HomeMy WebLinkAbout1963-003,­,:, O 'arc Motion was made by Commissioner Macdonald, seconded by Commis- sioner Waddell and unanimously carried, that the following Resolution be adopted: RESOLUTION WHEREAS, a proposed subdivision plat entitled "ST. JOHNS DRAINAGE DISTRICT UNIT NO. 4" has been submitted to the Board of County Commissioners of Indian River County, Florida, for approval, which plat subdivides a certain parcel of land situated in Indian River County, Florida, described as follows: From the N.E. corner of Section 25, Township 33 South, Range 37 East, run North 89031' West a distance of 5400.001; thence run South 210.00' to the point of beginning; thence run North 89020' West a distance of 5536.60' to a point; thence run South 00030' West a distance of 5015.81' to a point; thence run South 89020112" East a distance of 5579.60' to a point; thence run North a distance of 5015.81' to the point of beginning. Containing 639.999 acres in parts of Sections 26 and 27, Township 33 South, Range 37 East, Indian River County, Florida, Subject to an easement for the purpose of vehicular and pedestrian ingress and egress, utilities above and below ground; drainage and other uses in conformance with the master plan for the development of this parcel and the surrounding and adjacent parcels of land. Said easement is over the North 30.001; the West 30.001; the East 30.001; and the South 30.00'; of the above described property and the West 100.00' of the East 2818.00' of the above des- cribed property, but which plat does not comply with all of the rules, regulations and requirements of the subdivision resolution of Indian River County, Florida, and, WHEREAS, pursuant to Section XI of said resolution, the Board of County Commissioners of Indian River County, Florida, may authorize a variance from such rules, regulations and requirements when, in its opinion, undue hardship may result from strict compliance therewith, and, WHEREAS, the Board of County Commissioners of Indian River County, Florida has taken into account the nature of the proposed use of land, which is agricultural; and the existing use of land in the vicinity, which is also agricultural; the number of persons who reside or work in the proposed subdivision, which is negligible; the probable effect of the proposed subdivision upon traffic, which is negligible; and the public health, safety and convenience conditions in the subdivi- sion and in the vicinity thereof, which are not adverse to the public welfare; and, WHEREAS, the Board of County Commissioners of Indian River. County, Florida, has found and does find that there are special circumstances or conditions affecting said property such that the strict application of the provisions of the zoning resolution of Indian River County, Florida, would deprive the owners of said land of the reasonable use of their land, that the variance is necessary for the preservation and enjoyment of substantial property rights of the subdividers and that the granting of the variance will not be detrimental to the public welfare or injurious to the property in the general area in which the proposed subdivision is situated; WHEREFORE, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida, that the proposed plat of St. Johns Drainage District Unit No. 4 mentioned above, pre- pared by Lloyd and Associates, Engineers & Surveyors, Vero Beach, Florida, under date of October 11, 1962, be and the same is herewith and hereby approved and admitted to record.
