RESOLUTION NO. -40
WHEREAS, the Zoning Commission of Indian River County,
r Florida, did after public hearing make its final report recommending
changes and additions to the Zoning Resolution of Indian River County,
Florida; and,
WHEREAS, this Board did publish its notice of said recom-
mended changes and additions and did, pursuant thereto, hold a public
hearing in relation thereto at which parties in interest and citizens were
heard; Now, therefore,
BE IT RESOLVED by the Board of County Commissioners
of Indian River County, Florida, that the Zoning Resolution of Indian
River County, Florida, and the accompanying Zoning Map, be changed
as follows:
1. That the Zoning Map be changed in order that the follow-
ing described property, situated in Indian River County, Florida, to wit:
PARCEL NO. 1. The North half of the East half of
Lot 6 of Block 2 of Dr. Richard E. Bullington's SSD,
which plat was filed May 25, 1912, and recorded in
Plat Book 2, page 5, public records of St. Lucie
County, Florida; said land now lying and being in
Indian River County, Florida. EXCEPT the right-
of-way over the North 50 feet of the above-described
property conveyed to the City of Vero Beach for a
street; and EXCEPT street right-of-way as in Official
Record Book 73, page 226, public records of Indian
River County, Florida.
AND The North 160.5 feet of the West half of Lot 6,
Block 2, Dr. Richard E. Bullington's SSD, according
to plat filed May 25, 1912, and recorded in Plat Book
2, page 5, public records of St. Lucie County,
Florida; said land now lying and being in Indian River
County, Florida. EXCEPT, HOWEVER, the West
100 feet of the above-described property and except
the North 50 feet of the above-described property
conveyed to the City of Vero Beach for road right-of-
way.
PARCEL NO. 2. Lot 3, Block 2, of Dr. Richard E.
Bullington's Subdivision, of part of Section 1, Town-
ship 33 South, Range 39 East, according to plat filed
in the office of the Clerk of the Circuit Court of St.
Lucie County, Florida, in Plat Book 2, page 5; exclu-
ding therefrom the following described land:
® Beginning at the NW corner of said Lot 3, thence
run South along the West boundary line of said L.ot
3 3 for a distance of 208.71 feet, thence run Bast
db I for a distance of 208, 71 feet, thence run North for f
a distance of 208.71 feet, thence run West for a f
distance of 208.71 feet to the point of beginning;

® be changed from R-2, Single Family District, to R-2 A, Multi -Family '
District.
All within the meaning and intent and as set forth and des-
cribed in said Zoning Resolution; provided, however, that the foregoing
changes and additions to the Zoning Resolution are made contingent upon

the owner of said property obtaining a building permit for the construction
of an apartment building comparable to the William Penn Apartments in
Vero Beach within two (2) years upon either one or the other of the above
described parcels. If the contingency does not occur within the time
specified, this Resolution shall no longer be effective.

The County Administrator presented a final plat of a sub-
40 division known as Van Trician Subdivision. The streets have been
completed and the Administrator suggested that the $450.00
put into escrow by William Van Busch be retained for the completion
® of the ditches. A Notion was made by Commissioner McCullers,
seconded by Commissioner Massey and unanimously carried that since
Mr. Van Busch has completed the road for which he deposited $450.00,
the $450.00 held in escrow for the completion of the streets in
„ Van Trician Subdivision should be returned to him; and that final
approval of the plat is denied until the time the subdivision is
completed.
A resident of the Pinson Subdivision appeared before the
'•Board requesting that the County do what it can to alleviate the
problem of the water standing in the streets. The Administrator
stated that he would send a force to the area to do whatever
could be done at this time; and that he would make a further study
of the drainage problem and present his findings to the Board.
Chairman Dritenbas returned to the meeting and again took the
Chair.
Julian Lowenstein and John Sutherland appeared before the
Board in protestation to the phrase "for the construction of an
apartment building comparable to the William Penn Apartments" ,in
Resolution 69-49 adopted in the Minutes of September 24, 1969.

A Motion was made by Commissioner Loy, seconded by Commissioner
McCullers and unanimously carried that the phrase in the Minutes
of September 24, 1969, Resolution 69-49 reading "for the construction
of an apartment building comparable to the William Penn Apartments"
be changed to read "for the construction of an apartment building
comparable in exterior appearance to the William Penn Apartments
but not requiring the same size or style of the building."
