HomeMy WebLinkAbout2022-004RESOLUTION NO. 2022- 004 A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA, RELEASING AN EASEMENT (OR PORTION THEREOF) ON TRACT C, TIMBERLAKE SUBDIVISION WHEREAS, Indian River County has an interest in a emergency access easement in Tract C, of TIMBERLAKE SUBDIVISION; and WHEREAS, TIMBERLAKE-VERO BEACH HOMEOWNERS ASSOCIATION INC, the owner(s) of the property, has made application to Indian River County requesting that the County release the easement, or portion thereof; and WHEREAS, the retention of the easement, or portion thereof, as described below, serves no public purpose; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Indian River County, Florida that: INDIAN RIVER COUNTY DOES HEREBY RELEASE and abandon all right, title, and interest that it may have in the following described easement(s): to release the twenty (20) foot emergency access easement located within the south west portion of Tract C landscape, less and except any portions of the ten (10) foot drainage easement within Tract C landscape, Timberlake Subdivision, according to the peat thereof, as recorded in Plat Book 22, Page 68 of the Public Records of Indian River County, Florida. This release of easement is executed by Indian River County, a political subdivision of the State of Florida, whose mailing address is 1801 27th Street, Vero Beach, Florida 32960. THIS RESOLUTION was moved for adoption by Commissioner Flescher , seconded by Commissioner Earman , and adopted on the 18th day of January , 2022, by the following vote: Chairman Peter D.
