AND INDIAN RIVER COUN I`Y, FLORIDA. This is an amendment to the existing Construction Testing Services Agreement (AGREEMENT) dated February 3, 1993, between Dunkelberger Engineering and Testing, Inc. (ENGINEER) and Indian River County (COUNTY). This amendment addresses changes in "Section IV - Compensation" of the AGREEMENT'. This amendment includes the following: "Section IV - Compensation" is being adjusted to increase the Not -to -Exceed amount of the AGREEMENT. The section of the original AGREEMENT entitled "Section IV - Compensation" shall be revised to include compensation on a unit price basis for actual testing provided tip to a total "Not -to -Exceed" budget of $152,000.00. The AGREEMENT is hereby amended as specifically set forth herein. All other sections of the AGREEMENT shall remain in full force and effect, and are incorporated herein. This Amendment No. 1 to the AGREEMENT, regardless of where executed, shall be governed by and construed by the laws of the State of Florida.
