HomeMy WebLinkAbout1984-018r(raoITTION No. 84-18 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, PROVIDING FOR CTTAIN ADDITIONAL ASPHALT PAVING IMPROVEMENTS TO 11T11 AVENUE Sr.'I4dE N 2ND STREET AND THE SOUTH RELIEF CANAL; PROVIDING THE TOTAL ADDITIONAL COST, METHOD OF PAYMENT OF ADDITIONALASSESS- M M, NUMBER OF ANNUAL INSTAIJIMS, AND LEGAL DESCRIPTION OF THE AREA SPECIALLY BENEFITED. WHEREAS, the County Public Works Department has received a public improvement petition, signed by more than 2/3 of the owners of property in the area to be specially benefited, requesting paving and drainage improvements to lith Avenue , between 2nd Street and the South Relief Canal; and WHEREAS, the petition has been verified and meets the requirements of Ordinance 81-27; and WHEREAS, the total estimated cast of the proposed inprove- ments is $16,365.20; and WHEREAS, the County constructed paving and drainage improve- ments costing $10,119.07 along 11th Avenue in June, 1983, due to adverse weather conditions, base preparation, and a_phalt placement, additional asphalt was placed in November, 1983, costing $1,985.05; and WHEREAS, prior to placement of the above additional asphalt the County assessed the property owners $3.7686 per front foot which was substantially less than the approved, advertised, preliminary estimate of $5.655 per front foot; and WHEREAS, an additional special assessment is provided hereunder and shall, for any given record owner of property within the area specially benefited, be in an amount equal to that proportion of seventy- five percent(758) of the total additional cost of the asphalt paving which the number of lineal feet of road frontage owned by the given owner bears to the total number of lineal feet of road frontage within the area spe- cially benefited, and shall becom due and payable at the Office of the Tax Collector of Tndian River County ninety (90) days after the date of this resolution; and WHEREAS, Indian River County shall pay the remaining twenty- five percent(258) of the total additional cost of the project; and WHEREAS, the rate of special assessment shall be equal to $.77.90 per front foot for each owner, equaling the total additional assess- mp--nts reflected in the attached assessment roll; and WHEREAS, this Resolution shall serve as approval for both the preliminary and final assessment rolls for this project; and WHEREAS, any special assessment not paid within said ninety (90) day period shall bear interest beyond the due date at a rate of 128 per annum and shall be payable in two (2) equal installments, the first to be. made twelve (12) months from the due date and the second to be made twenty-four(24) months .from the due date; and MMMM, after examination of the .nature and anticipated usage of the proposed improvements, the Board of County Cortmissioners has determined that the following described properties shall receive a direct and special benefit from these improvements, to wit: Lots 1 - 27, Block H; as shown on the Plat of Indian River Heights Subdivision, Unit 8, Plat Book 7 Page 31 of Public Records of Indian River County, Florida. NOW THEi2EFORE, BE IT RESOLVED BY THE BOARD Oe COUNTY COMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows: 1. The foregoing recitals are affirms and ratified in their entirety. 2. A project providing for additional paving inprove-ents to lith Avenue, between 2nd Street and the South Relief Canal, heretofore designated as Public Works Project No. 8227, is hereby approved subje to the terms outlined above and all applicable requirements of Ordinance 81-27. The foregoing resolution was offered by Catmi.ssioner Wodtke Who nerved its adoption. The motion was seconded by Camds- sioner Bird and, upon being put to a vote, the vote was as follows: Chairman Don C. Scurlock, Jr. Ave Vice -Chairman Patrick B. Lyons Aye Commissioner. Margaret C. Botwman Aye Commissioner Richard N. Bird Aye Cormii.ssioner William C. Wodtke, Jr. Aye The Chairman thereupon declared the resolution duly passed and adopted this 7th day of March , 1984.
