e -cigarette device can contain harmful and potentially harmful substances, including
cancer-causing chemicals and heavy metals such as nickel, tin, and lead; and
WHEREAS, the focus of October, 2020 Vaping Awareness Month is to provide accurate information
about youth and adult e -cigarette use into the hands of our citizens, which is an important step to
reversing this alarming trend in Indian River County; and
WHEREAS, Indian River County is committed to the goals and objectives of Vaping Awareness Month
through a variety of public health activities and programs.
NOW, THEREFORE, BE IT PROCLAIMED BY THE BOARD OF COUNTY COMMISSIONERS,
INDIAN RIVER COUNTY, FLORIDA that October, 2020, be recognized as Vaping Awareness Month
in Indian River County.

Dear Board of County Commissioners,
In 2016, the Indian River County Commission designated Sean Sexton as the county's first Poet
Laureate for a term of four years. The mission of the Poet Laureate is to promote poetry and
other literary forms to the County's diverse population. Since then, each year Sean has offered
several public poetry programs, taught poetry workshops to high school students, judged poetry
competitions, and arranged for nationally ranked poets to come to Vero Beach to participate in a
celebration of National Poetry Month. Through these efforts over the years, he has reached
many hundreds of local residents as well as visitors.
The Laura (Riding) Jackson Foundation is delighted to announce Sean Sexton as the Indian
River County Poet Laureate for a four-year second term. Through his tireless work with our
foundation and other local organizations, Sean is helping to awaken interest in poetry in every
part of our community. As a consequence, Indian River County is becoming known locally,
nationally, and internationally as a community that values the writing arts, and much of that has
been because of Sean's presence as our Poet Laureate.
If you agree, Sean will serve as the Indian River County Poet Laureate through September
2024.

FISCAL YEAR 2020/2021 REGULAR BOARD MEETING SCHEDULE
NOTICE IS HEREBY GIVEN that the Sebastian River Improvement District ("SRID") will
hold Regular Board Meetings of the Board of Supervisors at the Indian River County
Administration Complex, Building B-1, Room 501, 1800 27th Street, Vero Beach, Florida
32960 at 10:00 a.m. (**unless otherwise noted**) on the following dates:
December 2, 2020
March 3, 2021
**June 2, 2021**
September 1, 2021
**The June 2, 2021, Regular Board Meeting will be held at the Indian River County
Administration Complex, Building B-1, Room 501, 1800 27th Street, Vero Beach, Florida 32960
and will commence at 9:00 a.m. The Annual Meeting will immediately follow the Regular
Board Meeting at 10:00 a.m. at the same location.**
The purpose of the meetings is to conduct any business which may properly come before the
Board. The meetings are open to the public and will be conducted in accordance with the
provisions of Florida law. Copies of the Agenda for any of the meetings may be obtained from
the District's website or by contacting the District Manager at (561) 630-4922 and/or toll free at
1-877-737-4922.
From time to time one or two Supervisors may participate by telephone; therefore, a speaker
telephone will be present as required, at the meeting location so that Supervisors may be fully
informed of the discussions taking place. Said meeting(s) may be continued as found necessary
to a time and place specified on the record.
If any person decides to appeal any decision made with respect to any matter considered at these
meetings, such person will need a record of the proceedings and such person may need to insure
that a verbatim record of the proceedings is made at his or her own expense and which record
includes the testimony and evidence on which the appeal is based.
In accordance with the provisions of the Americans with Disabilities Act, any person requiring

DESCRIPTION AND CONDITIONS
Public Works is progressing with Right -of -Way acquisition for the planned improvements of 66th Avenue
between 69th Street - 85th Street. The County purchased the 0.63 acres parcel located at 7125 66th
Avenue, Vero Beach, FL 32967 from Paul Edward Thompson and Rennie Sue Thompson on October 28,
2019.
The purchase included a Lease Agreement for the Thompsons for (12) twelve months of extended
possession at $1.00 a month in the current home in order to give sufficient time to complete their new
residence to the west of the property. The current lease agreement is subject to a one 30 day extension if
the new house is not completed.
The Thom psons have had numerous delays with the construction of the new homed ue to the pandemic.
They have requested the lease be extended an additional (4) four months. This would include the one 30
day extension, and the lease renewal would expire on March 1, 2021. Phase II/#1505B of the 66th Avenue
road project is estimated to begin in 2022, so the extension of the lease agreement will not interfere with
current progress of the Phase 1/#1505 road project plans.
FUNDING
Lease payments received over the four months totaling $4.00 will be deposited into the General
Fund/Rents & Royalties account 001038-362010.
RECOMMENDATION
Staff recommends the Board approve the Renewal of Lease Agreement for the property located at 7125
66th Avenue, Vero Beach, FL 32967, and authorize the Chairman to execute the Renewal of Lease
Agreement on behalf of the Board.

RENEWAL OF LEASE AGREEMENT
This lease renewal entered into this day of , 2020, by the Board of
County Commissioners of Indian River County, Florida, "Landlord" and Paul Edward

It is requested that the Board of County Commissioners formally consider the following information
at its regular meeting of October 13, 2020.
DESCRIPTION AND CONDITIONS
John H. Blum, P.E. of Carter Associates, Inc. on behalf of the Environmental Learning Center is requesting a
waiver of the cut and fill balance requirement in accordance with Land Development Regulations (LDR) Section
930.07(2)(i)I of the Stormwater Management and Flood Protection Ordinance. The project is located south of
State Road 510 on Wabasso Island within the Indian River Lagoon Estuary. The site is located within Special
Flood Hazard Area. Zone AE -7 with a base flood elevation of -seven (7) feet. The 10 year still water elevation is
approximately 3.40 feet. The proposed displacement of the floodplain below 3.40 feet for which the waiver is
requested is approximately 9,923 cubic feet (367.5 cubic yards) as indicated in the attached letter from the
applicant's engineer.
ALTERNATIVES AND ANALYSIS
The project meets the cut and fill balance waiver criteria provided in Section 930.07(2)(i) l ofbeing situated in an
estuarine environment within the 100 year floodplain along the Indian River and in staff's opinion it appears that
all other Stormwater Management and Flood Protection Ordinance requirements can be met without adverse
impact on other lands in the estuarine environment.
Alternative No. 1
Approve the cut and fill balance waiver request of 9,923 cubic feet (367.5 cubic yards)
Alternative No. 2
Deny the waiver request and require re -design to accomplish the additional on-site balance of cut and fill.
RECOMMENDATIONS
Staff recommends approval of Alternative No. 1

SUBJECT: Request for Waiver of Interest on Demolition Lien — Estate of Glenn W. Legwen
BACKGROUND.
On November 6, 2007, the Board of County Commissioners approved a demolition lien against Glenn W.
Legwen III (See Figure 1 below). Mr. Legwen was the owner of a parcel of property located at 5900 5th
Street SW in Vero Beach. This 3.84 acre site, zoned Agricultural, was the site of Glenn's Nursery and then
Acaddemix Nursery. The hurricanes of 2004 and 2005 severely damaged the buildings and shade houses
used in the nursery operation. The nursery closed but the damaged structures and material were never
demolished or cleaned up. The County initiated demolition action against the property which resulted in the
removal of the dilapidated structures and the property being brought into compliance, the cost of which was
reduced to a lien in the amount of $7,989.84 and recorded in the public records. Staff learned that Mr.
Legwen passed away on July 19, 2020.
The County Attorney's office was contacted by Michael Swan, Esq. from the firm of Rossway Swan in Vero
Beach. Mr. Swan is probating the estate on behalf of the Personal Representative, Glenn W. Legwen IV.
Mr. Swan is trying to clear title to the property so it may be sold or distributed to Mr. Legwen's heirs. On
behalf of his client, Mr. Swan now asks the Board to waive the interest that has accrued on the demolition
lien since 2007.
On November 7, 2007, the County recorded the lien, which is found at O.R. Book 2220, Page 1731, Official
Records of Indian River County. The lien noted that it would accrue interest at a rate of 7% per year, so as
of the date of this memo, the lien has accrued $7,226.01 in interest. Mr. Swan has been informed that since
the lien was for actual costs expended by Indian River County, staff was willing to support the waiver of
interest, if the initial demolition lien cost is paid. Mr. Swan and his client are agreeable to this
recommendation.
FUNDING.
Lien proceeds totaling $7,989.84 will be deposited into MSTU Fund/Building Demolition Liens Revenue
account number 004038-369092. The costs of recording the release of the lien will be borne by the estate.

