HomeMy WebLinkAbout1969-055On a Motion made by Commissioner Loy, seconded by Covmis€,ioner bJassoy, the following Resolution was unsanimot t.y adopted- Rl SOLUTION NO. tag -5 } WHEREAS, the Zoning Commission of Indian River County, Florida, did after public hearing make its final report recommending changes and � additions to the Zoning Resolution of Indi�'an River County,F'lorida; � and HTIiEMAS, this Board did publish its notice of said recommended changes and additions and did, pursuant thereto, hold a public hearing in relation thereto at which parties in interest and citizens were heard: Now, therefore, BE IT RSSOLVSD by the Board of County Commissioners of Indian River [: is County, Florida, that the Zoning Resolution of Indian River County, Florida, and the accompanying Zoning Map, be changed as follows: 1. That the Zoning Map be changed in order that the fcll.aaaing des- cribed property, situated in Indian River County, Florida, to -wit: Government Lot 4, Section 18, Township 33 South, Range 40 Fast; that part of the West half of the ,orthoast Quarter of the south- ,,aest Quarter of Section 18 lying North of the south Relief. To prepare plans and specifications for the work involved, and advertise for bids for the equipment and materials. The decision as to the type and make of equipment purchased will be at the Department's discretion. 2. To furnish technical supervision during the instal- lation phase of the work and finally inspect the completed project. 3. To pay the entire cost of said project using primary funds therefor. THE COUNTY AGREES: 1. That the equipment shall remain the property of the Department, and it is hereby understood and agreed that the County shall not, under any condition, remove the equipment which is the subject matter of this Agreement for any reason without permission and written consent of. the Department. 2. Upon completion of the installation, to assume the sole responsibility for the maintenance of said flashing school signs in accordance with the Department's policies and "Standard Specifications for Traffic Control Signals and Auxiliary and 2 Equipment;" and the payment for all costs for electricity and electrical charges incurred in connection with the operation thereof out of the County's general funds. 3. To indemnify, defend, save and hold harmless the Department from.any claims, demands or liabilities of any nature whatsoever arising out of or because of this Agreement. It is mutually agreed that the Department's State Highway Engineer shaX1 decide all questions, difficulties and disputes of whatever nature which may arise under or by reason of this Agreement, the prosecution and fulfillment of the services hereunder, and the character,.quality, amount and value thereof, and his decision upon all claims, questions ,and disputes shall be final and conclusive upon the parties hereto.
