That it does herewith offer to convey to the Florida Outdoor Recreational Development Council or other state agency holding title for it all of the following described land owned by Indian River County, Florida, and located therein, to -wit: Lots 14, 15 and 16 of Kansas City Colony, according to the plat thereof filed in the office of the Clerk of the Cir- cuit Court of St. Lucie County, Florida, in Plat Book 4, page 23; said land now lying and being in Indian River County, Florida. ALSO an unsurveyed sovereignty mangrove island known locally as Round Island, lying in the unsurveyed part of fractional Section 33, Township 33 South, Range 40 East, Indian River County, Florida, and in the unsurveyed part of the Northeast quarter of fractional Section 4, Township 34 South, Range 40 East, St. Lucie County, Florida, more particularly described in Dedication No. 23927, filed in Official Record Book 210, page 425, public records of Indian River County, Florida. ALSO an unsurveyed sovereignty mangrove island lying in Round Island Creek in the unsurveyed Southwest quarter of fractional Section 34, Township 33 South, Range 40 East, Indian River County, Florida, more particularly described in Dedication No. 23927, filed in Official Record Book 210, page 425, public records of Indian River County, Florida. ALSO two parcels of submerged land in the Indian River in Sections 33 and 34, Township 33 South, Range 40 East, Indian River County, Florida, as particularly described in Dedication No. 24343, filed in Official Record Book 237, page 135, public records of Indian River County, Florida. PROVIDED, however, that the sole and only consideration for such a conveyance would be that it is made upon the condition that the grantee of said deed would hold, develop, use and maintain all of said property as a public park and if said conditions were not kept and performed, then the con- veyance would become void and of no effect and the title to all of the property with all improvements thereon would revert to Indian River County, Florida.
