HomeMy WebLinkAbout1982-082RESOLUTION NO. 82- 82 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, TERMINATING THE TREASURE COAST UTILITIES, INC. WATER AND SEWER FRANCHISE AND AUTHORIZING THE IMPOSITION OF STANDARD COUNTY RATES. WHEREAS, Indian River County on February 17, 1960, issued a water and sewer franchise to Southern Gulf Utilities, Tn(-,; ? Florida corporation, Nuisuant to the provisions of Special Acts of Florida Chapter 59-1380, and WHEREAS, through a series of assignments the franchise was assigned to Treasure Coast Utilities, Inc., and WHEREAS, Indian River County has now purchased all the assets of Treasure Coast Utilities, Inc. and has merged the system into the County's water and sewer system, and WHEREAS, the County Commissi n on August 4, 1982, held a duly advertised public hearing to consider the formal termination of the franchise and imposition of standard County rates on cus- tomers within the former franchise area, and WHEREAS, during the public hearing there was no opposi- tion from the public or customers. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that; 1. The water and sewer franchise originally issued on February 17, 1960, to Southern Gulf Utilities, Inc. and subse- quently through a series of assignments, assigned to TYeasure Coast Utilities, Inc. is hereby terminated, and 2. the Indian River County Utilities Department is authorized to charge water and sewer customers within the former Treasure Coast Utilities franchise territory standard County rates beginning at such time as County provides improved water from a reliable source. The foregoing resolution was offered by Commissioner Wodtke who moved its adoption. The motion was seconded by Commissioner Lyons and, upon being put to a vote, the vote was as follows: Y .4, Chairman Don C. Scurlock, Jr. Aye Vice -Chairman A.