RECOMMENDATION.
The County Attorney's Office recommends that the Indian River County Board of County Commissioners
waive the interest, so long as the lien of $7,989.84 is paid within 120 days and once paid, that the Board
authorize the Chairman to execute the attached release of the lien.

SUBJECT: Developer's Agreement with GRBK GHO High Pointe, LLC
On March 29, 2005, the Board of County Commissioners granted PD rezoning,
preliminary PD approval and conceptual PD plan approval for High Pointe subdivision
located on 65th Street west of the FEC railroad and east of 58th Avenue. The 2005 PD
plan provided for 247 lots on 160 acres. The project was never started and the preliminary
PD approval expired. In January 2019, the new owner, GRBK GHO High Pointe, LLC
(GHO High Pointe), applied to the Planning and Zoning Commission to modify the project
as the preliminary PD approval expired, but the conceptual PD and the PD rezoning were
still active.
On January 24, 2019, the Planning and Zoning Commission approved GHO High Pointe's
request for modification of the PD plan. Under the modified PD Plan, the number of lots
remained the same at 247, but changed the phasing, setbacks near the FEC railroad and
increased the amount of conservation areas. Under the new PD Plan, GHO High Pointe
was also required to enter into a Developer's Agreement (Agreement) with the County to
contribute the project's fair share of the intersection improvements to 58th Avenue/65th
Street and 58th Avenue/49th Street. The Agreement calls for GHO High Pointe to
contribute 1.9% or $49,480.58 towards the 58th Avenue/49th Street intersection and
19.6% or $158,262.82 towards the 58th Avenue/65th Street intersection. The Agreement
must be approved by the Board prior to the issuance of a Land Development Permit for
Phase I of the project. Staff has reviewed and approved the Developer's Agreement
attached to this memorandum. A map of the High Pointe project is found below as Figure
1.

Funding: There are no County funds expended by this Agreement.
Recommendation: Staff recommends the Board of County Commissioners approve the
Developer's Agreement between the County and GRBK GHO High Pointe, LLC for the

WHEREAS, the County and the Developer desire to enter into this Agreement to set forth
the terms and conditions to which they have agreed with respect to the matters contained herein;
NOW, THEREFORE, for and in consideration of these premises, Ten Dollars ($10.00),
and other good and valuable consideration, the receipt and sufficiency of which are hereby
acknowledged, the County and the Developer do hereby covenant, stipulate, and agree as follows:
Recitals: The foregoing recitals are incorporated as if fully restated herein.
2. Intersection Improvements: The Developer shall contribute to the County
Developer's share of the cost of the ultimate build -out of the following intersection
improvements (a) 58a' Avenue and 49h Street: $49,480.58, representing a 1.9%
share and (b) 5P Avenue and 65a' Street: $158,262.82, representing a 19.6% share.
County acknowledges that the contributions above satisfy the Developer's entire

obligation with respect to off-site intersection improvements through build -out of
High Pointe, except to the extent that additional property or units may be added to
High Point in the future. The County shall not withhold any approval or permit, nor
shall it deny concurrency, because of the condition or state of any intersection in
the County as long as the Developer is in compliance with this Developer's
Agreement.
3. Miscellaneous:
A. In the event of any litigation arising out of this Agreement, the prevailing
party shall recover attorneys' fees and costs from the non -prevailing party.
B. No amendment, modification, change, or alteration of this Agreement shall
be valid or binding unless accomplished in writing and executed by all of
the parties hereto.
C. This Agreement shall be binding upon and inure to the benefit of the parties
hereto and their successors, and assigns.
D. This Agreement contains the entire agreement and understanding between
the parties. No representation, statement, recital, undertaking, or promise
not specifically set forth herein shall be binding on any parties hereto. This
Agreement shall not be effective unless signed by the Developer and the
County.
E. The obligations of the Developer to this Agreement are expressly
conditioned upon the Developer's decision, at the Developer's sole
discretion, to proceed with the development of High Pointe.
F. No Building Permit, Certificate of Completion, or Certificate of Occupancy
shall be withheld or delayed by the County for High Pointe or any portion
thereof, nor shall the County delay or withhold any other required permits,
provided that the Developer is in compliance with this Agreement, all
applicable laws and regulations.
G. Except as described herein, and in the plans submitted by the Developer and
approved by the County, the County shall not require the Developer to
construct, contribute to, or share in the costs of any off-site improvements
other than the payment of impact fees.
H. This Agreement and all matters arising hereunder shall be governed by and
construed in accordance with the laws of the State of Florida. Venue
hereunder shall lie in Indian River County, Florida. Time shall be of the
essence.
I. This Agreement shall be deemed prepared jointly by each of the parties
hereto and shall be construed on parity as between the parties. There shall

be no canon of construction for or against any party by reason of the
physical preparation of this Agreement.
Whenever the singular number is used in this Agreement and when required
by the context, the same shall include the plural; and the masculine,
feminine, and neuter genders shall each include the others.
K. The County and the Developer shall grant such further assurances and
provide such additional documents as may be reasonably required by one
another from time to time, and cooperate fully with one another in order to
carry out the terms and conditions hereof and comply with the express
intention of this Agreement.
L. Failure to insist upon strict compliance with any of the terms, covenants, or
conditions herein shall not be deemed a waiver of such terms, covenants, or
conditions, nor shall any waiver or relinquishment of any right or power
hereunder at any one time or times be deemed a waiver or relinquishment
of such right or power at any other time or times.
M. All words, terms, and conditions contained herein are to be read in concert
each with the other, and a provision contained under one paragraph may be
considered to be equally applicable under another in the interpretation of
this Agreement.
N. The words herein and hereof and words of similar import, without
referenced to any particular section or subdivision of this Agreement, refer
to this Agreement as a whole rather than to any particular section or
subdivision hereof.
O. In the event any term, conditions, or clause of this Agreement is declared to
be illegal or unenforceable by a court of competent jurisdiction, such
declaration of illegality or unenforceability shall not affect or alter the
legality or enforceability of any remaining term, condition, or clause hereof,
provided of the parties, as set forth in this Agreement.

