Adams, Chairman; Carolyn K. Eggert, Vice Chairman; Richard N. Bird; Kenneth R. Macht; and John W. Tippin. Also present were James E. Chandler, County Administrator; Charles P. Vitunac, County Attorney; and P. J. Jones, Deputy Clerk. Chairman Adams called the meeting to order, and Commissioner Bird led the Pledge of Allegiance to the Flag. CONSENT AGENDA A. DESCRIPTION AND CONDITIONS: Masteller & Moler, Inc. has submitted an application for major site plan and special exception use approval on behalf of the Riverside Church Assembly of God to expand the existing place of worship at 11205 Roseland Road. The proposed expansion will be constructed in two phases. Phase 1 proposes construction of a new sanctuary, parking, driveway modifications, and a landscape buffer for the entire project (phases 1 and 2). Upon completion of Phase 1, the "old" sanctuary will then be used as a fellowship hall. In Phase 2, the fellowship hall will be enlarged, and one of three existing modular buildings will be removed from the site. This special exception use application relates only to expansion of the existing church. No other uses requiring special exception approval (such as child care, private schooling or a parsonage) are proposed by this application. Since the site is located within an RS -1 zoning district, special exception use approval must be granted for the expansion. At its regular meeting of April 25, 1996, the Planning and Zoning Commission voted 4-0 to approve the major site plan request, and to recommend that the Board of County Commissioners grant special exception use approval, subject to the conditions stated at the end of this report (see attachment #4). Pursuant to Section 971.05 of the LDRs, the Board of County Commissioners is to consider the appropriateness of the requested use for the subject site and surrounding area. The County may attach any conditions and safeguards necessary to mitigate impacts and to ensure compatibility of the use with the surrounding area. ANALYSIS: 1. (modular unit to be removed*) TOTAL: 12,341 sq. ft. * Note: existing structures on the site include three 704 sq. ft. modular buildings and a 3,888 square foot church sanctuary, for a total of 6,000 square feet. One 704 square foot modular building will be removed from the site in Phase 2. 6. Open Space (overall site): Existing: 95.3% Required: 50.0% Provided: 69.0% 7. Traffic Circulation: The site is currently accessed by two driveways connecting to Roseland Road. Each driveway is approximately 12' wide. One driveway is located at the north limits of the site's Roseland Road frontage, while the other driveway is located at the south limits. The northern driveway is within a common ingress/egress easement, (approximately 480' X 50') and is used by both the church and the adjacent property owner. The southern driveway is used solely by the church. The proposed site plan modifies the site's existing traffic circulation plan by eliminating the church's use of the northern driveway. Under the proposed site plan, the northern driveway would remain in use for the property owner to the north. The church would use only the southern driveway, which would be widened from a 12' width to a 25' width to accommodate two-way traffic. The driveway would be improved but not paved, as is allowed for church and other infrequent uses. A 50' asphalt apron is to be constructed at the site's Roseland Road/southern driveway connection, as shown on the proposed plans. All existing and proposed internal driving aisles will provide for a two-way traffic flow through the parking areas and the sanctuary porte-cochere. The existing northern driveway will be physically altered at the point where it currently serves only the church site. From that point and toward the church, landscaping will replace a portion of the driveway to provide for the required northern boundary buffer (see item #10). The portion of the northern driveway serving the adjacent residence will remain undisturbed by the development proposed by the church (see attachment #3). The proposed driveway alterations and improvements, as well as the internal traffic circulation plan, have been approved by the County Traffic Engineer. 8. Off -Street Parking: Total Required: 114 parking spaces Total Provided: 142 parking spaces JUNE 4, 1996 � _ 9. Stormwater Management: The Stormwater Management Plan has been approved by the Public Works Department, and a Type "A" Stormwater permit will be issued. Through normal permitting procedures, the Public Works Department will ensure that the site's legal positive outfall will provide for a drainage flow across the church site to the St. Sebastian River. 