WHEREAS, GENERAL DEVELOPMENT CORPORATION, a Delaware
corporation, authorized to do business in Florida, did file a
Petition with the Board of County Commissioners of Indian River
County, Florida, requesting said Board to adopt a Resolution to
vacate, abandon, discontinue and close a portion of that certain
street known as 21st Street, S. W., hereinafter described; and
WHEREAS, a public hearing was duly held by said Board
on _January 8, 1975, pursuant to Notice thereof duly
published in the Vero Beach Press Journal, a newspaper of general
circulation in Indian River County, which said publication was had
two weeks prior to the public hearing as required by law; and
WHEREAS, the Board of County Commissioners has duly
considered the same;
NOW, THEREFORE, BE IT RESOLVED that this Board does find
and determine the following:
(1) That this Board has published a Notice of the hearing
on the Petition of GENERAL DEVELOP14ENT CORPORATION, a Delaware cor-
poration, authorized to do business in the State of Florida, one
time in the Vero Beach Press Journal, a newspaper of general cir-
culation in Indian River County, Florida, said publication being
published at least two weeks prior to the time stated thereon
for such public hearing.
(2) That the land hereinbelow described is not a part
of the public road and street required by the State of Florida,
or by the Federal Government as part of the State or Federal
Highway system and said street as described hereinbelow is not
located within the corporate limits of any municipality and is
located in Indian River County, Florida; and the following des-
cribed land is not needed for street, road, highway or other
public purposes by Indian River County.

BE IT FURTHER RESOLVED that the Board of County Com-
4bM missioners of Indian River County, for and on behalf of Indian
River County, Florida, does hereby renounce and disclaim any
®_= right, title or interest in and to the following described public
street or road, to -wit:
That certain street known as 21st Street,
S. W., being more particularly described
as follows:
The South 35 feet of the Northeast 1/4
of Section 31, Township 33 South, Range
40 East, lying Westerly of the West Right
of Way of U. S. Highway No. 1 and Easterly
of the East Right of Way of Old Dixie
Highway which was platted as 21st Street,
S. W. on Vero Beach Highlands Unit One,
and dedicated to the Public on said plat.
Said plat is recorded in Plat Book 5,
Page 29, of the Public Records of Indian
River County, Florida.
and that the same be and is hereby vacated, abandoned, discontinued
and closed and that all express or implied dedications thereon and
resulting therefrom are hereby vacated, abandoned, discontinued.
BE IT FURTFIER RESOLVED that Notice of the adoption of
this Resolution shall be published once in the Vero Beach Press
Journal, a newspaper of general circulation in Indian River County,
Florida, and proof of publication of the Notice of public hearing,
a certified copy of this Resolution as adopted and proof of the
publication of the Notice of adoption of such Resolution shall be
recorded in the deed records of Indian River County, Florida, as
required by law.
I do hereby certify that the above and foregoing Reso-
lution was duly adopted by the Board of County Commissioners of
Indian River County at its .regular meeting on January 8, 1975.

Gentlemen:
The undersigned Petitioner, GENERAL DEVELOPMENT CORPORATION,
a Delaware corporation, authorized to do business in the State of
Florida, does herewith petition you to adopt a resolution closing,
vacating and abolishing the public roads and right of way located
on the plat of VERO BEACH HIGHLANDS UNIT ONE, as recorded in Plat
Book 5, Page 29, of the Public Records of Indian River County, as
it pertains to the following described property situated in Indian
River County, Florida:
The South 35 feet of the Northeast 1/4
of Section 31, Township 33 South, Range
40 East, lying westerly of the West Right
of Way of U. S. Highway No. 1 and Easterly
of the East Right of Way of Old Dixie
Highway which was platted as 21st Street,
S. W. on Vero Beach Highlands Unit One,
and dedicated to the Public on said plat.
Said plat is recorded in Plat Book 5,
Page 29, of the Public Records of Indian
River County, Florida.
and requests said Board to renounce and disclaim any right of the
said County and the public in and to the above described public
road and right of way as delineated on said recorded plat.
The Petitioner, GENERAL DEVELOPMENT CORPORATION, a Dela-
ware corporation, is the owner of the property adjoining the above
property sought to be abandoned and the said property sought to be
, abandoned is not a State or Federal Highway.
reasons:
The Petitioner requests this abandonment for the following
1. Subject street has been dedicated but never constructed.
2. The other half of subject street right of way which
is not vested in GENERAL DEVELOPMENT CORPORATION has never been
dedicated, and is owned by REX OIL COMPANY, which has fuel tanks

on subject property thereby preventing any possible street con-
struction.
3. In the event subject street would be constructed at
some future date, subject street would cause a crossing of FLO"IDA
EAST COAST RAILROAD tracks that would be too close to the existing
crossing at 20th Place, S. W., and thereby create a safety hazard.
Petitioner plans to expand its office building on adjacent
tract and requires the use of the thirty five (35) feet right of
way now dedicated as a portion of 21st Street, S. W.
