WHEREAS, House BS.11 No. 477, adopted at the 1953 Seasion
of the Florida Legislature, authorized the Board of County Com-
missioners of Indian River Cocu_ity,_Florlda, to adopt regulations
proscribing building setback lines i'rom anyroad street or high -
,Amy existing and proposed; Now, therefore,
BE IT RESOLVED by the Board of County Commissioners of
Indian River County, Florida, that pursuant to the authority of
said law, sail Hoard does herewith adopt said buildtng setback
line as follows, to -crit:
1. On State Road 5 (U. S. Highway No. 1) from the south
City Limits of the City of Vero beach to the South County Line, no
building or structure shall be erected or maintained and no build-
ing permit shell issue for the construction of any buildings or
improvement within the liner, end limits of said right of way for
said road as the same now exists rand c:lso no buildin!_ or structure
sheill be erected or msintuined r.,nd no buil.dinj; permit shall issue
for the construction of any bui'ldin, or improvement within the
right of way line proposed for the widening, and improving of sild
road as set forth and contained in the rif;ht of way map of the
State Road Department of the Stute of Florida, Section No, 8801
150 - 191 - 206, which said right or' way inao i.s recorded in the

WHEREAS, House Bill No. 4.77, adopted at the 1953 Session'
of the Florida Legislature, authorizes the Board of County Com-
missioners of Indian River County, Florida, to adopt regulations
prescribing building setback lines-� rom any road, street or high-

way existing and proposed; Now, therefore,
BE IT RESOLVED by the Board of County Commissioners of
Indian River County, Florida, that pursuant to the authority of
said law, said Board does herewith adopt said building setback
line as follows, to -wit:
1. On State Road 5 (U. S. highway No. 1) from the South
City Limits of the City of Vero Beach to the South County Line, no
building or structure shall be erected or maintained and no build -
Ing permit shall issue for the construction of any building or
improvement within the lines and limits of said right of way for
said road as the same now exists and also no building or structure
shall be erected or maintained and no building permit shall issue
for the construction of any building or improvement within the
right of way line proposed for the widening and improving of said
road as set forth and contained in the richt of way map of the
State Road Department of the State of Florida, Sectisn No. 0.801 -
150 - 191 - 206, which said right, of way map is recorded in the
office of the Clerk of the Circuit Court of Indian River County,
Florida, in Plat Book 3 , page 2,6 . The right of way lines as
set forth and delineated on said right of way map are herewith
adopted as the building setback line on said road and no building
or structure shall be erected or maintained and no building permit
shall issue for the construction of any building or improvement
within the area between said rights of way lines on either side
of said road as shown on said right of way map.
2. That no building or structure ehall be erected or
maintained and no building permit shall issue for the construction
of any building or imprcvement abutting on State Road 5, Indian
River County, Florida, from the North City Limits of the City of

Vero Beach, Florida, to the intersection of said road with South
line of Section 28, Township 31 South, Range 39 East, within a

road. Said line 50 feet Eastward and parallel to the center line
of said road is herewith adopted as the building setback line on
the East side of said section of said road and a line parallel to
and 50 feet Westward from the center line of said section of said
road is herewith established as the building setback line on the
West side of said section of said road and no building or struc-
ture shall be erected or maintained and no building permit shall
issue for the construction of any building or improvement within
said building setback lines herewith established.
5. That no building or structure shall be erected or
maintained and no building permit shall issue for the construction
of any building or improvement abutting on the proposed realign-
ment of State Road No- 5, Indian River County, Florida, from the
South line of Section Q, Township 31 Sough, Range 39 East, at the
present intersection of said State Road 5 and said line and ex-
tending Northerly along the center line survey now established on
the ground from naid point to the South lino of the City Limits
of the City of Sebastian within a line parallel to and 50 feet
Easterly from said proposed renter line of said road and within a
line parallel to and 50 feet Westerly from the center line of said
proposed road. Said line 50 feet Eastward and parallel to said
center lino is herewith adoptod as the building setback line on
the East side of said section of Bald proposed road and said line
parallel to and 50 feet Westward from the center line of said pro-
posed road is herewith established as the building setback line on
the West side of said road and no building or structure shall be
erected or maintained and no building permit shall issue for the
construction of any building or improvement within said building

River County, Florida, from the North line of the City Limits of
the City of Vero Beach to the North limits of Indian River County,
Florida, on the proposed realignment, relocation and extension of
said State Road AIA an the center line thereof now exists on the
ground within a line parallel to anti 50 feet Easterly from said
proposed center line of said road and within a line parallel to
and 50 feet Westerly from the center line of said proposed road.
Said line 50 feet Eastward and parallel to said center line is
herewith adopted as the building setback line on the East side, of
said section of said proposed road and said line parallel to and
50 feet Westward from the center line of said proposed road is
herewith ostablished an the building setback line on the West side
of said road and no building or structure shall bo erected or
maintained and no building permit shall issue for the construction
of any building or improvement within said building setback linen