10. Landscape Plan: The landscape plan is in.compliance with Chapter 926 of the county's Land Development Regulations and proposes a Type "C" buffer along the site's northern and southern property boundaries. Buffer requirements are in compliance with the specific land use criteria (see paragraph 13). A type "C" landscaping buffer is required between a place of worship and adjacent residential uses. For this site, the existing driveway along the site's north boundary is located in an area that would normally be used for the buffer. Since the driveway is not under the sole control of the applicant and is located at the site perimeter in certain areas, a portion of the required buffer is proposed along the immediate south side of the driveway in such areas. The remaining portion of the buffer will be located along the northern property line where a portion of the existing driveway will be removed, as referenced in item #7 of this report. Thus, along the north property line a continuous buffer will be provided between any buildings and parking arear and adjacent residential property. All other buffer areas are located immediately adjacent to property lines. At its April 25, 1996 meeting, the Planning and Zoning Commission discussed the need for a barrier between proposed church parking spaces and the northern driveway which is to serve only the adjacent property to the north, which is owned by Mr. Robert Denton. The Planning and Zoning Commission concluded that a landscape strip along the east perimeter of the parking area would preclude church traffic from inadvertently using the adjacent northern driveway. Condition 2 at the end of this report represents the Planning and Zoning Commission's recommendation on this issue. At the April 25th meeting, the applicant indicated no objection -to such a condition. 11. Temporary Use of Modular Units: At its April 25th meeting, the Planning and Zoning Commission also discussed the use -of modular Sunday School classroom buildings located on the site's north side. The Planning and Zoning Commission concluded that the modular buildings were approved by .the county as special exception uses, based upon the understanding that the units were to be temporary. The Commission also concluded that timeframes for removal of the modular units should be formally addressed as part of this application. After discussing timeframes with the church and noting that the units have already existed on site for several years, the Planning and Zoning Commission recommended that the Board of County Commissioners condition the special exception approval by requiring the modular units to be removed in 3 years. The 3 year removal deadline is reflected in recommended condition 2 at the end of this report. It should be noted that, during discussion of the removal timeframe at the Planning and Zoning Commission meeting, the project engineer requested a removal deadline of 4 years. 12. Utilities: County water and wastewater are available to the site, and mandatory connections are required by the county Utilities Department. Prior to site plan release, the applicant, through normal procedures, must obtain utilities connection permits for the project. Neither the county Utilities Department nor Environmental Health Unit (HRS) object to site plan approval. JUNE 4, 1996 17 BOOK 98 PnE 263 Fr_ BOOK 13. Environmental Issues: During review of a previous site plan application for the site., Environmental Planning staff determined that the site's vegetation had been significantly altered and disturbed, with no actual native vegetation community remaining on site to be preserved. Therefore, no conservation set-aside measures are required. 14. Specific Land Use Criteria: The application must satisfy the following specific land use criteria which apply to a place of worship expansion proposed to be constructed in the RS -1 district: a. No building or structure shall be located closer than thirty (30) feet to any property line abutting a residential use or residentially designated property; Note: The 30' setback is satisfied for all proposed buildings. b. Access shall be from a major thoroughfare unless otherwise approved by the public works department; Note: The site is accessed from Roseland Road, a major thoroughfare. C. Any accessory residential use, day care facility or school upon the premises shall provide such additional lot area as required for such use by this section and shall further be subject to all conditions set forth by the reviewing procedures and standards for that particular use. Accessory residential uses may include convents, monasteries, rectories or parsonages as required by these regulations; Note: No such accessory uses are proposed. d. Type "C" screening shall be provided along all property boundaries where the facility is located adjacent to a single-family residentially designated property. Type "D" screening shall be provided along all boundaries when the facility is located adjacent to a multiple -family residentially designated property. Note: The plan provides for the required buffering. All of the above specific land use criteria have been satisfied by this site plan application. 15. Concurrency: The applicant has chosen not to apply for an initial concurrency certificate at this time and has executed and notarized a concurrency notice form. The notice states that no building permit will be issued for all or any portion of the project unless and until a concurrency certificate is issued for the project. With this notice, all concurrency requirements related to site plan approval have been satisfied. 16. Airport Zoning District: The site lies within- an Airport Height Notification Zone, as defined in the county Airport Impact Zoning Ordinance. This requires notification of the FAA for any structures proposed to exceed 25' in height. None of the proposed structures exceeds 25' in height. Therefore, no airport height notification zone regulations apply. RECOMMENDATION: Based on the analysis performed, staff recommends that the Board of County Commissioners grant special exception use approval for the proposed project with the following conditions: JUNE 4 1996 � _ 1. That prior to issuance of a certificate of occupancy for Phase 1, the required Type "C" buffer for the entire project (Phases 1 and 2) be in place and provided with irrigation. 