Improvements — Kinchen Groves, Inc. - 66th Avenue, Parcel 124
Kinchen Groves, Inc. is the owner of the parcel of property at 7655 66th Avenue, Vero
Beach, Florida 32967, depicted on the aerial attached to this memorandum as Exhibit "A".
The parcel is a 467.08' by 54.50' lot approximating 0.52 acres directly abutting the west
side of 66th Avenue. The parent tract is 20.76 acres, zoned A-1, Agricultural, up to one
residential unit per five acres, and lies outside of the Urban Services Boundary. The site
is a former citrus grove, and currently undeveloped land that is used for cattle grazing.
There are barbed wire fencing and wooden posts located in the proposed right-of-way
acquisition.
Construction plans call for the County to acquire the following from Kinchen Groves, Inc.:
■ Parcel 124 which is made up of 0.52 acres of right-of-way consisting of a 467.08' x
54.50' wide strip along the entire length of the eastern border of the 20.76 acre parcel.
The County's appraisal for Parcel 124 was performed by Armfield & Wagner. The
appraisal assigned Parcel 124 a value of $14,900. The appraisal did not find any
severance damages.
Kinchen Groves, Inc. and its attorney negotiated with Bill DeBraal and Susan Prado on
the sale of the piece of right-of-way. Staff and Kinchen Groves, Inc. agreed on the terms
of the Agreement for Purchase and Sale of Real Estate that is attached to this
memorandum as Exhibit "B". The Agreement terms are:

• The County will pay to Kinchen Groves, Inc. $22,350 for right-of-way parcel 124,
permanent access easement, and temporary construction easement;
• Statutory attorney's fees of $3,613.50;
• Appraisal fees $2,000; and
• Kinchen Groves, Inc.'s engineering analysis fees $3,192.
The total settlement cost to the County is $31,155.50.
By purchasing the property in advance of filing a lawsuit, staff is attempting to save on
expert witness fees incurred by both the County and the Kinchen Groves, Inc. As noted
in the past, expert witness fees for both parties often exceed $100,000 by the time the
suit is filed and mediation is held. Pursuant to state statutes, the County is responsible
for reasonable expert witness fees for Kinchen Groves, Inc. The County has incurred
significant savings by not having to hire our trial witnesses (appraiser, engineer and land
planner) and outside counsel.
Kinchen Groves, Inc. is represented by Raymer F. Maguire, III of the law firm Maguire,
Lassman, and Silbernagel, P.A. in Orlando.
FUNDING: Funding is budgeted and available for this expenditure in Traffic Impact
Fees/District I/ROW/66th Ave/69th Street -85th Street, Account # 10215141-066120-16009.
STAFF RECOMMENDATION: Staff recommends the Board approve the Agreement to
Purchase and Sell Real Estate for the Kinchen Groves, Inc. property and authorize the
Chairman to execute the document on behalf of the Board.

AGREEMENT TO PURCHASE AND SELL REAL ESTATE
BETWEEN INDIAN RIVER COUNTY
AND
KINCHEN GROVES, INC.
THIS AGREEMENT TO PURCHASE AND SELL REAL ESTATE ("Agreement") is
made and entered into as of the day of , 2020, by and between Indian
River County, a political subdivision of the State of Florida ("the County"), and Kinchen
Groves, Inc. ("the Sellers") who agree as follows:
WHEREAS, Seller owns property located at 7655 66th Avenue, Vero Beach, FL,
Vero Beach, Florida. An aerial photo of the Property is attached to this agreement as
Exhibit "A", incorporated by reference herein; and
WHEREAS, the County is scheduled to do road improvements on 66th Avenue
between 69th Street and 81St Street in the future and the road expansion will impact the
Seller's property; and
WHEREAS, in order for the County to proceed with its road expansion plans, the
County needs to purchase property to be used as right-of-way from landowners along and
adjacent to 66th Avenue; and
WHEREAS, the County contacted the Seller and offered to purchase a portion of
the property, consisting of approximately 0.52 acres of property as depicted on Exhibit
"A", and
NOW, THEREFORE, in consideration of the mutual terms, conditions, promises,
covenants and premises hereinafter, the COUNTY and SELLER agree as follows:
1. Recitals. The above recitals are affirmed as being true and correct and are
incorporated herein.
2. Agreement to Purchase and Sell. The Seller hereby agrees to sell to the County,
and the County hereby agrees to purchase from Seller, upon the terms and conditions set
forth in this Agreement that parcel of real property located at 7655 661h Avenue, Vero
Beach, FL and more specifically described in the legal description attached as Exhibit "A",
fee simple, containing 0.52 acres, all improvements thereon, together with all easements,
rights and uses now or hereafter belonging thereto (collectively, the "Property").
2.1 Purchase Price, Effective Date. The purchase price ("Purchase Price") for the
Property shall be $25,542 (Twenty Five Thousand Five Hundred and Forty Two, 00/100
Dollars). The Purchase Price amount includes the cost of Kinchen Groves, Inc. engineering
analysis on this parcel coming out to $3,192 (Three Thousand One Hundred and Ninety
Two, 00/100 Dollars). The Purchase Price shall be paid on the Closing Date. The
Effective Date of this Agreement shall be the date upon which the County shall have
approved the execution of this Agreement, either by approval by the Indian River County

Board of County Commissioners at a formal meeting of such Board or by the County
Administrator pursuant to his delegated authority.
2.2 Drain Pipe. The property uses outfall drainage for storm water control to drain any
excess water into the adjacent Indian River Farms Water Control District drainage ditch.
This is in the area of take. The County will place a drain pipe and shut off gate on the
property to replace the current drainage this would put the owner back to where they were
at the time of take with the ability to drain excess water off the property and to the adjacent
canal. The drain pipe will be installed per Indian River Farms Water District requirements.
(see Exhibit "B" for sketch of drain pipe)
2.3 Attorneys Fees. Attorney's fees in the amount of $3,613.50 (Three Thousand Six
Hundred and Thirteen, 50/100 Dollars). This amount is the statutory attorney's fees amount
which is 33% (Thirty Three Percent) of the benefit conferred to the Seller.
3. Title. Seller shall convey marketable title to the Property by warranty deed free of
claims, liens, easements and encumbrances of record or known to Seller; but subject to
property taxes for the year of Closing and covenants, restrictions and public utility
easements of record provided (a) there exists at Closing no violation of any of the
foregoing; and (b) none of the foregoing prevents County's intended use and development
of the Property ("Permitted Exceptions").
3.1 County may order an Ownership and Encumbrance Report or Title Insurance
Commitment with respect to the Property. County shall within fifteen (15) days following
the Effective Date of this Agreement deliver written notice to Seller of title defects. Title
shall be deemed acceptable to County if (a) County fails to deliver notice of defects within
the time specified, or (b) County delivers notice and Seller cures the defects within thirty
(30) days from receipt of notice from County of title defects ("Curative Period"). Seller shall
use best efforts to cure the defects within the Curative Period and if the title defects are not
cured within the Curative Period, County shall have thirty (30) days from the end of the
Curative Period to elect, by written notice to Seller, to: (i) to terminate this Agreement,
whereupon shall be of no further force and effect, or (ii) extend the Curative Period for up
to an additional 90 days; or (iii) accept title subject to existing defects and proceed to
closing.
4. Representations of the Seller.
4.1 Seller represents to the parties to have marketable, fee simple title to the Property,
and is the sole owner of and has good right, title, and authority to convey and transfer the
Property which is the subject matter of this Agreement, free and clear of all liens and
encumbrances.
4.2 From and after the Effective Date of this Agreement, Seller shall take no action
which would impair or otherwise affect title to any portion of the Property, and shall record
no documents in the Public Records which would affect title to the Property, without the
prior written consent of the County.

4.3.1 There are no existing or pending special assessments affecting the Property, which
are or may be assessed by any governmental authority, water or sewer authority, school
district, drainage district or any other special taxing district.
5. Default.
5.1 In the event the County shall fail to perform any of its obligations hereunder, the
Seller shall, at its sole option, be entitled to: (i) terminate this Agreement by written notice
delivered to the County at or prior to the Closing Date and thereupon neither the Seller nor
any other person or party shall have any claim for specific performance, damages, or
otherwise against the County; or (ii) waive the County's default and proceed to Closing.
5.2 In the event the Seller shall fail to perform any of its obligations hereunder, the
County shall, at its sole option, be entitled to: (i) terminate this Agreement by written notice
delivered to the Seller at or prior to the Closing Date and thereupon neither the County nor
any other person or party shall have any claim for specific performance, damages or
otherwise against the Seller; or (ii) obtain specific performance of the terms and conditions
hereof; or (iii) waive the Seller's default and proceed to Closing:
6. Closing.
6.1 The closing of the transaction contemplated herein ("Closing" and "Closing Date")
shall take place within 45 days following the execution of the contract by the Chairman of
the Board of County Commissioners. The parties agree that the Closing shall be as
follows:
(a) The Seller shall execute and deliver to the County a warranty deed conveying
marketable title to the Property, free and clear of all liens and encumbrances and in the
condition required by paragraph 3.
(b) If Seller is obligated to discharge any encumbrances at or prior to Closing and fails
to do so, County may use a portion of Purchase Price funds to satisfy the encumbrances.
(c) If the Seller is a non-resident alien or foreign entity, Seller shall deliver to the County
an affidavit, in a form acceptable to the County, certifying that the Seller and any interest
holders are not subject to tax under the Foreign Investment and Real Property Tax Act of
1980.
(d) The Seller and the County shall each deliver to the other such other documents or
instruments as may reasonably be required to close this transaction.
6.2 Taxes. All taxes and special assessments which are a lien upon the property on or
prior to the Closing Date (except current taxes which are not yet due and payable)
shall be paid by the Seller.
6.3 Non -Ad Valorem. All non -ad valorem assessments for the current year must be
deposited into escrow by the Seller at the time of closing.

