HomeMy WebLinkAbout1971-050adopted: `® RESOLUTION 71- 50 WHEREAS, WYN COVE, INC., a Florida corporation, did file a 404 Petition with the Board of County Commissioners of Indian River County, Florida, requesting said Board to adopt a Resolution to vacate, abandon, discontinue and close that certain street known as Vanada Lane, hereinafter described; and WHEREAS, a public hearing was duly held by said Board on September 8 1971, pursuant to Notice thereof duly published in the Vero Beach Press Journal, a newspaper of general circulation in Indian River County, which said publica- tion was had two weeks prior to the public hearing as required by law; and WHEREAS, the Board of County Commissioners has duly considered the same; NOW, THEREFORE, BE IT RESOLVED that this Board does find and de- termine the following: 1. That this Board has published a Notice of the hearing on the Petition of WYN COVE, INC., a Florida corporation, one time in the Vero Beach Press Journal, a newspaper of general circulation in Indian River County, Florida, said publication being published at least two weeks prior to the time stated thereon for such public hearing. 2. That the land hereinbelow described is not a part of the public road and street required by the State of Florida, or by the Federal Government as part of the State or Federal Highway system and said street as described hereinbelow is not located within the corporate limits of any municipality and is located in Indian River County, Florida; and the following described land is not needed for street, road, highway or other public purposes by Indian River County. BE IT FURTHER RESOLVED that the Board of County Commissioners of Indian River County, for and on behalf of Indian River County, Florida, does hereby renounce and disclaim any right, title or interest in and to the following 8809 14 f -AA 3 LAW OFFICES JOHN H. SUTHERLAND VERO REACH, FLORIDA ��� p described public street or road, to -wit: That certain street known as Vanada Lane, being 76.2 feet in width, lying between Lots 10 and 11, and between Lots 16 and 17, as shown on plat of Wyn Cove, recorded in Plat Book 4, page 61, public records of Indian River County, Florida. and that the same be and is hereby vacated, abandoned, discontinued and closed and that all express or implied dedications thereon and resulting there- from are hereby vacated, abandoned, discontinued and closed, except that the Board of County Commissioners of Indian River County, for and on behalf of Indian River County, Florida does hereby reserve unto itself a 10 -foot public utility and drainage easement over the Northerly 10 feet of Vanada Lane and over :the Southerly 10 feet of Vanada Lane as the same is shown on plat of Wyn Cove, above described. BE IT FURTHER RESOLVED that Notice of the adoption of this Resolution shall be published once in the Vero Beach Press Journal, a newspaper of general circulation in Indian River County, Florida, and proof of publication of the Notice of public hearing, a certified copy of this Resolution as adopted and proof of the publication of the Notice of adoption of such Resolution shall be re- corded in the deed records of Indian River County, Florida, as required by law. I do hereby certify that the above and foregoing Resolution was duly adopted by the Board of County Commissioners of Indian River County at its regular meeting on September.8 , 1971.