2. That prior to site plan release, the applicant shall revise the site plan to provide for a continuous landscaping strip along the entire east perimeter of the easternmost parking area. 3. That the three modular classrooms be removed from the site within three years of the granting of the special exception use approval by the Board of County Commissioners. Planning Director Stan Boling reviewed the project and stated that the Planning and Zoning Commission has recommended conditional approval. He advised that Robert Denton, a single-family resident, shares the driveway on the north side of the property which will no longer be used by the Church. A larger driveway is to be constructed on the south side of the property; more landscaping will be added on the north side of the property; and the modular units presently on the site will be removed. Commissioner Eggert questioned the time required for completion of the southerly driveway and expressed her concern for the property owner to the north if that driveway is used for construction traffic. The Chairman opened the public hearing and asked if anyone wished to be heard in this matter. Mike Oliver of Masteller & Moler, representing the applicant, stated the applicant's intention to construct the new driveway immediately and their desire to have the opportunity to use the north driveway if necessary for construction. The congregation of the church would be informed to use the new driveway to the south beginning immediately. Mr. Oliver stated there would be no problem with leaving the north driveway in the same condition as it is when construction is started. Robert Denton of 11245 Roseland Road expressed some of his concerns regarding the activity at the church's property. Mr. Denton felt this development impacts the surrounding area in a manner which is contrary to the aims of the state and county in trying to protect the area. The development has created a very negative impact on the wildlife which has greatly decreased over the last several years due to the lighting and the level of activity on the church property. Mr. Denton felt that trailers should not be allowed in a residential area; questioned whether signs are allowed and, if so, whether they may be lighted. He also JUNE 49 199619 n �- BOOK 981'4; Fr- 7 BOOK 98 ruG 266 brought to the attention of the Board the fact that people are coming onto the church's property for recreational purposes, including launching of boats at all hours of the night. He stated that the church should be able to have its own boats, but that the property should not be opened to the public to use as a mini - marina. The County closes its parks at nightfall and he believed the church should do the same thing. Mr. Denton related an incident which occurred recently and caused him a great deal of concern. There were some young men launching a boat from Mr. Denton's dock in the evening who disturbed Mr. Denton's neighbor to the north, causing her to call Mr. Denton with a complaint that the noise was making it impossible to sleep. When Mr. Denton walked down to his dock to investigate, he discovered a young man urinating on some lawn chairs belonging to Mr. Denton. When he advised the young men that this was private property, they made Mr. Denton very uncomfortable on his own property. He went back to his house and attempted to contact someone from the church unsuccessfully. He then notified the Sheriff's Department. However, when the sheriff's deputy arrived, the boat had gone down the river. The officer did not have a boat and asked Mr. Denton to call again when the young men in the boat returned. Mr. Denton later questioned an official of the church about this activity and was told that these young men were not members of the congregation. Mr. Denton felt that the church has an obligation to make itself aware of activities occurring on their property as a part of the liability and responsibility of property ownership. County Attorney Vitunac commented that the church has riparian rights to use the riverfront property but the exception is for a church, not a marina, and that the activity is not proper if it goes beyond the rights of any other riverfront property owner. Mr. Denton then questioned the use of motor homes on the property for extended periods of time. His concern was that the church's use would be a precedent. Director Boling responded that these vehicles can be parked like any other vehicle but may not be used as a temporary residence. Mr. Denton then questioned a third trailer which was moved onto the church's property supposedly to be used for a Sunday school. He has noted that this trailer is being used a great deal more often than just Sunday mornings and he has been told that it is being used for classes for learning handicapped persons. He wondered whether the church will be able to operate a school with dining facilities which could be used for summer camp and fund raising dinners. The church also recently offered a play to the JUNE 4 1996 do general public. Mr. Denton felt that activity would be normal during the holiday season but understood that the minister and his family are interested in theater and drama and he wanted to know whether the church will be able to