7. Personal Property.
7.1 The Seller shall have removed all of its personal property, equipment and trash from
the Property. The Seller shall deliver possession of the Property to County vacant and in
the same or better condition that existed at the Effective Date hereof.
7.2 Seller shall deliver at Closing all keys to locks and codes to access devices to
County, if applicable.
8. Closing Costs; Expenses. County shall be responsible for preparation of all Closing
documents.
8.1 County shall pay the following expenses at Closing:
8.1.1 The cost of recording the warranty deed and any release or satisfaction obtained by
Seller pursuant to this Agreement.
8.1.2 Documentary Stamps required to be affixed to the warranty deed.
8.1.3 All costs and premiums for the owner's marketability title insurance commitment and
policy, if any.
8.2 Seller shall pay the following expenses at or prior to Closing:
8.2.1 All costs necessary to cure title defect(s) or encumbrances, other than the Permitted
Exceptions, and to satisfy or release of record all existing mortgages, liens or
encumbrances upon the Property.
9. Miscellaneou
9.1 Controlling Law. This Agreement shall be construed and enforced in accordance
with the laws of the State of Florida. Venue shall be in Indian River County for all state
court matters, and in the Southern District of Florida for all federal court matters.
9.2 Entire Agreement. This Agreement constitutes the entire agreement between the
parties with respect to this transaction and supersedes all prior agreements, written or oral,
between the Seller and the County relating to the subject matter hereof. Any modification
or amendment to this Agreement shall be effective only if in writing and executed by each
of the parties.
9.3 Assignment and Binding Effect. Neither County nor Seller may assign its rights and
obligations under this Agreement without the prior written consent of the other party. The
terms hereof shall be binding upon and shall inure to the benefit of the parties hereto and
their successors and assigns.
9.4 Notices. Any notice shall be deemed duly served if personally served or if mailed by

certified mail, return receipt requested, or if sent via "overnight" courier service or facsimile
transmission, as follows:

Either party may change the information above by giving written notice of such change as

9.5 Survival and Benefit. Except as otherwise expressly provided herein, each
agreement, representation or warranty made in this Agreement by or on behalf of either
party, or in any instruments delivered pursuant hereto or in connection herewith, shall
survive the Closing Date and the consummation of the transaction provided for herein.
The covenants, agreements and undertakings of each of the parties hereto are made
solely for the benefit of, and may be relied on only by the other party hereto, its successors
and assigns, and are not made for the benefit of, nor may they be relied upon, by any other
person whatsoever.
9.6 Attorney's Fees and Costs. In any claim or controversy arising out of or relating to
this Agreement, each party shall bear its own attorney's fees, costs, and expenses.
9.7 County intends to construct the project in accordance with the construction plan sheets
relating to Parcel 124. In the event Petitioner fails to construct the project substantially in
conformance with these construction plans and paragraph 2.2 herein, Respondent retains all rights
and remedies pursuant to Central and Southern Florida Control District v. Wye River Farms, Inc.,
297 So.2d 323 (Fla. 4th DCA 1974) cert. denied 310 So. 2d 745 (Fla. 1975).
9.9 County Approval Required: This Agreement is subject to approval by the Indian
River County Board of County Commissioners as set forth in paragraph 2.
9.10 Beneficial Interest Disclosure: In the event Seller is a partnership, limited
partnership, corporation, trust, or any form of representative capacity whatsoever for
others, Seller shall provide a fully completed, executed, and sworn beneficial
interest disclosure statement in the form attached to this Agreement as an exhibit that
complies with all of the provisions of Florida Statutes Section 286.23 prior to approval of
this Agreement by the County. However, pursuant to Florida Statutes Section 286.23 (3)
(a), the beneficial interest in any entity registered with the Federal Securities and Exchange
Commission, or registered pursuant to Chapter 517, Florida Statutes, whose interest is for
sale to the general public, is exempt from disclosure; and where the Seller is a non-public
entity, that Seller is not required to disclose persons or entities holding less than five (5%)

percent of the beneficial interest in Seller.
9.11 "Seller acknowledges receipt of the "Notice to Owner" and understands his/her
rights granted under Florida Law Chapters 73 and 74."

Marvin Kenneth Kinchen and Marsha A. Kinchen (hereinafter "Kinchens") are the owners
of the parcel of property at 7615 66th Avenue, Vero Beach, Florida 32967, depicted on
the aerial attached to this memorandum as Exhibit "A". The parcel is a 38.6' by 185' lot
approximating 0.16 acres directly abutting the west side of 66th Avenue. The parent tract
is 0.84 acres in size, zoned A-1, Agricultural, up to one residential unit per five acres, and
lies outside of the Urban Services Boundary. The parent tract is a legal non -conforming
property. The site is a former citrus grove, and currently a single family home is located
upon the site. This house is the homestead property of the Kinchens and is not within
the area of take, however improvements consisting of a chain-link fence, gravel driveway,
two (2) bottle brush trees, one (1) avocado tree, and one (1) powder puff tree are within
the area of take.
Construction plans call for the County to acquire the following from the Kinchens:
Parcel 124-A which is made up of 0.16 acres of right-of-way consisting of a 38.6' x
185' wide strip along the entire length of the eastern border of the 0.84 acre parcel.
The County's appraisal for Parcel 124-A was performed by Armfield & Wagner. The
appraisal assigned Parcel 124-A a value of $12,000. The appraisal did not find any
severance damages.

BETWEEN INDIAN RIVER COUNTY
AND
MARSHA A. KINCHEN AND MARVIN KENNETH KICHEN
THIS AGREEMENT TO PURCHASE AND SELL REAL ESTATE ("Agreement") is
made and entered into as of the day of , 2020, by and between Indian
River County, a political subdivision of the State of Florida ("the County"), and Marsha A.
Kinchen and Marvin Kenneth Kinchen ("the Sellers") who agree as follows:
WHEREAS, Seller owns property located at 7615 66th Avenue, Vero Beach, FL,
Vero Beach, Florida. An aerial photo of the Property is attached to this agreement as
Exhibit "A", incorporated by reference herein; and
WHEREAS, the County is scheduled to do road improvements on 66th Avenue
between 69th Street and 81 st Street in the future and the road expansion will impact the
Seller's property; and
WHEREAS, in order for the County to proceed with its road expansion plans, the
County needs to purchase property to be used as right-of-way from landowners along and
adjacent to 66th Avenue; and
WHEREAS, the County contacted the Seller and offered to purchase a portion of
the property, consisting of approximately 0. 16 acres of property as depicted on Exhibit
"A", and
NOW, THEREFORE, in consideration of the mutual terms, conditions, promises,
covenants and premises hereinafter, the COUNTY and SELLER agree as follows:
1. Recitals. The above recitals are affirmed as being true and correct and are
incorporated herein.
2. Agreement to Purchase and Sell. The Seller hereby agrees to sell to the County,
and the County hereby agrees to purchase from Seller, upon the terms and conditions set
forth in this Agreement that parcel of real property located at 7615 66th Avenue, Vero
Beach, FL and more specifically described in the legal description attached as Exhibit "A",
fee simple, containing 0.16 acres, all improvements thereon, together with all easements,
rights and uses now or hereafter belonging thereto (collectively, the "Property").
2.1 Purchase Price, Effective Date. The purchase price ("Purchase Price") for the
Property shall be $30,192 (Thirty Thousand One Hundred and Ninety Two, 00/100 Dollars).
The Purchase Price amount includes the cost of the Kinchens' engineering analysis on this
parcel coming out to $3,192 (Three Thousand One Hundred and Ninety Two, 00/100
Dollars). The Purchase Price shall be paid on the Closing Date. The Effective Date of this
Agreement shall be the date upon which the County shall have approved the execution of
this Agreement, either by approval by the Indian River County Board of County

