Reed Knight and Mary Betty Knight have applied to the Board of County Commissioners of Indian River County, Florida at their regular meeting today, Tuesday, March 3, 1953 at 9 o'clock A.M. to vacate in part the plat off"Penn Park )`' a subdivision recorded in Plat Book 2, page 2, public records of Indian River County, Florida, and WHEREAS, said C. Reed Knight and 14ary Betty Knight have] conclusively shown that they are the owners of foe simple title to that part of said subdivision sought to be vacated, which part of said subdivision sought to be vacated is described as follows,' to -wit: �j All of the plat of "Penn Park" a subdivision recorded in Ii Plat Book 2, page 2, public records of Indian River County, Florida, EXCEPT that part of said subdivision lying in and including the E 10 Acres of NEI of SW4, Section 13, Township 33 South, Range 39 East, and also it that is rt of said subdivision lying East of the East action j boundary line of the SWg of Sn 13, township 33 ii South, Range 39 Fast; and I� WHEREAS, said C. Reed Knight and Mary Betty Knight have; further shown that the vacation by the Board of County Commission, ers of the part of said subdivision sought to be vacated will not: affect the ownership of persons owning other parts of said sub- division, and WHEREAS, they have shown that no conveyance has ever been made of record using said plat as a reference, but rather that all conveyances of said property have used only a description with reference to acreage or a metes and bounds description, and that said property has always appeared on the tax and assessment rolls only as acreage, and I WHEREAS, the County Commissioners upon proof duly shown! have found that there is not now nor ever has been any use made i of said subdivision by the public, and i i 17HEREAS, said Board of County Commissioners have found I that there are no streets or alleys that have become necessary for use by the traveling public, and that all streets, avenues, j boulevards alloys and y public rights-of-way shown on the plat f? have never been opened up and used by the public, and that the park dedicated on said plat has never been used as a park by MITCHELL. SMITH d MITCHELL, ATTORNEYS AT LAW, VERO BEACH, FLORIDA the public, and WHEREAS, said Board of County Commissioners do find that said property is not located in any incorporated city or town and that it is for the beat interests of the public and the owners of said property that said plat or subdivision be vacated for the purpose of returning said property into acreage for tax- ation, and WHEREAS, said Board of County Commissioners do further find that newspaper notice as required by law was given and that Proof of Publication as required by law was given and that Proof of Publication as required by law was filed this day with the Board of County Commissioners, NOMI, THEREFORE, BE IT RESOLVED that that portion of "Penn Park", a subdivision recorded in Plat Book 2, page 2, public records of Indi.sn River County, Florida, described as follows, to -wit; All of the plat of "Penn Park" a subdivision recorded in plat book 2, page 2, public records of Indian River County, Florida, Except that part of said subdivision lying in and including the E 10 Anros of NE -.'i- of SW --.I, Section 13, Township 33 South, Range 39 East and also that part of said subdivision lying East of the East boundary line of the SWI of Section 13, Township 33 South, Range 39 East.; be and the same is hereby vacated, abolished, and abandoned.
