-1- RESOLUTION NO. 82-41 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS ® OF INDIAN RIVER COUNTY, PURSUANT TO ORDINANCE NO. 81-27, PROVIDING FOR THE METHOD OF ASSESSMENT TO RAISE SUFFICIENT FUNDS TO ELIMINATE A PACKAGE SEWAGE TREATMENT SYSTEM, BRING A DETERIORATED COLLECTION AND ® PUMPING SYSTEM UP TO ACCEPTABLE STANDARDS FOR THE ULTIMATE TAKEOVER OF TOTAL WASTE WATER SERVICE BY THE CITY OF VERO BEACH; PROVIDING FOR THE TOTAL ESTIMATED COST OF THE PROJECT; PROVIDING FOR THE METHOD OF PAYMENT OF ASSESSMENTS BY THE OWNERS OF THE PROPERTY SPECIALLY BENEFITED BY THE PROJECT; PROVIDING FOR THE NUMBER OF ANNUAL INSTALLMENTS AND A DESCRIPTION OF THE AREA SPECIFICALLY BENEFITED. •• WHEREAS, the Board of County Commissioners of Indian River County finds and determines that it is necessary and in the public's best interest to eliminate a certain package sewage treat- ment system and make improvements to the collection and pumping system within the area described in Exhibit "A", and WHEREAS, the total estimated prorated cost of the improvements necessary to service the property described in Exhibit "A" is $154,509.85, and WHEREAS, the Board of County Commissioners after examina- tion of the utilization of the proposed improvements determines that the property described in Exhibit "A" shall receive a direct and special benefit from the proposed improvements, and WIiEREAS, the special assessment provided hereunder shall become due and payable at the Office of the Tax Collector of Indian River County ninety days after the final determination of the special assessment pursuant to the provisions of Ordinance 81-27, any assessments not paid within said period shall bear interest at a rate established by the Board of County Commissioners at the time of preparation of the final assessment roll, payable in two equal installments; the first being, six months from the due date and the second, one year from the due date. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows: 1. The foregoing recitals are ratified and approved, and 2. The project to provide for the elimination of a package sewage treatment plant and bring a deteriorated collection and pumping system up to acceptable standards for the ultimate -1- takeover of total waste water sawage by the City of Vero beach is ® hereby approved subject to the terms outlined above and the requirements of Ordinance No. 81-27. Th The foreqoing resolution was offered by Commissioner Lyons who moved its adoption. The motion was seconded by Commissioner Bird and, upon being put to a vote, the vote was as follows: ® Chairman Don C. Scurlock, Jr. Aye Vice -Chairman A. Grover Fletcher Nay Commissioner Patrick B. Lyons Aye Commissioner William C. Wodtke, Jr. Aye Commissioner Dick Bird' Aye The Chairman thereupon declared the resolution duly passad and adopted this 17th day of March , 1982.
