A RESOLUTION OF INDIAN RIVER COUNTY,
FLORIDA, ACCEPTING A GRANT IN THE AMOUNT
OF $1,241,303 FROM THE U.S. ENVIRONMENTAL
PROTECTION AGENCY FOR CONSTRUCTION OF AN
ROCKRIDGE COLLECTION SYSTEM AND
AUTHORIZING TERRANCE G. PINTO, UTILITIES
DIRECTOR, TO EXECUTE THE REQUIRED
ACCEPTANCE FORMS

WHEREAS, Indian River County (County) has made
i
application to the United State Environmental Protection
Agency for a construction grant to assist in providing public
sewers to the Rockridge area; and
WHEREAS, the County has been offered a federal grant in
the amount of $1,241,303, which represents 55% of the E.P.A.
eligible costs; and
WHEREAS, in order to accept this grant, it is necessary
for the County to execute the agreement with the E.P.A.
which is attached to this resolution;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, THAT:
1. The County accepts the offer of a federal grant in
the amount of $1,241,303, and
2. The Utilities Director, Terrance G. Pinto, is
authorized to execute the grant acceptance form on behalf of
Indian River County.
The foregoing resolution was offered by Commissioner
Eggert _ who moved its adoption. The motion was seconded
by Commissioner Wheelerand, upon being put to a vote, the
vote was as follows:

Dear Mr. Pinto:
I am pleased to make the enclosed offer of a federal grant in the amount of
$1,241,303 to Indian River County for construction of your wastewater
treatment facilities. This offer is made under the provisions of the
Federal Water Pollution Control Act as amended and represents fifty-five
(55) percent of the Environmental Protection Agency (EPA) eligible cost.
This offer is subject to the assurances and conditions as set forth in the
grant agreement, to any other stipulations approved by the Administrator,
and to adjustment in amount as determined by final inspection and audit.
We suggest you familiarize yourself with the conditions and enclosed
Federal Registers to ensure smooth execution of this project.
Please review all standard and special conditions of the grant carefully
prior to signing the grant agreement. After signature, return the original
and two (2) signed copies to EPA, Attn: Grants Administration Unit, by
certified mail. Also, include three (3) copies of the required resolution
authorizing your acceptance of this offer. The offer must be accepted
within three (3) weeks from the date of receipt of this letter or it
becomes invalid unless a time extension is requested from this office. The
request must be in writing with a detailed explanation justifying your
request.

Your attention is invited to Sections 30.301, 30.309 and 30.510 of EPA's
regulation 40 CFR 30 and Section 35.2104 of 40 CFR 35 and Sections 33.210,
33.211 and 33.220 of 40 CFR 33 which set forth the recipient's responsi-
bility for project management and procurement. Copies of these regulations
are enclosed.
You are advised that any planned procurement actions in excess of $10,000
resulting in items available from a single or sole source must be procured
in accordance with Sections 33.110, 33.250, 33.275, 33.290, 33.605, and
Appendix A of 40 CFR 33.
After acceptance of this grant you may advertise for bids on the
construction of this project. You are cautioned not to advertise unless
you have a proper wage decision that will not expire before bids can be
received and a tentative contract award made.
The enclosed five copies of the Project Review and Cost Summary are to be
completed after bids have been received and submitted along with supporting
documents including a detailed cost breakdown showing the units, unit cost,
and value of the eligible work. The complete bid package should reach the
state offices within twenty-one (21) days after bid opening. Equal Employ-
ment Opportunity documentation to be provided by the successful bidder must
be submitted directly to EPA within fourteen (14) days after bid opening.
The State will authorize you to award contracts when these documents are
approved.
EPA has entered into an agreement with the Corps of Engineers for the
purpose of performing construction, engineering and administrative moni-
toring functions on Step 3 grant projects. Our interest in the assignment
of these functions is to assure that the overall objectives of the grant
are realized; that the grant and the project will be administered in
accordance with federal laws and EPA regulations; and that needed
assistance will be provided to you. Your project will be monitored by the
Orlando Project Office under this agreement.
Performance of these services by the Corps does not relieve you of
responsibility under the grant, nor does it relieve the consultant,
contractor, subcontractor or other party from any obligation imposed upon
them by federal laws, EPA regulations or other applicable requirements or
terms of contract agreements entered into as a result of this construction
grant.

It is necessary that you provide access to the project site and to project
records and that you require all consultants, contractors, and subcon-
tractors to also provide such access to the Corps of Engineers as EPA's
representative. Please submit the schedules, bar graphs and/or curves and
other documents described on Attachment No. 2 at the times indicated.
Attachment No. 1 sets forth the services to be performed by the Corps of
Engineers on projects assigned to them under the agreement. By copy of
this letter, we are notifying the Jacksonville District Office of the
assignment of this project.
Please read and follow carefully the instructions that are being sent to
you under separate cover to expedite handling details of the federal grant
offer.

