HomeMy WebLinkAbout1999-040a Indian River County I/ A/ Task 01- Roseland Area Stormwater Improvements 9 t) , D q b df WORK ORDER NO. 2 TO THE PROFESSIONAL UIVIL SERVICES MASTER AGREEMENT ® BETWEEN CARTER AND ASSOCIATES, INC., DATED AUGUST 4,1998 AND INDIAN RIVER COUNTY, FLORIDA. Pursuant to the Professional Services Agreement dated August4,1998, by and between Indian River County, apolitical subdivision of the State of Florida, hereinafter referred to as the COUNTY, and CARTER AND ASSOCIATES, INC., VERO BEACH, FLORIDA, hereinafter referred to as the ENGINEER, this Work Order No. 2 is an extension of and hereby becomes apart of the MASTER AGREEMENT as follows: SECTION 1 - PROJECT LIMITS AND DESCRIPTION The Roseland Area Stormwater Improvement Project will provide flood control and stormwater quality treatment fora portion of Roseland lying primarily east of the FEC Railroad including tributary areas west of the Railroad. The limits of the work is the east Roseland Watershed north of the City of Sebastian, east of Gibson Street, south of the St. Sebastian River, and west of US 1, including connecting tributaries. SECTION H - COUNTY OBLIGATIONS The COUNTY agrees to provide the ENGINEER with the following material, data or services as required in connection with the work to be performed under this Agreement: A. Currently available drainage studies, survey drawings, plans, calculations and other data pertinent to the project. B. Title information and title opinion relating to land necessary for the project. C. Landowner authorizations to inspect the site(s) with jurisdictional agencies to determine existing environmental conditions. D. Landowner negotiations to acquire easements and/or right-of-way necessary for the project. E. Property appraisal information for areas of potential acquisition. F. Soils testing as required, under the direction of the ENGINEER. SECTION III - SCOPE OF SERVICES A. The ENGINEER will perform all necessary environmental investigation, engineering design, surveying, drainage design, permitting, and incidental work for the drainage and related improvements to the east Roseland Area Stormwater Improvement project. Detailed Plans and Specifications shall be prepared so that the construction can be properly bid. The ENGINEER will prepare complete permit applications to St. Johns River Water Management District(SJRWMD), Florida Department of Environmental Protection(FDEP), US Army Corps of Engineers(USACOE), and Environmental Protection Agency(EPA), for the COUNTY's signature. B. After issuance of a work order and written authorization to proceed, the ENGINEER shall consult with the COUNTY to clarify and define theCOUNTY's requirements and objective for the project, and review all available data. C. The ENGINEER will strive to complete his work on the PROJECT within the time allowed by maintaining an adequate staff of registered engineers, biologists, draftsmen, and other employees on the work at all times. D. The ENGINEER shall report the status of this project to the Director of Public Works Department upon request and hold all drawings, calculations and revised work open to the inspection of the Director or his authorized agent at any time, upon reasonable request. E. ITEMIZED WORK TASK 01 - PROJECT DEFINITION The ENGINEER will assemble all available surveys and information from the COUNTY which is associated with this project. The ENGINEER will prepare a conceptual design of the drainage system in order to determine the right-of-way needed for the project and receive comments from the COUNTY for the design concept. A positive piped and/or open swale drainage system shall be designed along the existing flood plain east of the FEC Railroad right-of-way north approximately three hundred feet. Once the COUNT Y has reviewed and approved the conceptual plan, the ENGINEER will meet with all regulatory agencies having permit jurisdiction on the project, as well as representatives of the project area. During this task, a meeting will be held with COUNTY staff to review and examine the plan and select the desired design so that the ENGINEER may proceed with subsequent tasks. Engineering Services (Includes G.K. Environmental Estimated Cost - See attachment) A. Prepare Base Sheet • Assimilate County survey drawings, aerials and all available topographic information. • Survey work to provide information on tributary drainage structures directly connected to the Hanson property. B. Preliminary Environmental Report • Written letterreport and aerial map with jurisdictional wetland boundaries. • Meet on-site with agencies, flag and survey wetland lines in the vicinity of the Bay Street right-of-way and areas to the north up to three hundred feet which may be directly impacted by the proposed swale/pipe conveyance system. C. Conceptual Design Review watershed areas for establishing the limits of the project and for preliminary sizing of the improvement. • Preliminary drainage calculations to determine peak discharge rate. • Research historical drainage patterns which may be impacted. = Preliminary wetland mitigation plan for impacts within the Bay Street right-of-way and area to the north 300'±. — Inspect potential mitigation sites; — Draft a conceptual mitigation plan; — Meet with regulatory agencies and provide a written report. • Prepare a conceptual design plan with the conveyance system and wetland impacts depicted. Cost + 10% Blueprints ............................................ $ 0.20/sf Mylars............................................... $ 1.75/sf Xerox................................................ $ .15 SECTION VII - PARTIAL PAYMENTS The COUNTY shall make monthly partial payments to the ENGINEER for all authorized work pertaining directly to this project performed during the previous calendar month. Invoices will be submitted on forms furnished for that purpose by the ENGINEER to the COUNTY monthly for services performed and expenses incurred pursuant to this Agreement during the prior month. The ENGINEER shall submit duly certified invoices in duplicate to the Director of the Public Works 3 Department. The amount of the invoices submitted shall be the prorated amount due for all work performed ® to date undar this phase, determined by applying the percentage of the work completed as certified by the ENGINEER to the total due for this phase of the work. The amount of the partial payment due for the work performed to date under these phases shall be ® an amount calculated in accordance with the percentage of work complete, less ten percent (10%) of the amount thus determined which shall be withheld by the COUNTY, as retainage, and less previous payments. The ten percent (10%) retainage withheld with respect to the Task I phase shall be paid in full to the ENGINEER upon award of a Design Phase Work Order, but in no case shall the amount be retained longer than six (6) months after the date of final acceptance of the Task I phase by the Director of Public Works. Fees are payable monthly based upon a percent complete of the lump sum elements. Billings will be payable within 25 days. The contract is broken into deliverable units. No payment shall be made unless the Public Works Director has received and approved work products required under the Scope of Services. SECTION VIII - RELATIONSHIP TO MASTER AGREEMENT AND LAWS OF FLORIDA All conditions set forth in the MASTER AGREEMENT shall control unless otherwise specified in this WORK ORDER. This WORK ORDER, regardless of where executed, shall be governed by and construed according to the laws of the State of Florida.
