WHEREAS, the fee simple owner of the property described herein, VERO BEACH ASSOCIATED DEVELOPERS, INC., a Florida corporation, pursuant to Florida Statutes 5177.101 petitioned the Board of County Commissioners of Indian River County, Florida, to partially vacate the Plat of Park Shores recorded in Plat Book 10, page 74, Public Records of Indian River County, Florida; and WHEREAS, the TOWN OF INDIAN RIVER SHORES by Resolution No. 366 vacated that portion of the Plat of Park Shores recorded in Plat Book 10, page 74, Public Records of Indian River County, Florida, described as follows: Commencing at the Northwest corner of the Plat of Park Shores as recorded in Plat Book 10, Page 74, Public Records of Indian River County, Florida; run South 20°55151" East a distance of 974.72 feet to the Point of Beginning; thence run North 69°00114" East a distance of 180.00 feet to a point; thence run North 20°55151" West a distance of 284.75 feet to a point; thence run North 69°00'14" East a distance of 94.65 feet; thence run South 20"55151" East• a distance of 622.15 feet to a point; thence run North 69°00114" East a distance of 265.35 feet to a point; thence run South 20°55151" East a distance of 420.85 feet to a points thence run South 69°00'14" East a distance of 540.00 feet to a point; thence run North 20°55'51" Wast a distance of 758.25 feet to the Point of Beginning. and WHEREAS, pursuant to Florida Statutes 5177.101 approval by Resolution of the hoard of County Commissioners of Indian River County, Florida in required to complete the vacation of that portion of the plat above described; and WHEREAS, notice of application for vacation of that portion of the Plat for Park Shores described herein has been published as required by Florida Statutes; and WHEREAS, convenient access to persons owning the property in the balance of the platted area has been provided by that Easement and Maintenance Agreement dated ,Tune 20, 1989, and recorded in Official Record Book 834, Page 1463, Public Records of Indian River County, Florida; and WHEREAS, taxes affecting the property herein described 1 are paid. NOW, THEREFORE, BE IT RESOLVED by tho Board of County Commissioners of Indian River County, Florida as follows: 1. That the Board of County Commissioners of Indian River County, Florida, hereby vacates that portion of the Plat of Park Shores recorded in plat Book 10, page 74, Public Records of Indian River County, Florida, described as follows: Commencing at the Northwest corner of the Plat of park Shores as recorded in plat Hook 10, page 74, Public Records of Indian River County,Florida; run South 20°55'51° East a distance of 974.72 feet to the Point of Beginning; thence run North 69'00114" East a distance of 180.00 feet to a point; thence run North 20°55'51" West a distance of 204.75 feet to a point; thence run North 69'00'14" East a distance of 94.615 feet; thence run South 20'55'51" East a distance of 622.15 feet to a point; thence run North 69'00114" East a distance of 265.35 feet to a point; thence run South 20'55151" East a distance of 420.85 feet to a point; thence run South 69'00'14" East a distance of 540.00 feet to a point; thence run North 20'55'51" West Is distance of 758.25 feet to the point of Beginning. 2. The vacation of that portion of the plat for Park Shores above described includes vacation of easements set forth in the dedication, but limited to the vacation of the easement within the vacated platted area above described. COLLINS, Jit., hereby petitions the Board of County Commissioners of. Indian River County to partially vacate the Plat of Park Shores recorded in Plat Book 10, page 74, Public Records of Indian River County, Florida, pursuant to Florida Statutes 5177.101, and states as follows, 1. Petitioner, states that the Town of Indian River Shores by Resolution No. 366, a certified copy of which is attached hereto as Exhibit "A," has vacated that portion of the Plat for: Park Shores described as follows. Petitioner further states the vacation of that portion of the plat for Park Shores above described includes vacation of easements set forth in the dedication, but is limited to the vacation of the easements within the vacated platted area above described. 3. The property vacated in owned in Ecco Hope by VERU BEACH ASSOCIATED DEVELOPiRS, INC. and convenient access to persons owning the property in the balance of the platted area has been provided by that Easement and Maintenance Agreement dated June 20, 1989, and recorded in Official Record Bonk 834, Page 1463, Public Records of Indian River County, Florida. 4. Pursuant to Florida Statutes ;177.101, Petitioner has published a legal notice in a newspaper of general circula- tion in Indian River County, a copy of the proof of said 1 EXHIBIT "A" RESOLUTION NO. 366 WHEREAS, VERO BEACH ASSOCIATED DEVELOPERS, INC., the developers of a portion of the property described in the Plat of Park Shores recorded in Plat Book 10, Page 74, in the Public Records of Indian River County, Florida; and WHEREAS, VERO BEACH ASSOCIATED DEVELOPERS, INC. has requested the TOWN OF INDIAN RIVER SHORES to vacate the plat of Park Shores above described as it applies to the property awned by VERO BEACH ASSOCIATED DEVELOPERS, INC. hereinafter described; and WHEREAS, in compliance with Town ordinances, upon the vacation of a part of the Plat for Park Shores, VERO BEACH ASSOCIATED DEVELOPERS, INC. will submit a replat of the land so vacated; and WHEREAS, the vacation of a portion of the plat of Park Shores is authorized pursuant to Chapter 177.101 Florida Statutes and appropriate 'TOWN OF INDIAN RIVER SHORES ordinances. r BE IT, THEREFORE, RESOLVED, as followsi 1.