PART III—AWARD CONDITIONS
■. GENERAL CONDITIONS.
The recipient covenants and agrees that it will expeditiously initiate and timely complete the project work for
which assistance has been awarded under this agreement, in accordance with all applicable provisions of 40 CFR
Chapter 1, Subpart B. The recipient warrants, represents, and agrees that it, and its contractors, subcontractors,
employees and representatives, will comply with: (1) all applicable provisions of 401CFR Chapter 1, Subchapter B,
INCLUDING BUT NOT LIMITED TO the provisions of Appendix A to 40 CFR Part 30, and (2) any special
conditions set forth in this assistance agreement or any assistance amendment pursuant to 40 CFR 30.425.
b. SPECIAL CONDITIONS:
(For cooperative agreements include identification or summarization of EPA responsibilities that reflect or
contribute to substantial involvement.)
1. The grantee agrees to submit, immediately after execution, a copy of all contracts (A/E
and Construction) associated with this grant. The contract documents are required in
order to process grant payments and change orders.
2. EPA reimbursement for engineering fees will be limited to 30% of the total eligible
engineering fees until the DER approves the contract for engineering services.
3. Estimated eligible construction costs were determined to be $1,837,750 or 99.4% of
total construction costs of $1,848,350. This factor, applied to.relevant line items of the
approved application budget, yields the following:
Administration $50,000 x 99.4% = $49,700
Basic engineering 23,100 x 99.4% = 22,961
Other engineering 2,400 x 99.4% = 2,386
Project inspection 50,000 x 99.4% = 49,700
4. One year after the date of initiation of operation of project facilities, the
grantee agrees to certify to the following performance standards:

Note: The project's ability to meet performance standards is to be evaluated using
field measurements obtained under operating conditions.
5. The grantee agrees to submit at least one interim progress report summarizing the
results of data collected, observations made and resources expended during that portion of
the twelve-month operational period prior to performance certification. The final report
shall summarize the remaining portion of the operational period prior to certification.
6. The design allowance was calculated at 6.0205% of the estimated eligible building
costs of $1,837,750:

7. The grantee agrees to comply with the provisions of OMB Circular A-128 governing the

8. The grantee agrees to comply with the following project schedule:
Advertise bids December 1987 Complete construction May 1989
Open bids January 1988 Initiate operation May 1989
Award contract March 1988 Certify performance May 1990
Start construction April 1988
9. The grantee and the Environmental Protection Agency agree, pursuant to Section
203(a)(2) of the Clean Water Act, that the eligibility of specific project components
is limited as described in Attachment A to this grant agreement (per 40 CFR 35.2250,
determination of allowable costs).
10. All eligible project costs are also alternative -eligible:
$2,256,914 x 20% federal share = $451,383
No funds are currently available for alternative technology funding. Therefore, this grant
does not contain such funds. However, September 21, 1987 shall serve as the effective date
for establishing chronological order for priority funding pursuant to Chapter 17-50, Florida
Administrative Code.
PART Iv
NOTE: The Agreement must be completed in duplicate and the Original returned to the Grants Administration
Division for Headquarters awards and to the appropriate Grants Administrations Office for State and local
awards within 3 calendarweeks after receipt or within any extension of time as may be granted by EPA.
Receipt of a written refusal or failure to retum the properly executed document within the prescribed time, may
result in the withdrawal of. the offer by the Agency. • Any change to the Agreement by the recipient subsequent
to the document being signed by the EPA Award Official which the Award Official determines to materially

Project Description

Indian River County
This project consists of a low pressure collection system for the Rockridge Area of
Indian River County. More specifically the project includes:
1. Approximately 410 grinder pumps with basins.
2. Approximately 410 4 -inch -diameter service laterals.
3. Approximately 18,600 linear feet of 1 1/4 -inch -diameter service connections.
4. Approximately 20,000 linear feet of 2- through 4 -inch -diameter pressure sewer.
5. One trailer -mounted 25 kW emergency generator.
The service laterals (Item 2) are not part of the allowable project and are not
eligible for Environmental Protection Agency funding. Items 1, 3, 4 and 5 are
allowable and eligibility is 100 percent. There is no eligibility reduction for
reserve capacity due to the nature of the low pressure collection system and the
minimal size of the pipes involved.
Note: This project description is based on the project plans and specifications
accepted September 15, 1987.
