WHEREAS, the Board of County Commissioners of Indian River
County, Florida, has found it necessary and does find It neces-
sary to acquire land in Indian River County, Florida, for use
as a public dump and for future use as a sanitary land fill
project; and,
WHEREAS, said Board has found and does find that the land
hereinafter described is entirely suitable for such purposes
and that the purchase of said land is necessary for the fulfill-
ment of such purposes and that the purchase price hereinafter
named is the fair market value of and a reasonable purchase
price for such land; NOW, THEREFORE,
BE IT RESOLVED, by the Board of County Commissioners of
Indian River County, Florida, that Indian River County purchase
from Herschel A. Auxier, individually and as trustee, for a cash
price of $31,500.00, the following described land lying and being
in Indian River County, Florida:
West 10 acres of Tract 9, East 10 acres of Tract 10,
West 10 acres of East 20 acres of Tract 10, and East
11.11 acres of West 21.11 acres of Tract 10, all it,
Section 28, Township 32 South, Range 39 East, ac-
cording to the last general plat of lands of the
Indian River Farms Company filed in the office of
the Clerk of the Circuit Court of St. Lucie County,
Florida, in Plat Book 2, page 25; said land now
lying and being in Indian River County, Florida.
Subject to all. easements, rights-of-way, restrictions
and reservations of record.
BE IT FURTHER RESOLVED, that all ad valorem and other taxes
on said land for 1962 be prorated as of the date of delivery of
the deed and the payment of the purchase price.
BE IT FURTHER RESOLVED, that no part of such purchase price be
paid and that delivery of a deed to said land not be accepted until
title evidence in the form of abstract of title showing good and
marketable title vested in said Herschel A. Auxier has been de-
livered to Indian River County, and until such title has been
approved by the County Attorney.
Al Webber presented for Attorney Charles Herring the following
Resolution on Oslo Road right-of-way. Motion was made by Commis-
sioner Macdonald, seconded by Commissioner McCullers and unanimously
carried, that the same be adopted and that $860.00 is authorized to
be paid into the Registry of the Court Fund for Condemnation Suit No.
5760.
