HomeMy WebLinkAbout1985-056• RESOLUTION No. 85- 56 A RESOIATION OF THE BOARD OF OCURry CONAIISSIONERS OF INDIAN RIVER COiNPY, j FLORIDA, PROVIDING FOR CERTAIN PAVING AND DRAINAGE IMPROVEMENT TO 1ST STREET BETWEEN 18TH AND 20TH AVFNNES;PROVIDING THE TOTAL ESTIMATED COST, METHOD OF PAYMENT OF ASSESSMMM, NU413ER OF ANNUAL INSTALIVErNTS, AND LEGAL DF--k?JPTION OF THE AREA SPECIALLY BENEFITED. ! WHEREAS, the County Public Works Department has received 'i a public improvement petition, signed by more than 2/3 of the owners of • 0 property in the area to be specially benefited, requesting paving and drainage improvements to 1st Street between 18th and 20th Avenues; and WHEREAS, the petition has been verified and meets the requirements of Ordinance 81-27, and design work including cost esri- mates has been completed by the Public Works Division; and WHEREAS, the total estimated cost of the proposed im- provements is $19,400.34; and WHEREAS, the special assessment provided hereunder shall, for any given record owner of property within the area specially bene- fited, be in an amount equal to that proportion of seventy-five percent (75%) of the total exist of the project which the number of lineal feet of road frontage awned by the given owner bears to the total number of lineal feet of road frontage within the area specially benefited, and shall become due and payable at the Office of the Tax Collector of Indian River County ninety (90) days after the final determination of the special assessment pursuant to Ordinance 81-27; and WHEREAS, Indian River County shall pay the remaining twenty-five percent(25%) of the total cost of the project; and WHEREAS, any special assessment not paid within said ninety (90) day period shall bear interest beyond the due date at a rate established by the Board of County Commissioners at the time of prepar- ation of the final assessment roll, and shall be payable in two (2) equal installments, the first to be made twelve (12) months frau the due date and the second to be made twenty-four(24) months from the due date; and WHEREAS, after examination of the nature and anticipated usage of the proposed improvements, the Board of County Commissioners has determined that the following described properties shall receive a direct and special benefit frau these improvements, to wit: Lots 3 through 8, Block C; Lot 1, Block F; Lots 10 through 14, Block F; Moreland Subdivision as recorded in Plat Book 4 Page 12 of the Public Records of Indian River County, Florida NCW =RM.)RE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF IRIDIAN RIVER COUNTY, FLORIDA, as follows: 1. The foregoing recitals are affirmed and ratified in ® their entirety. 2. A project providing for paving and drainage improve- ments to 1st Street between 18th and 20th Avenues, heretofore designated as Public Works Project No.8928, is hereby approved subject to the terms outlined above and all applicable requirements of Ordinance 81-27. The foregoing resolution was offered by Commissioner Scurlock Who moved its adoption. The motion was seconded by Ccnmis- • sioner Wodtke and, upon being put to a vote, the vote was as follows: Chairman Patrick B. Lyons Aye Vice-Chairnul Don C.