Commissioners at a formal meeting of such Board or by the County Administrator pursuant
to his delegated authority.
2.2 Attorneys Fees. Attorney's fees in the amount of $5,346.00 (Five Thousand Three
Hundred and Forty Six, 00/100 Dollars). This amount is the statutory attorney's fees
amount which is 33% (Thirty Three Percent) of the benefit conferred to the Seller.
3. Title. Seller shall convey marketable title to the Property by warranty deed free of
claims, liens, easements and encumbrances of record or known to Seller; but subject to
property taxes for the year of Closing and covenants, restrictions and public utility
easements of record provided (a) there exists at Closing no violation of any of the
foregoing; and (b) none of the foregoing prevents County's intended use and development
of the Property ("Permitted Exceptions").
3.1 County may order an Ownership and Encumbrance Report or Title Insurance
Commitment with respect to the Property. County shall within fifteen (15) days following
the Effective Date of this Agreement deliver written notice to Seller of title defects. Title
shall be deemed acceptable to County if (a) County fails to deliver notice of defects within
the time specified, or (b) County delivers notice and Seller cures the defects within thirty
(30) days from receipt of notice from County of title defects ("Curative Period"). Seller shall
use best efforts to cure the defects within the Curative Period and if the title defects are not
cured within the Curative Period, County shall have thirty (30) days from the end of the
Curative Period to elect, by written notice to Seller, to: (i) to terminate this Agreement,
whereupon shall be of no further force and effect, or (ii) extend the Curative Period for up
to an additional 90 days; or (iii) accept title subject to existing defects and proceed to
closing.
4. Representations of the Seller.
4.1 Seller represents to the parties to have marketable, fee simple title to the Property,
and is the sole owner of and has good right, title, and authority to convey and transfer the
Property which is the subject matter of this Agreement, free and clear of all liens and
encumbrances.
4.2 From and after the Effective Date of this Agreement, Seller shall take no action
which would impair or otherwise affect title to any portion of the Property, and shall record
no documents in the Public Records which would affect title to the Property, without the
prior written consent of the County.
4.3.1 There are no existing or pending special assessments affecting the Property, which
are or may be assessed by any governmental authority, water or sewer authority, school
district, drainage district or any other special taxing district.
5. Default.
5.1 In the event the County shall fail to perform any of its obligations hereunder, the
Seller shall, at its sole option, be entitled to: (i) terminate this Agreement by written notice

delivered to the County at or prior to the Closing Date and thereupon neither the Seller nor
any other person or party shall have any claim for specific performance, damages, or
otherwise against the County; or (ii) waive the County's default and proceed to Closing.
5.2 In the event the Seller shall fail to perform any of its obligations hereunder, the
County shall, at its sole option, be entitled to: (i) terminate this Agreement by written notice
delivered to the Seller at or prior to the Closing Date and thereupon neither the County nor
any other person or party shall have any claim for specific performance, damages or
otherwise against the Seller; or (ii) obtain specific performance of the terms and conditions
hereof; or (iii) waive the Seller's default and proceed to Closing:
6. Closing.
6.1 The closing of the transaction contemplated herein ("Closing" and "Closing Date")
shall take place within 45 days following the execution of the contract by the Chairman of
the Board of County Commissioners. The parties agree that the Closing shall be as
follows:
(a) The Seller shall execute and deliver to the County a warranty deed conveying
marketable title to the Property, free and clear of all liens and encumbrances and in the
condition required by paragraph 3.
(b) If Seller is obligated to discharge any encumbrances at or prior to Closing and fails
to do so, County may use a portion of Purchase Price funds to satisfy the encumbrances.
(c) If the Seller is a non-resident alien orforeign entity, Seller shall deliverto the County
an affidavit, in a form acceptable to the County, certifying that the Seller and any interest
holders are not subject to tax under the Foreign Investment and Real Property Tax Act of
1980.
(d) The Seller and the County shall each deliver to the other such other documents or
instruments as may reasonably be required to close this transaction.
6.2 Taxes. All taxes and special assessments which are a lien upon the property on or
prior to the Closing Date (except current taxes which are not yet due and payable)
shall be paid by the Seller.
6.3 Non -Ad Valorem. All non -ad valorem assessments for the current year must be
deposited into escrow by the Seller at the time of closing.
7. Personal Property.
7.1 The Seller shall have removed all of its personal property, equipment and trash from
the Property. The Seller shall deliver possession of the Property to County vacant and in
the same or better condition that existed at the Effective Date hereof.
7.2 Seller shall deliver at Closing all keys to locks and codes to access devices to

County, if applicable.
8. Closing Costs; Expenses. County shall be responsible for preparation of all Closing
documents.
8.1 County shall pay the following expenses at Closing:
8.1.1 The cost of recording the warranty deed and any release or satisfaction obtained by
Seller pursuant to this Agreement.
8.1.2 Documentary Stamps required to be affixed to the warranty deed.
8.1.3 All costs and premiums for the owner's marketability title insurance commitment and
policy, if any.
8.2 Seller shall pay the following expenses at or prior to Closing:
8.2.1 All costs necessary to cure title defect(s) or encumbrances, other than the Permitted
Exceptions, and to satisfy or release of record all existing mortgages, liens or
encumbrances upon the Property.
9. Miscellaneous.
9.1 Controlling Law. This Agreement shall be construed and enforced in accordance
with the laws of the State of Florida. Venue shall be in Indian River County for all state
court matters, and in the Southern District of Florida for all federal court matters.
9.2 Entire Agreement. This Agreement constitutes the entire agreement between the
parties with respect to this transaction and supersedes all prior agreements, written or oral,
between the Seller and the County relating to the subject matter hereof. Any modification
or amendment to this Agreement shall be effective only if in writing and executed by each
of the parties.
9.3 Assignment and Binding Effect. Neither County nor Seller may assign its rights and
obligations under this Agreement without the prior written consent of the other party. The
terms hereof shall be binding upon and shall inure to the benefit of the parties hereto and
their successors and assigns.
9.4 Notices. Any notice shall be deemed duly served if personally served or if mailed by
certified mail, return receipt requested, or if sent via "overnight" courier service or facsimile
transmission, as follows:

Either party may change the information above by giving written notice of such change as
provided in this paragraph.
9.5 Survival and Benefit. Except as otherwise expressly provided herein, each
agreement, representation or warranty made in this Agreement by or on behalf of either
party, or in any instruments delivered pursuant hereto or in connection herewith, shall
survive the Closing Date and the consummation of the transaction provided for herein.
The covenants, agreements and undertakings of each of the parties hereto are made
solely for the benefit of, and may be relied on only by the other party hereto, its successors
and assigns, and are not made for the benefit of, nor may they be relied upon, by any other
person whatsoever.
9.6 Attorney's Fees and Costs. In any claim or controversy arising out of or relating to
this Agreement, each party shall bear its own attorney's fees, costs, and expenses.
9.7 County intends to construct the project in accordance with the construction plan sheets
relating to Parcel 124-A. In the event Petitioner fails to construct the project substantially in
conformance with these construction plans, Respondent retains all rights and remedies pursuant to
Central and Southern Florida Control District v. Wye River Farms, Inc., 297 So.2d 323 (Fla. 4th DCA
1974) cert. denied 310 So. 2d 745 (Fla. 1975).
9.8 Counterparts. This Agreement may be executed in two or more counterparts, each
one of which shall constitute an original.
9.9 County Approval Required: This Agreement is subject to approval by the Indian
River County Board of County Commissioners as set forth in paragraph 2.
9.10 Beneficial Interest Disclosure: In the event Seller is a partnership, limited
partnership, corporation, trust, or any form of representative capacity whatsoever for
others, Seller shall provide a fully completed, executed, and sworn beneficial
interest disclosure statement in the form attached to this Agreement as an exhibit that
complies with all of the provisions of Florida Statutes Section 286.23 prior to approval of
this Agreement by the County. However, pursuant to Florida Statutes Section 286.23 (3)
(a), the beneficial interest in any entity registered with the Federal Securities and Exchange
Commission, or registered pursuant to Chapter 517, Florida Statutes, whose interest is for
sale to the general public, is exempt from disclosure; and where the Seller is a non-public
entity, that Seller is not required to disclose persons or entities holding less than five (5%)
percent of the beneficial interest in Seller.
9.11 "Seller acknowledges receipt of the "Notice to Owner" and understands his/her
rights granted under Florida Law Chapters 73 and 74."

On June 23, 2020, the Indian River County Board of County Commissioners (the "Board") authorized the
County to file a lawsuit concerning the above -referenced matter. In the interim period, the parties have
had negotiations concerning settling the dispute. Unfortunately, the parties have not been able to resolve
the matter and the County has given notice of its intent to file suit in the early part of November. The
County Attorney's Office is seeking guidance from the Board as to any other settlement options before
filing suit.

Groundwater Technical Support Services
Descriptions and Conditions:
On December 10, 2019, the Solid Waste Disposal District (SWDD) Board approved CCNA-2018 Work Order No.
6 to Geosyntec Consultants (Geosyntec) for $176,511.29 to provide engineering services related to the 2020
SWDD Annual Permit Compliance Monitoring and Reporting.
On May 6, 2020, the Florida Department of Environmental Protection (FDEP) provided comments regarding the
results of the January 2020 Semi -Annual Water Quality Monitoring Report for the Class 1 landfill. Based on the
correspondence provided by Geosyntec on May 28, 2020, the FDEP provided notification to SWDD to initiate
evaluation monitoring of four (4) monitoring wells with detected exceedances above applicable groundwater
cleanup target levels (GCTLs) for pH, ammonia, chloride, sodium, TDS and arsenic. The FDEP approved this
request in a letter dated August 14, 2020, and the 90 -day evaluation -monitoring period was initiated on
September 17, 2020.
The FDEP has also requested a supplemental groundwater assessment to evaluate the groundwater conditions
between the Construction and Demolition (C&D) debris landfill and the Residual Dewatering Facility (RDF) and
the Lateral C Canal to the east. Specifically, groundwater with elevated conductivity and nutrients needs to be
characterized in order to assess potential remedial alternatives.
Per staff request, Geosyntec has provided the attached CCNA-2018 Work Order No. 8 for additional technical
services to respond to the FDEP's request.
Analysis:
Geosyntec has prepared CCNA-2018 Work Order No. 8, provided in Attachment 1, for engineering services
detailing the scope of work, budget, and schedule for each of the phases. The fees to be paid by SWDD for
the execution of this work authorization are in accordance with the engineer's continuing consulting
services master agreement. The phases are listed below along with their estimated fees.

Besides the routine landfill compliance monitoring and reporting that SWDD performs on an annual basis, it
is becoming evident that the FDEP is requesting more and more in order to show regulatory compliance of
our facility. Although our C&D landfill was originally permitted as an unlined facility in 1994, the FDEP now
requires all new C&D landfills to be lined to reduce and minimize groundwater impacts. Nevertheless,
SWDD is committed to evaluating and remediating such impacts in full cooperation with the FDEP.
The work outlined in this work order by Geosyntec will assist in establishing a robust historical database
going back to 1978 when the Class 1 Landfill originally started. Historical trends and establishing
background groundwater quality is essential in evaluating the path forward. In addition, Geosyntec is
evaluating alternative remedial technologies that are passive in nature, effective and overall least costly.
They have proposed to evaluate their patented TreeWell phytoremediation technology, which is a plant -
based remediation technology.
Funding:
Funding for the compliance monitoring and reporting is budgeted and available in the Engineering Services
account in the SWDD Landfill Fund, which is funded from SWDD assessments and user fees. The account
has a total budget of $415,000 for the 2020/2021 fiscal year.

Dear Mr. Mehta:
Geosyntec Consultants, Inc. (Geosyntec) is pleased to submit this letter proposal to the Indian
River County (IRC) Solid Waste Disposal District (SWDD) to provide professional services
supporting the operation of the Class I landfill and Construction and Demolition (C&D) debris
disposal facility at the IRC Landfill (IRCL) site located in Vero Beach, Indian River County,
Florida (Site). The proposal presents the scope of work, schedule, and budget estimate for the
technical support services relating to groundwater compliance at the Class I Landfill and the
C&D disposal facility.
Geosyntec has prepared this proposal (professional services as Exhibit A of CCNA-2018-WO
No. 8, pursuant to that certain Continuing Contract Agreement for Professional Services, dated
April 17, 2018 (collectively referred to as the "Agreement"), by and between INDIAN RIVER
COUNTY, a political subdivision of the State of Florida ("COUNTY") and Geosyntec
("Consultant").
The remainder of this proposal presents: (i) project background; (ii) proposed scope of services;
(iii) schedule; and (iv) budget estimate.
PROJECT BACKGROUND
The IRCL site is located south of Oslo Road, west of Range Line Road (74ffi Avenue) and east of
Interstate 95 in Section 25, Township 33 South, Range 38 East in Indian River County, Florida.
The IRCL site occupies 276 acres, with approximately 141.5 acres permitted for Class I disposal,

19 acres is comprised of Cell 1 C&D debris disposal facility, and 2.5 acres consists of a C&D
debris recycling facility.
The Class I landfill currently accepts both Class I waste and C&D debris for disposal under the
Florida Department of Environmental Protection (FDEP) Construct and Operate Permit
Modification Nos. 0128769 -026 -SC -IM and 0128769 -027 -SO -MM, dated April 2, 2018 (Class I
Permit). The C&D debris disposal facility operates under FDEP Permit No. 0128769 -025 -SO -
24, dated July 13, 2017 (C&D Permit).
The Water Quality Monitoring Plan (WQMP) for each of the IRCL facilities permits (which is
listed as Appendix 3 of each permit) indicates that groundwater and surface water quality
monitoring are required. Semi-annual sampling of the Class I landfill and C&D debris disposal
facility groundwater monitoring wells shall be conducted in January and July 2020. The samples
collected from the Class I landfill and C&D debris disposal facility monitoring wells shall be
analyzed for the routine monitoring parameters listed in Section 11.3 (Class I Permit) and
Paragraph 8 (C&D Permit) of the WQMP, respectively, as required by paragraphs 62-
701.510(5)(c) & (7)(a) and 62-701.730(8)(d), Florida Administrative Code (F.A.C.). Samples
from one surface water monitoring site (SW -2) shall be collected semi-annually in January and
July, if water is discharging from the stormwater pond. The samples, if collected, shall be
analyzed for the list of parameters listed in Section I11.2 of the Class I Landfill WQMP, as
required by paragraphs 62-701.510 (5)(d) and (7)(b), F.A.C.
Semi -Annual Water Quality Compliance Monitoring for the Class I Landfill
A comment letter from FDEP dated 6 May 2020 provided comments regarding the results of the
January 2020 Semi -Annual Water Quality Monitoring Report for the Class I landfill. The FDEP
provided notification to SWDD to initiate evaluation monitoring at all monitoring wells with
detected exceedances above applicable groundwater cleanup target levels (GCTLs) for pH,
ammonia, chloride, sodium, TDS and arsenic. Geosyntec provided a response to comments
(RTC) letter the FDEP comment letter on 28 May 2020 which focused on the long-term trends
with the dataset available from the FDEP Water Assurance Compliance System (WACS)
database and requested a reduction of evaluation monitoring locations from 25 locations (as
originally requested by the FDEP in the 8 May 2020 letter) to 4 locations (specifically
downgradient of MW -3S, MW -145, MW -44S and MW -44I). The FDEP approved this request
in a letter dated 14 August 2020 and the 90 -day evaluation monitoring period was initiated on 17
September 2020 through a second RTC letter provided to FDEP.

