No room shall be considered "reserved" until a signed contract and 25% deposit are received. 2. No contract shall be valid unless it is signed by the designated Indian River County Parks and Recreation Department approved staff member. 3. Contracts for groups composed of minors will be issued only to adults who accept responsibility for them and will supervise them throughout the period covered. 4. No tickets, for any event, shall be sold at the door and no admission charges shall be made except as authorized by the contract. The Applicant shall provide to the County information as to the total ticket sales at 30, 15, 7 and 3 days prior to the Event. The County reserves the right to cap ticket sales depending on the capacity of the Premises and the iG Center or because of law enforcement, sanitation, traffic control or due to other public safety issues. 5. Renter shall maintain the area rented in a safe, clean and attractive condition and at the end of the event, the area shall be in a substantially same condition as it was at the beginning of the event. 6. Renter shall not exceed the posted occupancy of the rented area. 7. Cooking indoors is strictly prohibited. 8. Renter shall not make any alterations or improvements to the rented area, or any portion of the Intergenerational Recreation Center. This includes moving, and removing, chairs, tables and any other equipment to any other area of the Intergenerational Center without approval of the Center staff. 9. Renter shall remove all decorations at the end of the event. 10. Renter agrees to accept premises "as is" and acknowledges responsibility of conduct of each member attending the group's activity. Applicant conducts all events at their own risk, each member has the status of "permittee". 11. Contracts are non-transferrable. 12. A 30 day notice must be given to reschedule or cancel, in order to receive a refund on the reservation deposit. If cancellation notice is not given before the 30 day period, the reservation deposit will be forfeited. For all events booked within 30 days, or less, the 25% reservation deposit will become non-refundable. 13. Rescheduling will only be allowed once and must be rescheduled a minimum of 30 days in advance. More than one rescheduled reservation requires cancellation of the current contract. The applicant will only be reimbursed if the cancellation occurs before the time frame listed above. If the cancellation occurs after the 30 day time frame, the deposit will be forfeited. 14. The serving and consumption of alcoholic beverages is strictly prohibited under this Rental Agreement/Contract and grounds I'm- dismissal of the event including the loss of your Damage Deposit 15. There shall be no eanlbline on the premises. 16. Undisclosed or unpermitted activities or hours shall void this contract. The Event shall be used for no other purpose whatsoever, unless prior written approval is requested in writing by Applicant and given by the County which approval shall be subject to availability but not be unreasonably withheld, conditioned, or delayed so long as such request is submitted at least 90 days prior to the beginning of the License Duration. 17. Applicant's failure to make any of the payments required hereunder in a timely manner shall constitute a material breach and shall result in the immediate termination of this License Agreement. All fees, costs and expenses, including, without limitation, attorney's fees, incurred by the County in the collection of any payment due hereunder shall be reimbursed by Applicant. Notwithstanding the provisions of the Agreement, the Parties acknowledge the Applicant has neither the statutory authority nor legislative appropriation to indemnify and hold the County harmless for losses it may incur as a result of this Agreement. Applicant, a state agency or subdivision as defined in section 768.28, Florida Statutes, agrees to be fully responsible to the limits set forth in section 768.28, Florida Statutes, for its negligent acts or Applicant Initials Intergenerational Center Rental Contract Page 2 of 5 sC�fVBRr0 • • RENTAL CONTRACT INDIAN RIVER COUNTY INTEM NERA,nONAL �ORIO" RECREATION CIATER E V E N T V E N C E omissions or intentional tortuous acts or noncompliance and agrees to be liable to the limits sets forth in section 768.28, Florida Statutes, for any damages proximately caused by said acts or omissions which may result in claims against the County. Nothing herein shall be construed to be a waiver of sovereign immunity by the contractor to which sovereign immunity applies. Nothing herein shall be construed as consent by a state agency or subdivision of the State of Florida to be sued by third parties in any matter arising out of any contract. 18. Applicant acknowledges that the County may immediately terminate the Event if the National Weather Service issues a severe weather warning, or imminent severe weather conditions develop in the area indicating a risk to public safety, or a state of emergency has been declared. Applicant hereby waives any rights and all claims for damages against the County that may result from the exercise of the rights reserved herein. 19. The County and its officers, agents and employees engaged in the operation and maintenance of the Premises reserve the right to enter upon and to have free access to the Premises at any and all times, which reservation is hereby acknowledged and agreed to by Applicant. Any notice, request, instruction, demand, consent or other communication required or permitted to be given under this License Agreement shall be in writing and shall be given in writing and delivered by email to: ichandler0di, rcgov.com 20. Applicant acknowledges receipt of and agrees to comply with the iG's Rules and Regulations which are attached hereto as Exhibit C and incorporated by reference. 21. Animals will not be permitted onto the iG Center property during an event unless they are considered a Service Animal. The Americans with Disabilities Act (ADA) 2010 Regulations define a service animal as "any dog that is individually trained to do work or perform tasks for the benefit of an individual with a disability, including a physical, sensory, psychiatric, intellectual, or other mental disability. Other species of animals, whether wild or domestic, trained or untrained, are not service animals for the purposes of this definition." C.F.R. § 35.104 and § 36.104 (2010). This paragraph does not apply to organizations hosting animal events (dog shows/horse shows). Indian River County Code of Ordinances also states: "Dogs prohibited No dogs are allowed in any park or recreational facility unless specifically posted as allowable by the department. (205.3 paragraph 22). The Promoter/Organization/Renter is wholly responsible for any incidents that occur during the event that involve non -service animals that were allowed on the property during their event. 22. County and Applicant retain all television, film, recording and licensing rights as to any Event that takes place in or on the Premises, provided such is permitted within the Artist Contract. County will coordinate such recordings with Applicant's marketing representative. In the event of artist recording restrictions, Applicant shall request the right to allow the County to take generic production and still photographs of the Event. Notwithstanding the provisions of the Agreement, the Parties acknowledge the Applicant has neither the statutory authority nor legislative appropriation to indemnify and hold the County harmless for losses it may incur as a result of this Agreement. Applicant, a state agency or subdivision as defined in section 768.28, Florida Statutes, agrees to be fully responsible to the limits set forth in section 768.28, Florida Statutes, for its negligent acts or omissions or intentional tortuous acts or noncompliance and agrees to be liable to the limits sets forth in section 768.28, Florida Statutes, for any damages proximately caused by said acts or omissions which may result in claims against the County. This acceptance is on behalf of all persons in the group with me. If the rules are violated this permit may be revoked and future permission may be refused.
