HomeMy WebLinkAbout1961-004A RESOLUTION WHEREAS, Ruth Hotchkiss Millman and Richard M. Bilinian, her husband, and others who own land that abuts upon an existing park located outside the corporate limits of any municipality and which is not a State or Federal park and owns lands adjoining said park, has petitioned this Board requesting this Board to vacate, abandon, discontinue and close the existing park of the County located upon the property situated in Indian River County, Florida, described as follows, to -wit: Beginning at the Southeast corner of Lot 4, Block 6, according to Plat of Lone Palm Park Subdivision, which said plat was filed February 24, 1926, and recorded in Plat Book 1, page 61, pub- lic records of Indian River County, Florida, run South 120 feet, more or less, to Elie Northeast corner of Lot 7 in said Block 6; thence run West along the North line of Lot 7 and Lot 14 in said Block 6 a distance of 250 feet to the Northwest corner of said Lot 14; thence run North 120 feet, more or less, to the South- west corner of Lot 17 in said Block 6; thence run East on the South line of said Lots 17 and 4 a distance of 250 feet to the point of beginning. Now, therefore, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida, that this Board does herewith declare that a public hearing will be held to consider the advisability of vacating, abandoning, dis- continuing and closing the above described existing park which was dedicated as a public park in the original plat of said subdivision and has been used by Indian River County, Florida, as a public park since that time, and consider- ing the advisability of renouncing and disclaiming any right of the County and of the public in and to the land constituting such park. Said public hearing will be held in the offices of said Board in the Indian River County Courthouse, Vero Beach, Florida, on the 6th day of June, 1961, at 10:00 o'clock A.M. ; and, BE IT FURTHER RESOLVED that all landowners owning lots or parcels of land in said Lone Palm Park Subdivision, Plat Book 1, page 61, of which the park sought to be closed is a part, shall be mailed notice to their last known addresses as disclosed by the last tax assessment roll of said County at least twenty-eight (28) days before said hearing and the proof of s iiailing of such notice to said landowners shall be filedwith the Board by the Clerk of the: Circuit Court; and, BE IT FURTHER RESOLVED that a notice thereof shall be pub- lished one time in the 'Vero Beach Press journal, a newspaper of general cir- culation in Indian River County, Florida, which publication shalt be at least two (2) weeks prior to the date stated therein for such public hearing; and, BE 1T FURTHER RESOLVED that should either twenty (20) per cent of the landowners or ,the owners of twenty (20) per cent of the lots in the subdivision in which said park is located or the owner of any lot in said sub- division located within 404 feet of said park and on which lot any building exists object at said hearing before the Board to said Petition initiated as to the closing of said park, then the Board of County Commissioners shall deny said Petition. 4 40 40I s iiailing of such notice to said landowners shall be filedwith the Board by the Clerk of the: Circuit Court; and, BE IT FURTHER RESOLVED that a notice thereof shall be pub- lished one time in the 'Vero Beach Press journal, a newspaper of general cir- culation in Indian River County, Florida, which publication shalt be at least two (2) weeks prior to the date stated therein for such public hearing; and, BE 1T FURTHER RESOLVED that should either twenty (20) per cent of the landowners or ,the owners of twenty (20) per cent of the lots in the subdivision in which said park is located or the owner of any lot in said sub- division located within 404 feet of said park and on which lot any building exists object at said hearing before the Board to said Petition initiated as to the closing of said park, then the Board of County Commissioners shall deny said Petition. 0 4► PROOF OF ",AAILINC f ;STATE OF FLORIDA (COUNTY O1' INDIAN RIVER I; 1, DOUGLAS BAKER, Clerk of the Circuit Court and ex officio j'.Clerk of the Board of County Commissioners of Indian River County, Florida, do herewith certify that I did, at lease twenty-eight (28) days before the hearing 11set forth in the above and foregoing Notice, mail a copy of said notice to all 1! landowners owning lots or parcels of land in the subdivision described in the above notice of which the park sought to be closed is a part, such mailing being to their last known address as disclosed by the last tax assessment roll of said County.