Ouarterly Assessment Water Ouality Compliance Monitoring for the C&D Debris Disposal
Facili
Results of routine sampling of C&D debris disposal facility groundwater monitoring well (MW -
21 S) in January 2017 indicated exceedances of benzene and sodium GCTLs. As a result, SWDD
was requested by FDEP to initiate evaluation monitoring in accordance with subsection 62-
701.510(6), F.A.C. Pursuant to this request SWDD installed one groundwater monitoring well
(MW -49S) in July 2017. These and other wells (MW -21S, MW -33S, MW -35S, MW -40S, MW -
49S, MW -50S, MW -51S, and MW -52S) and three surface water (SW) Lateral Canal (LC)
sample sites (SW-LC1, SW-LC2, and SW-LC3) have been sampled quarterly from July 2017 to
October 2019 under an evaluation monitoring program with FDEP. However, in correspondence
from FDEP to SWDD dated 14 October 2019, the FDEP approved SWDD's request to replace
the evaluation monitoring of the eight groundwater wells and three surface water sample sites
with quarterly assessment monitoring and with the addition of other parameters (arsenic,
benzene, naphthalene, and other semi -volatile organic compounds [VOCs]) to the suite of
parameters to be analyzed for at these wells. The FDEP also requested establishing background
water quality for seven (7) additional surface water sampling sites (LC4-SW to LC10-SW) along
the Lateral C canal. SWDD sampled and analyzed water -quality for these surface water sites in
the January and April 2020 quarterly water -quality assessment events. Following, the April
2020 quarterly sampling event, FDEP approved (via e-mail on 17 July 2020) SWDD's request to
limit the monitoring of the surface water sites to SW -LC 1, SW-LC2, SW-LC3 and SW-LC4.
Results of the quarterly sampling downgradient of the C&D debris disposal facility have
indicated persistent detections of ammonia, arsenic, sodium, iron, TDS, TN and TP in
groundwater and persistent detections of ammonia, sodium, iron, TDS, TN and TP in surface
water sampling locations in the Lateral C Canal adjacent to the evaluation groundwater
monitoring locations. Geosyntec completed a site visit on 21 July 2020 as summarized in a 10
August 2020 memorandum to SWDD. One of the objectives of the site visit was to visually
observe the site conditions on the east side of the C&D debris disposal facility and the Residuals
Dewatering Facility (RDF) relative to the current monitoring wells and surface water monitoring
locations. A stormwater management ditch located between the C&D debris disposal facility
and the RDF is suspected to be a potential source area for the persistent detections. A
supplemental groundwater assessment is recommended in this area to identify the lateral and
vertical extent of the groundwater impacts and to collect information to evaluate the remedial
alternatives including groundwater extraction via TreeWell° phytoremediation technology. The
information collected will be valuable with respect to other areas at the Site should additional
assessment be required.

Tree Well systems are engineered phytoremediation plantings designed to aggressively draw
groundwater from the saturated zone, thereby increasing groundwater extraction rates and
meaningfully controlling the flow dynamics of an aquifer. It is an active remedial system that
operates in a passive manner, with no external energy requirement, resulting in significantly
reduced operation and maintenance (O&M) costs. Geosyntec has the experience to design and
implement these systems and is licensed to provide Tree Well units to our clients. We have
successfully implemented these systems in Florida and across North America.
PROPOSED SCOPE OF SERVICES
The proposed scope of services includes activities to be performed on behalf of SWDD for the
evaluation monitoring downgradient of the four wells for the Class I landfill and supplemental
groundwater assessment at the C&D debris disposal facility. For the purpose of budgeting, the
scope of work has been divided into the following four (4) main phases:
• Phase 1 — General Consulting/Meeting Support/Project Management;
• Phase 2 — Database Preparation;
• Phase 3 — C&D Debris Disposal Facility Supplemental Groundwater Assessment; and
• Phase 4 — Class I Landfill Evaluation Monitoring.
The above scope of services is based on current regulations and reporting requirements for the
IRCL facility as previously discussed above. An amendment to this scope of services may be
needed should there be any regulatory changes that result in additional work. The remainder of
this section presents a general description of the activities to be performed in each phase.
Phase 1— General Consulting/Meeting Support/Project Management
Under this phase, Geosyntec will perform project planning and management responsibilities,
such as correspondence with SWDD and FDEP, invoice review, project coordination, prepare a
site-specific Health and Safety Plan, preparation of a work plan for FDEP approval for the tasks
outlined in Phase 3 of this proposal and project administration. Geosyntec has also included
budget for preparation and attendance (by three Geosyntec personnel) at two meetings with
SWDD and/or FDEP, as needed.

Phase 2 — Database Preparation
The historical groundwater and surface water analytical data collected at both the Class I landfill
and the C&D debris disposal facility is not currently in a database for long-term trend analysis
which will be required to justify background demonstrations needed in the future and to address
specific FDEP issues raised as summarized below.
• The FDEP comment letter dated 6 May 2020 indicated evaluation monitoring was
required at 25 of the Class I landfill monitoring wells, however, when presented with an
evaluation of the long-term groundwater concentration trends generated from the WACS
database the requirement was reduced to 4 wells. It should be noted that the WACS
database is not complete and will need to be supplemented with additional data.
• The FDEP letter dated 14 August 2020 indicated the enforcement of a groundwater
standard for ammonia based upon regional surface water analytical results. In order to
effectively address this FDEP comment in the future, a complete database will be needed
which includes the Site and regional surface water analytical data.
To supplement the existing WACS database, groundwater and surface water data from the
following sources will be integrated into a new database:
1. Baseline analytical data from initial Hydrogeologic and Geotechnical reports from both
the Class I landfill and C&D debris disposal facility;
2. Biennial reports from both the Class I landfill and C&D debris disposal facility (dating
back to 1978);
3. Contamination Evaluation Reports or any other Assessment Monitoring Report from
both the Class I landfill and C&D debris disposal facility; and
4. Information from the STORET database from surface water and groundwater monitoring
locations within a one -mile radius of the Site and all surface water monitoring locations
within the Lateral C Canal between the Site and the Indian River Lagoon.
Geosyntec will have to retool most of this information from a table that was presented in a report
to an electronic form (in Microsoft® Excel) that can be uploaded into this format. Geosyntec has
assumed that 47 reports will need to be retooled.
The deliverable for this task will be a Microsoft® Access format of the database and two (2)
figures indicating the local and regional data collection locations. The Microsoft® Access will
include various queries and reports that will allow Geosyntec to perform the trend analysis on the