operate a theater with productions for extended periods of time. Mr. Denton also brought to the Board's attention the sodium lighting located on the church's grounds which is hung in pine trees, maybe 30 feet high. This lighting penetrates the darkness very well and has a very broad boundary which includes the whole area, discouraging the native wildlife and encouraging people who come on the property for fishing, etc. He stated that it is like living in a K -Mart parking lot with the lights on all night long. Mr. Denton then brought up the existing landscape buffer which has not been maintained. He expressed his hope that someone will take care of the landscaping problem and that the trailers will be removed after 3 years from date of approval, including the air conditioned trailer brought onto the property for the purpose of storing the church's puppets. He also remarked that the driveway to the north of the property is now encroaching on his property and noted that in order to repair a barbed wire fence on his property, he would have to remove the road material now on his property.' Chairman Adams expressed the Board's appreciation for Mr. Denton's time and very valid concerns. Discussion ensued regarding the various concerns raised. Commissioner Macht felt that most of the problems expressed should have been settled between the parties on a neighborly basis. Director Boling advised that the Code Enforcement Department is looking into the shielding of the lighting and the setback from the river for the identification sign. He also stated that he would check with the Building Department regarding a permit for the shed being used for the storage of the puppets. Commissioner Macht suggested that the removal of the modular units be required when construction is completed or 3 years from the date of approval of the special exception, whichever occurs sooner. County Attorney Vitunac advised that the condition of the north driveway is a private matter between the 2 neighbors. Tom Kempf, Pastor of Riverside Church Assembly of God, assured the Board that the church is willing to comply with any reasonable limitations and advised that he had learned a lot at this meeting. The manufacturer of the shed being used for the storage of the puppets had advised that no permit was required. Pastor Kempf also felt that the church needs to arrange more control of the property to avoid having strangers using it and advised they will take that into consideration when they build the new driveway. They also were not aware that the use of the motor homes was inappropriate and will put a stop to that practice. The Chairman asked if anyone else wished to be heard in this matter. JUNE 49 1996 23 J BOOK 98 PACE 270 DESCRIPTION AND CONDITIONS: Reverend Ron Barber, on behalf of the Community Baptist Church, has submitted a request for special exception use approval to operate a child care operation in association with an existing place of worship. The subject site is located at 12534 Roseland Road and is zoned RS -3 (Single Family Residential up to 3 units per acre). Recently, special exception use and site plan approval were granted for an expansion of the church. The expansion project is now complete, and the child care use proposed with this application will be located in a portion of the expanded church facility. Child care uses, located within RS -3 zoning districts, must be approved as special exception uses prior to operation, pursuant to LDR section 971.28(1). Staff has reviewed the administrative approval site plan application- submitted in conjunction with the special exception use request and has granted site plan approval subject to the granting of special exception use approval. Therefore, the site plan approval will become effective if and when the Board of County Commissioners grants special exception approval. At its regular meeting of May 9, 1996, the Planning and Zoning Commission voted to recommend that the Board of County Commissioners grant the requested special exception use request with the conditions stated at the end of this report .(see .attachment #4). The Board of County Commissioners is now to approve, approve with conditions, or deny the special exception use request. Pursuant to LDR section 971.05, the Board is to consider the appropriateness of the requested use for the subject site and surrounding area. The County may attach any conditions and safeguards necessary to mitigate impacts and to ensure compatibility of the use with the surrounding area. - ANALYSIS: 1. Zoning Classification: RS -3, Single Family Residential (up to 3 units per acre) 2. Land Use Designation: L-2, Low Density (up to 3 units per acre) 3. Surrounding Land Use and Zoning: North: Single Family Residential/RS-3 South: Single Family Residential/RS-3 East: Sebastian City Limits, Vacant/IN (Industrial), West: Roseland Road/RS-1 Note: The City of Sebastian has been notified of the request and has not forwarded any comments or objections to county planning staff. 4. Building Area: The proposed child care operation will utilize a 960 square foot pavilion and 1,400 square feet of an existing 4,600 square foot building. The building will provide for the child care operation; including restrooms and classrooms (indoor activity areas). There will also be an outdoor recreation area. No new building area is required, and none is proposed to provide for'the proposed child care operation. 