HomeMy WebLinkAbout1990-1008/23/90(UTIL)Reso2(DO/Vk) RESOLUTION NO. 90- 100 A RESOLUTION OF INDIAN RIVER COUNTY CONFIRMING THE SPECIAL ASSESSMENTS IN CONNECTION WITH A WATER MAIN IN HEDDEN PLACE AND PROVIDING FOR SPECIAL ASSESSMENi'=RS-Tam MADE OF RECORD. WHEREAS, the Board of County Commissioners of Indian River County has, by Resolution No. 90-91, adopted August 14, 1990, determined to make special assessments against certain properties to be serviced by a water main of the County located in HEDDEN PLACE; and WHEREAS, said resolution described the manner in which said special assessments shall be made and how said special assessments are to be paid; and WHEREAS, the resolution was published as required by 411-52, Indian River County Code; and WHEREAS, an assessment roll in connection with said special assessments has been prepared; and WHEREAS, the Board of County Commissioners of Indian River County passed Resolution No. 90-92 on August 14, 1990, which set a time and place for a public hearing at which the owners of the properties to be assessed and other interested persons would have the chance to be heard as to any and all complaints as to said project and said special assessments, and for the Board to act as required by 511-53, Indian River County Code; and WHEREAS, notice of the time and place of the public hearing was published in the Press Journal Newspaper on Frida , August 17, 1990 and Frida , Au ust 24_ 1990, (twice ----Y--------__--------Y----B----- ----- one week apart and the last being at least one week prior to the hearing) as required by 511-52, Indian River County Code; and RECORD VERIFIED JEFFFIEY K. RRRTON CLERK CIS' INDIAN, .:. nis document Vons propnred by AILS] should be ret1 rnet] to the County A foeltt y'c Office, 11340 251h St., Vcro Beach, Florida 32960 RESOLUTION NO. 0() -Inn WHEREAS, the land owners of record were mailed notices on Monday, August 20 1990, (at least ten days prior to the hearing) as required by 411-52, Indian River County Code; and WHEREAS, the Board of County Commissioners of Indian River County on Tuesday__ September 4, 1990, at 9:05 A.M. conducted the public hearing with regard to the special assessments; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows: 1. The special assessments shown on the attached assessment roll are hereby confirmed and approved, and shall remain legal, valid, and binding first liens against the properties assessed until paid in full. 2. That the County will record the special assessments and this resolution, which describes the properties assessed and the amounts of the special assessments, on the public rer�rds which shall constitute prima facie evidence of the validity of the special assessments. The resolution was moved for adoption by Commissioner Wheeler and the motion was seconded by Commissioner Scurlock __— and, upon being put to a vote, the vote was as follows: Chairman Carolyn K.
