This is an amendment to the existing Professional Services Agreement(AGRCCiviENT) dated July 21, 1998, between Applied Technology and Management, Inc. (CONSULTANT) and Indian !fiver County (COUNTY), This amendment addresses changes in "Section III - Scope of Services" and "Section V - Compensation" of the Agreement. Amendment Dgscri tion ' This Amendment includes the following changes to "Section III -Scope of Service" and "Section V - Compensation" of the Amendment: SECTION Il! 1. The CONSULTANT shall conduct a Winter Recreational Beach User Survey during March through April, 1999 in accordance with Exhibit "A". 2. The CONSULTANT shall generate a separate report to the economic analysis cost allocation plan and complete the necessary modifications in order to incorporate the Winter Survey Data into the overall findings of the funding program. SECTION V is being revised in response to the Section III changes. The charges associated with the change in project scope are in accordance with "Exhibit A". The section of the original AGREEMENT entitled "Section V - Compensation" shall be revised to include compensation due the CONSULTANT in the amount of $21,950. This AGREEMENT is hereby amended as specifically set forth herein. All other sections of the AGREEMENT shall remain in full force and effect, and are incorporated herein. This Amendment No. 1 to the AGREEMENT regardless of where executed, shall be governed by and construed by the laws of the State of Florida. Machtp Chairman Attest:_. l: Jeffery K Barton 4w 40 EXHIBIT "A" Scope of Work and Project Costing C-1 ib SCOPE OF WORK AND PROJECT COSTING Indian River County Winter Recreational Beach User Survey Task 1.0 Conduct Beach User Survey This task is the actual collection of the recreational beach user data by performing on-site beach surveys of beach goers. The survey's design will allow the economists to evaluate recreational benefits per typical user and allocate these benefits among specific user groups. This Winter Survey will be used to more completely validate the data. It will also allow us to make more up to date calculations of beach user counts. These surveys will be conducted during the March through April period. The cost of the Winter Survey includes seven (7) survey days along the beach nourishment project areas within the Indian River Beaches. Costs include travel, overnight stays and mileage, Tran Task 1.0 Casts: $9,97 Task 2.0 Evaluation and Interpretation of Beach user Survey In this task Is beach survey data will be tabulated and a preliminary recreational beach use survey report will be written and presented to the appropriate County officials and Boards. This report will be used to validate the Phase I survey and the data of the two reports may be combined. Tota! Task 2.0 Costs. = $3,225 Task 3.0 Revise Recreational Benefits and the 'Distribution of Benefits Computation of the total recreational project benefits by Project Sector will be developed based on the new survey data collected in this study. All benefits will be revised based on the neva economic data and the adjusted total distribution of recreational and storm protection benefits. Task 4.0 Project Reports and Deliverables The economic team will make monthly reports and provide the County with draft reports and participate in County meetings as required. There will be a written summary report that may be part of the overall report submitted by the Project Team. Total Task 4.0 Costs: = $2,000 Task 5.0 Project Meetings and Project Management Participate in meetings with the County Commission and staff to present the results of the beach user survey and the final adjusted distribution of total project benefits. Total Task 5.0 Costs. = $.3,000 Total Tasks 1.0 - 5.0 Costs. = $21,950 99.7198 99ONMTEPCOS73CHERM41)2037'- 40 1-1 _�„ �, ]I]yE44SagxY }e[YPMOi epv VVV INDIAN RIVER COUNTY EXPERIMENTAL TEST PLAN/MONITORING OF VERO BEACH PEP REEF PROFESSIONAL SERVICES AGREEMENT SEA TURTLE MONITORING THIS AGREEMENT, entered into this z-! day of mei , 1999, by and between INDIAN RIVER COUNTY, a ,political subdivision of the State of Florida, hereinafter referred to as the COUNTY, and Christine Perretta ,hereinafter referred to as the CONSULTANT, WITNESSETH The COUNTY and the CONSULTANT in consideration of their mutual covenants, herein agree with respect to the performance of professional services by the CONSULTANT and the payment for those services by the COUNTY as set forth below. The CONSULTANT shall provide Biological Monitoring (Sea Turtle Monitoring) of the Indian River County, Vero Beach PEP Reef, professional biological recommendations, preparation of monitoring reports and data, and additional related miscellaneous services to the COUNTY and shall give advice to the COUNTY during the performance of the services to be rendered hereunder. SECTION I - SCOPE OF WORK The CONSULTANT shall provide experienced, technical and professional field and laboratory/office personnel to perform the necessary sea turtle monitoring services, data analysis, professional recommendations and other miscellaneous services set forth in the Florida DEP permit. The County Coastal Engineer shall act as the duly authorized agent of the COUNTY for ordering and directing said work. The consultant shall obtain and maintain during the life of this agreement, proper certification from the State of Florida DEP and USFWLS to monitor, relocate, and inventory turtle activity within the project limits, as needed. Christine Perretta will superviselperform the work as necessary. The COUNTY must approve all personnel performing the work. SECTION 11 - TIME OF COMPLETION AND DURATION OF AGREEMENT The Services of this AGREEMENT will begin upon execution of contract and extend until receipt of the final report for the 1999 nesting season. SECTION III - COMPENSATION Compensation to the CONSULTANT for the services herein shall be on a percentage basis for the actual work performed in accordance with the Schedule of Services and Fees set forth in Exhibit "B".