5. Total Impervious Surface Area: No additional building or parking area is required. The proposed project will provide 5,625 square feet of outdoor play area that is neither impervious area nor stabilized. Therefore, no increase in impervious surface area will result from this project. JUNE 4 1996 1" 6. Traffic Circulation: No new driveway improvements are required to accommodate the proposed child care operation, and none are proposed. Site access and on-site traffic circulation have been approved by the County Traffic Engineer. 7. Off -Street Parking: Required for.child care use: 6 paved parking spaces Provided for child care use: 6 paved parking spaces The overall site has 56 parking spaces. Forty spaces are required for the church and 6 spaces are required for the child care use. Therefore, the total site parking exceeds the minimum required number of spaces by 10. 8. Stormwater Management: The stormwater management plan has been approved by the Public Works Department. 9. Landscaping Plan: The landscaping plan is in accordance with Chapter 926 and 971 of the land development regulations. Special buffering (Type "C" buffers) exists on site for the existing facilities. The proposed play area will be buffered by a 6' opaque screening feature on its south side where the play area is closer than 150' to an adjacent residential area. 10. Utilities: County water and wastewater are available to the site. Connection to county water service is mandatory at this time. Due to the low demand of the site, connection to county wastewater service is not required. The county Utilities Services and the county Environmental Health Unit (HRS) have no objections to approval of the proposed site plan. 11. Environmental Issues: 'Environmental planning staff .have no objection to the approval of the child care use and its associated outdoor play area. 12. County Environmental Health Service Unit (HRS): Churches may opt to be exempted from HRS child care licensing pursuant to the provisions of Florida Statute 402.316. In order to qualify for the exemption, the church must either be a member of or accredited by an organization recognized by the HRS, and must be issued a certificate of compliance by the organization. Community Baptist Church has chosen to be exempt from HRS licensing. Therefore, the applicant must document to planning staff that a certificate to operate a child care operation has been issued by an HRS -recognized organization. The Environmental Health Services Unit has no objection to special exception use approval of the proposed child care operation. 13. Special Land Use Criteria: The application must satisfy the following .specific land use criteria which apply to a child day care facility proposed in the RS -3 zoning district: a. The site shall be located on a paved road with sufficient width to accommodate pedestrian and vehicular traffic generated by the use. The facility shall be located near thoroughfares, as designated in the county's major thoroughfare plan, so as to discourage traffic along residential streets in the immediate area. Note: Satisfied by site location on Roseland Road, which is a Thoroughfare Plan road. b. Special passenger loading and unloading facilities shall be provided on the same site for vehicles to pick up and deliver clientele. Such or shall include driveways that do not require any back-up movements by vehicles to enter or exit the premises. Note: Satisfied by existing driveway and drop-off facilities. Keatin , ACP Planning Director Community Develop ent D ector SUBJECT: Request to Form Task Force for Preparing a CR 512 Corridor Plan DATE: May 29, 1996 It is requested that the data herein presented be given formal consideration by the Board of County Commissioners at its regular meeting of June 4, 1996. JUNE 4 1996 BACKGROUND: Recently, Board of County Commissioners Chairman Fran Adams received a letter from Vero Lake Estates resident Martha Osborne (see attachment #1). Subsequently, a copy of the letter was sent to planning staff. The letter stated that several citizens in the north county are concerned about the CR 512 corridor and are hopeful that a CR 512 task force will be formed to prepare a plan similar to the Wabasso Corridor Plan. Ms. Osborne's letter states that there is support for such a task force. from residents of Vero Lake Estates, Pine Lake'Estates, Sunshine Travel Park, Fellsmere, and Sebastian, including three Sebastian City Council members and two Fellsmere Town Council members. Although no CR 512 corridor plan area has been defined, any special planning efforts by the county would involve only the unincorporated area but would be coordinated with Fellsmere and Sebastian. Planning staff responded to Ms. Osborne's letter (see attachment #2), stating that it intended to schedule her request for consideration by the Board of County Commissioners at its June 4, 1996 meeting. ANALYSIS: •Current Corridor Planning Activity Recently, planning staff completed and the Board of County Commissioners adopted the Wabasso Corridor Plan. That plan required over 6 months of task force work, involving a field -trip .and various workshops and public meetings. Staff intends to propose formal codification of that plan's requirements and procedures during the next round of land development regulation (LDR) amendments this summer and fall. Planning staff is also coordinating the efforts of the recently appointed