HomeMy WebLinkAbout1956-014To: Board of County Commissioners, Indian River County, Florida. The undersigned Adelaide T. Zeuch, Warren T. Zeuch, Frederic E. Zeuch and Katherine Z. Forster, do herewith petition and certify under oath to iLq Board of County Commissioners of Indian River County, Florida, as follows, to -wit: That H. J. Zeuch & Co., a Florida corporation, was the record fee simple owner of the following described property, situated in Indian River County, Florida, to -wit: The West half of the South half of the North half of the Southeast quarter of the Southeast quarter of Section 24, Township 33 South, Range 39 East; from the year 1927 until the title to said lands became vested in Indian River County, Florida, under and by virtue of a foreclosure of tax certificates,, instituted by said County in the Circuit Court in and for Indian River Qounty, Florida, in Chancery No. 2398. That said County did, under date of January 31, 1952, convey said lands after public sale to J. Douglas Baker and Marion Baker, his wife. That a question has arisen as to the validity of said sale by said County due to the fact that the said J. Douglas Baker is the Clerk of the Circuit Court of Indian River County, Florida, and as such Clerk made said sale for and upon behalf of said County. That subsequently, the said J. Douglas Baker and wife conveyed said lands to Vero Beach Home Lands, Inc., a. Florida corporation, who subse- quently conveyed the same to Country and Town Investment Company, Inc., a New Jersey corporation authorized to do business in the State of Florida, who now claim to own said lands. That the said 1-1. J. Zeuch & Co., acting by and through a majority of its Trustees, have agreed to sell and convey said lands to said Country and Town Investment Company, Inc., In the event the same are conveyed by said County to the Trustees of said 1-1. J. Zeuch & Co. In order that title may be MITCHELL. SMITH 6 MITCHELL, ATTORNEYS AT LAW, VERO BEACH, FLORIDA 3 then vested in said Country and "Gown Investment Company, Inc. , and said Trustees make this Petition on that premise and do herewith request said County to convey said lands to the said Trustees of FI. J. Zeueh & Co., whose: address is 21.02 Ponce DeLeon Boulevard, Vero Beach, Florida. That the date of the final decree under which the title to said lands was quieted in the County is August 14, 1944. That the price of the lands as previously fixed by Resolution of the Board of County Commissioners is $ ;25, 00 That ii no actual use of said lands was enjoyed by such former owner at the time of entry of said final decree except that of its ownership. That in all good conscience, said lands should now be conveyed to said former owner in order that title to said present owner under the deed from the County may be per- fected. That said former owner offers to pay to the County an amount equal to all taxes which have become delinquent together with interest and costs provided by law, less the stun of $25.00 heretofore paid to said County by the i said J. Douglas Baker and wife. That said lands are not situated and have not been situated in any municipality and in the event the lands have not been assessed for taxes for the current year, then in that event in addition to the amounts above provided for, said former owner offers to include an amount which would pay the taxes for the current and any omitted years, such latter amount to be determined by applicable miliage for such omitted years and based upon said last assessment of said lands. That said lands were acquired prior to January 1, 1946, by Indian River County for delinquent taxes under the provisions of Chapter 22079, Laws of Florida, Acts of 1943, and were described and recorded in the book designated "County Lands Acquired for Delinquent Taxes" on file in the office of the Clerk of the Circuit Court of said County and because of the reasons Hereinbefore recited, have not been previously sold and have not been dedicated by the County in the manner prescribed by law. That attached hereto, marked "Exhibit A" and as such trade a part hereof, is the Certificate of the Clerk of the Circuit Court of said County showing the amount of all delinquencies existing at the time the title to the -2- MITCHELL, SMITH A MITCHEL!., ATTORNEYS AT LAW, VERO BEACH, FLORIDA to 40 lands became vested In the County and estimates of the amount of taxes which would have accrued to said lands had not the title reverted to the County. That the total thereof Is $ 47.24 and after subtracting the suin of $25.00 heretofore paid, the balance Is $ 22. 24 which said sum is herewith tendered to said County in cash. I? J. ZeUCh & Co. , a Florida corporation at the time of Its dissolution, constituting a majority of its Board of `Trustees for the property owned by said dissolved corporation.