historical groundwater and surface water quality data. It should be noted that upon the generation
of this database, it will be easier to analyze trends going forward at the Site as part of the
groundwater monitoring program.
Phase 2 — C&D Debris Disposal Facility Supplemental Groundwater Assessment
Quarterly assessment is currently being performed on the eastern side of the C&D debris
disposal facility to monitor conditions of groundwater and surface water to meet objectives
outlined by FDEP electronic mail (e-mail) correspondence dated 10 June 2019, 22 August 2019,
and 3 October 2019. A supplemental groundwater assessment is required to evaluate the
groundwater conditions between the C&D debris disposal facility/RDF and the Lateral C Canal
to the east. Specifically, the dimensions of the plume consisting of elevated conductivity and
nutrients need to be characterized in order to assess remedial alternatives including groundwater
extraction via Tree Well phytoremediation technology.
In order to accomplish this objective, a supplemental groundwater assessment is recommended
consisting of groundwater screening followed by the installation of temporary piezometers at
targeted intervals. Groundwater screening will be completed by advancing a 5 -foot stainless
steel slotted screen and using direct push technology (DPT) methods. The focus of the
groundwater screening will span from the water table to an approximate depth of 25 feet (ft)
below ground surface (bgs). Groundwater will be purged from each 5 -ft interval and screened
with a water quality probe capable of monitoring temperature, pH, conductivity, oxidation
reduction potential (ORP) and ammonium. Turbidity will also be monitored using a
turbidimeter. Each groundwater screening interval will be purged at least 3 equipment volumes
until stability of field parameters is achieved per FDEP Standard Operating Procedures (SOPS)
or a maximum purging period of 30 minutes. It is estimated a total of six (6) locations will be
screened with the approximate locations summarized below. Locations may be adjusted based
upon the results of the initial screening locations. The intent is to delineate the north/south
extent of the elevated conductivity and nutrients in groundwater. Each location will be
abandoned with tremie applied cement grout slurry.

Temporary piezometers will be installed at three (3) locations within the groundwater assessment
area using hollow stem auger (HSA) methods to enable further subsequent sampling. A
continuous soil sample will be collected prior to monitoring well installation and logged.
Selected horizon/lithologic units will be sampled and 'submitted to the agronomic laboratory,
ServiTech, for analysis of select soil agronomic test parameters) to evaluate the feasibility of the

sulfur, calcium, magnesium, sodium, zinc, iron, manganese, copper, organic matter, soil pH, buffer pH, soluble salts,

application of engineered phytoremediation techniques as a potential remedial approach. The
temporary piezometers will be constructed of 2 -inch (in.) schedule (SCH) 40 poly -vinyl chloride
(PVC) well materials including a 10 -slot (0.001 -in.) screen including a 20/30 graded silica sand
filter pack, 30/65 graded silica sand seal and cement grout slurry to surface. The completion
interval of the temporary piezometers will be based upon the groundwater screening results.
Each temporary piezometer will be completed with an above ground protective casing and three
steel bollards. Each temporary piezometer will be developed for a period of one hour either prior
to grouting or at least 24 hours after grouting. Slug testing will be completed at each of the three
(3) new temporary piezometers to estimate the aquifer permeability which is needed to evaluate
the groundwater velocity to assess remedial alternatives including groundwater extraction via
Tree Well phytoremediation technology.
A single round of groundwater samples will be collected from each of the three (3) new
temporary piezometers for the parameters as required by paragraphs 62-701.510(5)(a) and (c),
F.A.C., and will also include TN and TP. Additionally, a groundwater sample from each
temporary piezometer will be submitted to ServiTech for analysis of select groundwater
agronomic test parameters to evaluate the feasibility of the application of engineered
phytoremediation techniques as a potential remedial approach. The intention is to collect the
temporary piezometer groundwater samples during the October 2020 quarterly C&D debris
disposal facility assessment monitoring event. Any subsequent sampling at the three (3)
temporary piezometers will be included in a subsequent proposal for the 2021 water -quality
compliance monitoring program.
The result of the supplement groundwater assessment will be summarized in a technical
memorandum which will include:
1. Summary of field methods;
2. Summary of field and analytical laboratory results;
3. Evaluation of remedial options including feasibility of groundwater extraction via
Tree Well phytoremediation technology; and
4. Recommendation for path forward for remediation.
Geosyntec will oversee the DPT groundwater screening and HSA soil sampling and temporary
piezometer installation. The subcontracted driller will be JAEE of Davie, Florida. Geosyntec
2 Groundwater agronomic parameters to be analyzed by ServiTech will include: nitrate -nitrogen, chloride, sulfate -
sulfur, carbonate, bicarbonate, calcium, magnesium, sodium, potassium, boron, total hardness, total dissolved solids,
alkalinity, electrical conductivity, sodium adsorption ratio (SAR), adjusted SAR (SARa), sodium, % of cations,
water pH, pHc, nutrients in lb/acre-foot, potassium as K20, ammonia, phosphorus as P205, total nitrogen (Calc),
total phosphorus, total Kjeldahl nitrogen.

will re -install staff gauges at the surface water sampling locations LC-SW5 and LC-SW6. Peavy
& Associates Survey & Mapping, PA (Peavy) will conduct a top -of -casing survey at the three (3)
new evaluation monitoring wells and survey the two (2) re -installed staff gauges. Geosyntec will
subcontract the field sampling activities to Ideal Technical Services (ITS). ITS is currently
performing the sampling for the semi-annual compliance and quarterly assessment monitoring
events at the IRCL facility. Where noted, the agronomic analytical analysis will be completed
by ServiTech of Dodge City, Kansas. The other analytical testing will be conducted by ENCO
Laboratories (ENCO) of Orlando, Florida, the analytical laboratory contracted with, and direct
bill to, SWDD.
A work plan detailing the scope of work detailed in this task will be provided to FDEP for
approval at least 45 days prior to anticipated start date of the scope of work detailed in this Task.
The results of the initial temporary piezometer water -quality monitoring event will be integrated
into the October 2020 quarterly assessment report for the C&D debris disposal facility and will
be reported to FDEP within 60 days of receipt of analysis from the laboratory. The technical
memorandum will be submitted to FDEP within 90 days of receipt of analytical data.
Geosyntec assumes the areas where the groundwater screening and temporary piezometers need
to be installed will be cleared by SWDD and SWDD will provide assurance that the drilling
areas are clear of subsurface utilities; otherwise, a subsurface utility survey will be performed
prior to initiating work.
Phase 4 —Class I Landfill Evaluation Monitoring
The installation and sampling of four (4) evaluation monitoring wells is required per
correspondence with FDEP dated 17 September 2020 as noted above. The evaluation
monitoring wells must be installed at the edge of the zone of discharge (ZOD) which is located
100 ft from the edge of waste and downgradient of existing detection monitoring wells: MW -3 S,
MW -145, MW -44S and MW -44I. The evaluation monitoring wells will be installed with
identical construction to the detection monitoring wells where the evaluation monitoring is to
occur.
The evaluation monitoring wells will be installed using HSA methods and constructed of 2 -in.
diameter SCH 40 PVC well materials including a 10 -slot (0.001 -in.) screen including a 20/30
graded silica sand filter pack, 30/65 graded silica sand seal and cement grout slurry to surface.

sample total ammonia nitrogen (TAN) value will be calculated at each evaluation monitoring
location using the average pH and temperature from the contemporaneously collected surface
water samples from sampling locations C5-SW1 and C5-SW3. Subsequent rounds of quarterly
evaluation groundwater monitoring for the parameters as required by paragraph 62-
701.510(5)(a), F.A.C. will be completed, however, the charges associated with these events will
be included in our 2021 groundwater monitoring proposal

SCHEDULE
Geosyntec will initiate work immediately upon receipt of Notice to Proceed (NTP) from SWDD.
The compliance reports required by each permit will be completed and submitted to FDEP
before the deadlines discussed above. Other technical and miscellaneous permit compliance
support services will be provided on an as -needed basis.
BUDGET ESTIMATE
Geosyntec proposes to perform the above -referenced work on a lump sum basis for $134,972.70.
A budget estimate for the scope of work outlined in Phases 1 through 4 of this proposal
is summarized in the following table, and a detailed budget estimate is provided as Attachment
1. The budget estimate presented in this proposal is based on Geosyntec's understanding of