SR 60 Corridor Plan Task Force which is scheduled to hold its first meeting on - June 4, 1996 at 2:00 p.m. Also, as stated in its response letter (see attachment #2), staff is encouraging developers of new non- residential projects along CR 512 to consider following the principles of the Wabasso Corridor Plan, since CR 512 is the entrance to the north county and the Board has expressed its support for special aesthetic improvements along such county entranceways. Due to the work involved in preparing the SR 60 Corridor Plan, it is staff's opinion that work on a CR 512 corridor plan should not commence until the SR 60 Corridor Plan is completed. *Pending Ordinance Doctrine In relation to the Wabasso Corridor Plan and the "interim" SR 60 Corridor Plan, the "pending ordinance doctrine" has been used by the county. As -was reported to the Board last fall, staff applied the pending ordinance doctrine to new development proposals in the Wabasso Corridor Plan area once an initial plan was formulated by the Wabasso Corridor Plan Task Force. This ensured that new development proposals would comply with the intent of the proposed plan. Now that the Wabasso Corridor Plan has been adopted by resolution of the Board, it will be codified into the LDRs at the next opportunity. Until a formal LDR ordinance is adopted, the requirements and procedures contained in the adopted plan are being applied under the pending ordinance doctrine. On April 9, 1996, the Board extended staff's application of the pending ordinance doctrine to non-residential project proposals along the SR 60 corridor from 43rd Avenue to 102nd Avenue. Under that action, the following four design upgrades are being applied to such projects: BOOK 98 PAGE 279 JUNE 49 1996 33 I BOOK 98 ME 280 1. Landscaping upgrade along SR 60 frontage. In keeping with the increased landscaping required along the Indian River Mall DRI project's SR 60 frontage, Type "C" landscape strips are being required along SR 60 and at major intersections (e.g. along 58th Avenue north and.south of SR 60). Examples include the Indian River Square (Target) shopping center, Cracker Barrel, and Applebees projects. 2. Building foundation plantings. Plantings of shrubs, flowers, or understory trees are being required along portions of the foundations of new commercial buildings. Such plantings are contained within landscape strips or planters. Examples include Applebees, Cracker Barrel, Indian River Mall and Indian River Square outparcel projects. Some foundation plantings are also being provided along the main buildings of the Indian River Mall, Indian River Commons, and Indian River Square projects. 3. Monument -style free-standing signs. Except for sites at the I-95/SR 60 interchange, limited height, monument -style signs are being required. Examples include Applebees, as well as Indian River Mall and Indian River Square outparcel projects. (Note: On April 23, 1996, the Board approved a sign package for the Indian River Mall, consistent with this requirement.) 4. Architectural features. Buildings proposed or constructed are required to use roof slopes, canopies, or other features to provide some building articulation. Examples include Applebees and Cracker Barrel, as well as Indian River Mall and Indian River Square outparcel projects. Some building articulation features are also being provided with the main buildings of the Indian River Mall, Indian River Commons, and Indian River Square projects. There are limitations to the pending ordinance doctrine, as indicated in the attached, recent memo from Deputy County Attorney Will Collins (see attachment #3). In general, invoking the pending ordinance doctrine is more likely to be legally sustainable if such action is based upon a proposed ordinance change that is imminent and specific. The Deputy County Attorney has recommended that the pending ordinance doctrine not be invoked for other corridors (such as the CR 512 corridor) until recommendations (a full plan) are formally considered by the Board. Until that occurs, the Deputy County Attorney recommends that staff continue to encourage applicants to incorporate various staff -recommended design upgrades in order to avoid possible nonconformities with plans and ordinances that may be adopted in the future. ALTERNATIVES: The Board has various options regarding Ms. Osborne's request. First, the Board must determine whether or not it wants to have a CR 512 corridor plan proposed, and whether or not it wishes to appoint a task force to prepare such a plan. If the Board decides that it wants to appoint a task force to prepare a CR 512 Corridor Plan, then the Board has several options, including the following: 1. Appoint a CR 512 task force and begin the CR 512 corridor planning process now, and: a. Invoke the pending ordinance doctrine now, after citing specifically what pending regulations are to be applied and the circumstances to which they are to be applied; or b. Invoke the pending ordinance doctrine at such time as the Board considers the task force's recommended plan and adopts a CR 512 Corridor Plan. JUNE 49 1996 34 2. Appoint a CR 512 task force within a timeframe such that the CR 512 corridor planning process can begin when the SR 60 corridor plan process is completed, and a. Invoke the pending ordinance doctrine now, after citing specifically what pending regulations are to be applied and the circumstances to which they