WHEREAS, on July 21, 1986, the ':ounty received a duly execut- ed and documented petition from t'Ae Roseland United Methodist Church, P. 0. Box 157, Roseland Roed, Roseland, Florida, request- ing the County to close, vacate, eoandon, and disclaim any right, title, and interest of the County and the public in and to the 16 foot alley lying in the center of Block 9 Townsite of Roseland subdivision running in an easterly direction between Josie and Baird Streets. WHEREAS, in accordance with Florida Statutes §336.10, notice of a public hearing to consider said petition has been duly published; and WHEREAS, after consideration of the petition, supporting documents, staff investigation and report, and testimony of all those interested and present, the Board finds that said right- of-way is not a state or federal highway, nor located within any municipality, nor is said right-of-way necessary for continuity of the County's street and thoroughfare network, nor access to any given private property. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMIS- SIONERS OF INDIAN RIVER COUNTY, FLORIDA that: 1. All right, title and interest of the County and the public in and to that certain right-of-way being more particularly described as: A 16 FOOT ALLEY LYING NORTH AND ADJACENT TO LOTS 6,7,8,9 and 10 OF BLOCK 9 OF THE TOWNSITE OF ROSELAND ACCORDING TO PLAT FILED IN THE OFFICE OF THE CLERK OF THE CIRCUIT COURT OF ST. LUCIE COUNTY, FLORIDA IN PLAT BOOK 1, PAGE 43. SAID LAND NOW LYING AND BEING IN INDIAN RIVER COUNTY, FLORIDA. is hereby forever closed, abandoned, vacated, surrendered, discon- tinued, remised and released. 2. Notice of the adoption of this resolution shall be forthwith published once within thirty (30) days from the date of adoption hereof; and 3. The Clerk is hereby directed to record this resolution together with the proofs of publication required by Florida Statutes §336.10 in the Official Record Books of Indian River 1 County without undue delay. The foregoing resolution was offered by Commissioner Lyons who moved its adoption.
