Article V Trust Fund Grant -ill -Aid Agreement
for Indian River County, Florida
This Agreement is made between ilio olllcc CII the Stale Courts Admiaistrator (the
"OSC'A") and elle Indian My" County Board ofComity Commissioners 011ie "Grantee"). The
parties agree that:

(1997), for casts incurred under Article V of elle Florida ConsOmlion in operming the state
coupes system, contingent upon sufficient ('ounly Article V Trust Reuel collections. Upon
wvritlen request I'or the release of the fiends, the OSUA %will jlay out dlrcc djsbursenlcnls
prior to July 31, 1999 to the Grantee.
B. The Grantee has a population of grealer than 74.999 and %ill use grant monies provided
under this Agreement in accordance wwirh _' 5.402(l g d)(2 ), lila. Stal. ( 1997) for expert
witness fees in Criminal cases, court rcporlillg and 11:111:`.Crihmg costs in Criminal cases, and
costs associated with the appoinllnenl ofspecial public defenders.

B. The Grantee has a population of greater than 74,999 and will use grant monies provided
under this Agreement in accordance with §25.402(1)(4)(2), Fla. Stat. (1997) for expert
witness fees in criminal cases, court reporting and transcribing costs in criminal cases, and
costs associated with the appointment of special public detenders.
1. The Grantee will submit a written requisition to the OSCA for release of grant funds
no later than February 19, 1999.
2. The Grantee, in consultation with the chiefjudge of the Ninteenth Judicial Circuit,
will submit a detailed, written plan for use of grant funds to OSCA no later than
February 19, 1999, for OSCA's use in reporting to the Florida Legislature.
3. The Grantee will not use grant funds for lobbying the Florida Legislature. the judicial
branch, or a state agency.
4. The Grantee will retain grant funds not encumbered by June 30, 1999 for subsequent
use in accordance with Provision B. The Grantee will return grant funds not
encumbered by June 30, 2001, along with interest accrued, to the trust fund for
distribution to all counties in the fund's fourth year.
C. This Agreement is subject to the following terms incl conditions -
The Grantee will maintain proper documentation orall monies spent in a manner
sufficient for proper pre- and ,post -audit. The Grantee will maintain all expenditure
records for a period of years following the conclusion of this Agreement.
2. The Grantee will maintain all records made or received in conjunction with this

§ 11.45. Fla. Stat. (1997).
5. ll; in the judgment of the OSCA, the Grantee for any reason fails to comply with the
terms of this Agreement; the OSCA will have the right to terminate the Agreement on
5 days written notice by certified mail. In the event of termination, the Grantee will
return all grant funds to the OSCA for reversion to the Article V Trust Fund.
This Agreement constitutes tfte entire understanding of the parties. All modifications to the
Agreement must be in writing. This Agreement is cfiective on the date of execution and will
terminate on June 30, 1999,
