PROCLAMATION DECLARING A LOCAL STATE OF EMERGENCY IN
INDIAN RIVER COUNTY, FLORIDA, IN CONNECTION WITH COVID-19
WHEREAS, COVID-19 cases in Indian River County are on the rise; and
WHEREAS, Indian River County wishes to have the flexibility under section 252.38, Florida
Statutes, in addressing the increase in cases, to waive the procedures and formalities otherwise
required of Indian River County pertaining to:
a. Performance of public work and taking whatever prudent action is necessary to
ensure the health, safety, and welfare of the community and the County work force.
b. Entering into and modifying existing contracts.
c. Incurring obligations.
d. Employment of permanent and temporary workers to provide essential services.
e. Utilization of volunteer workers.
f. Rental of equipment.
g. Acquisition and distribution, with or without compensation, of supplies, materials,
and facilities.
h. Appropriation and expenditure of public funds
; and
WHEREAS, Indian River County will not infringe the rights or liberties of individuals or
businesses within Indian River County; and
WHEREAS, pursuant to section 101.10(1) of the Code of Indian River County, and
Resolution 2020-104 of the Indian River County Board of County Commissioners, the County
Administrator is authorized to declare a local state of emergency upon making a determination that a
disaster has occurred or is imminent, requiring immediate and expeditious action; and
NOW, THEREFORE, in my capacity as County Administrator, 1 hereby (1) determine that,
by reason of COVID-19, the threat of a disaster has occurred, requiring immediate and expeditious
action, (2) declare that a local state of emergency exists and continues in all of Indian River County,
Florida, effective as of 7:00 a.m., on October 1, 2021. _ A