are to be applied; or b. Invoke the pending ordinance doctrine at such time as the Board considers the task force's recommended plan and adopts a CR 512 Corridor Plan. As previously stated, it is planning staff's opinion that the county should focus on and complete its work on the SR 60 Corridor Plan before starting a CR 512 corridor plan process. Therefore, it is planning staff's recommendation that neither option l.a. nor option l.b. be selected. Also, as previously referenced, the county attorney's office has given an opinion that the pending ordinance doctrine cannot be legally invoked for CR 512 until the Board has approved a CR 512 corridor plan. Therefore, neither option l.a. nor 2.a. should be selected. Thus, the option consistent with both the planning staff and attorney's office opinions is option 2.b. Under such an option, planning staff would continue to recommend design enhancements to developers of new non- residential projects along CR 512, as referenced in attachment #2. RECOMMENDATION: Staff recommends that the Board of County Commissioners: 1. Agree to appoint a task force to prepare a corridor plan for CR 512. 2. Direct planning staff to return to the Board with a recommended list of potential task force members in a timely manner that will allow the CR 512 task force to begin its work as soon as the Board considers the recommendations of the SR 60 Corridor Plan Task Force. 3. Direct staff to continue to encourage developers of new non- residential projects along CR 512 to incorporate into their development plans the design principles of the Wabasso Corridor Plan. Commissioner Macht felt the County must do the best it can to assure development does not become ugly and does not adversely impact residents who live close to the thoroughfare. Deputy County Attorney Collins expressed his concerns regarding ordinances being applied in different parts of the County which are unwritten and not yet formally adopted. He felt a task force could apply other criteria which are not yet in ordinance form which would allow landowners to proceed under laws as they are now, not as they may be sometime in the future. Commissioner Bird felt this task force may be a little premature. Chairman Adams cited the Vero Lake Estates community which made an effort to clean up their community and commended staff who made an effort to go ahead and start the process. She felt citizens like a comfort level in having some input into the process. Deputy County Attorney Collins advised the Board there is no legal problem with the motion on the floor simply to appoint a task force and put the process in motion. THE CHAIRMAN CALLED THE QUESTION and the Motion passed unanimously. $38,900,000 UTILITIES BOND ISSUE The Board reviewed a Memorandum of May 29, 1996: TO: Members of the -Board of County Commissioners DATE: May 29, 1996 SUBJECT: $39,900,000 UTILITY BOND ISSUE OFFICE OF MANAGEMENT AND BUDGET - AGENDA ITEM FROM: Joseph A. Baird OMB Director Indian River County was scheduled to issue a Water and Sewer Revenue bond issue on March 11, 1996. The Preliminary Official Statement was printed on Thursday, March 7, 1996. Unfortunately on Friday, March 8, there was a significant change in the interest rates upwards which did not benefit the County. Due to this change and the volatile interest market, County staff, the County Financial Advisor and the Underwriter decided not to market the bonds on Monday, March 11, 1996. Because of the recent volatility of the bond market, staff wanted the ability to move rapidly to take advantage of the market if the interest rates dropped. On March 13, 1996 the Board of County Commissioners passed a resolution, 96-042, to give the Chairperson or Vice Chairperson and the County Administrator or the Budget Director the authority to approve the issuance of bonds provided the 30 year bond issue had a true interest cost that did not exceed 5.8% per annum. JUNE 1996 ds - On the afternoon of Tuesday, May 21, 1996 the market dropped to where the underwriters could issue the bonds within the approved parameters. A bond issue sale was authorized and Indian River County issued bonds at a true interest cost of 5.752%. The interest rate achieved is within 60 basis points of the lowest interest rate in the market place in _ the past 25 years. The lowest rates were achieved on October 17, 1993 with a 30 year Term Bond rate of 5.18%. Interest rates in the past 2 years on average have exceeded 7.00%. ON MOTION by Commissioner Macht, SECONDED by Commissioner Bird, the Board unanimously approved the bond issue at a true interest cost of 5.7520, pursuant to staff's recommendations. Lenz of Vero Beach for Phase IV of the Water Expansion Plan in the amount of $190,000.00. The agreement was assigned to Kimley-Horn and Associates when H. F. Lenz was purchased by Kimley-Horn and Associates. (See attached agenda item approved by the Board on December 12, 1995.) ANALYSIS The service for the Water Expansion Phase IV Project has been completely satisfied. The engineer has been paid to date in the amount of $183,200.00, leaving a balance of $6,800.00, including retainage. The engineer submitted a final payment request in the amount of $6,800.00. RECOMMENDATION The staff of the Department of Utility Services recommends the Board of County Commissioners approve the final payment request in the amount of $6,800.00 to Kimley-Horn and Associates for services rendered.
