the following Resolution was unanimously adopted:
l® RESOLUTION NO. 70-51
WHEREAS, the State of Florida Board of Trustees of the
® Internal Improvement Trust Fund has purchased land to establish
the Sebastian Inlet Park, and
WIiEREAS, said Board has requested Indian River County
to deed to said Board the land now presently held by the County
along the South boundary of the Sebastian Inlet so that the park may
be dedicated and the state may begin development,
NOW, THEREFORE, BE IT RESOLVED that the chairman
of the Board of County Commissioners of Indian River County is
authorized to sign all papers necessary to effectuate said transfer.

THIS DEED, made this day of November, 1970, by INDIAN
RIVER COUNTY, FLORIDA, party of the first part, and THE STATE OF
FLORIDA, BOARD OF TRUS'T'EES OF THE INTERNAL. IMPROVEMENT
TRUST FUND, party of the second part.
® WITNESSETH, that the said party of the first part, for and in
consideration of the sum of Ten and no/100 Dollars ($10. 00) to it in hand
paid by the party of the second part, receipt whereof is hereby acknowledged
and other good and valuable considerations, has granted, bargained and sold
to the party of the second part, its successors and assigns forever, the
following described land lying, and being in Indian River County, Florida:
From the Southeast corner of Section 20, Township 30 South, Range
39 East, Indian River County, Florida, run North 89 degrees 31 minutes West
along the South line of said Section 20 a distance of 3505.98 feet to the point
of beginning; thence North 31 degrees 21 minutes 01 seconds East 1620.0 feet;
thence North 34 degrees 51 minutes 43 seconds East 928. 84 feet; thence North
11 degrees 48 minutes East 332.01 feet; thence South 37 degrees 42 minutes
22 seconds West 435.0 feet; thence South 53 degrees 42 minutes 22 seconds
West 230. 0 feet; thence South 41 degrees 05 minutes 32 seconds 4k est 350. 0 feet;
thence South 04 degrees 59 minutes 36 seconds West 7.40.0 feet; thence South
31 degrees 21 minutes 01 seconds West 1741.80 feet; thence run South 89 degrees
31 minutes East a distance of 168. 93 feet, more or less, to the point of beginning
and from the Southeast corner of Section 20, Township 30 South, Mange 39 East,
Indian River County, Florida, run North 89 degrees 31 minutes West along the
South line of said Section 20, a distance of 2891. 01 feet to the point of beginning;
thence continue along this sarne bearing 783. 90 feet; thence run South 31 degrees
21 minutes 01 seconds West 1213. 20 feet to a point of tangency of a circular curve;
thence continue on the arc of said circular curve concave to the left, having a
radius of 485 feet a distance of 1904. 59 feet to a point; thence run North 24 degrees
24 minutes 21 seconds East a distance of 1281. 79 feet, more or less to the
point of beginning
Subject to conditions, reservations, limitations, easements, questions
of survey and agreements, if any there be.
Grantor does not warrant condition of title. Grantor will defend title
against the claims of any person claiming by, through or under the Grantor herein.
It is agreed and understood by and between the parties, and the party
of the second part, by its acceptance of this Deed, does acknowledge its under-
standing of the agreement and does covenant and agree for itself, and its
successors and assigns, forever, as follows:
1. The premises above described shall be forever and continuously
used and maintained as and for a public park for recreational purposes and no
part of said premises is to be confined or used as a restricted campground or
other restricted area.
2. That day or night free access to all of the South shoreline of the
Sebastian Inlet, the fishing pier, under the Sebastian Inlet Bridge and the South
Jetty of the Sebastian Inlet, will be provided by the party of the second part for
the use and enjoyment of all citizens and that no special charge will ever be made
for the exercise of such enjoyment.
IN WITNESS WHEREOF, the said Harty of the first part has caused
these presents to be executed in its name by Its Board of County Commissioners
