Administrative Code, Chapter 33-3.003 and 73-3.017, the .attached
agreement is nubiri.tted for your review and signature.
The contact persons overseeing this program at Indian River
Correctional Institution are Lieutenant Linda Cochenour and Mr.
Steve Kegerreis. They can be reach at 564-2787„ and 564-2824,
respectively.
The Department continues to have ae one of its goals, work programa
that provide support for the connunity an well as productive
opportunities for the inmate population. We are pleased to
participate with you in this program and request that you contact
as, at any time, if you have concerns or questions about the
execution of this agreement.

referred to as Corrections, and --Indian--RiverBoard of_ County
CQg=ja#ioners, hereinafter to as the Agency, is done so in
accordance with Chapter s. 945.40 F.S., and Rules of the Department
of Corrections, Chapter n. 333.003, F.A.C., Inmate Work Program
and s. 33-3.01.7, F.A.C., Use of Inmates in Public Works 'Thea

Work performed under this local agreement is determined to be value
added or cast savings as defined in the Community Work. Squad
1lanual.

I.
Corrections agrees to provide for those items no indicated with a
chock ( X ) to the left of each appropriate number. All other
items are to be marked "N/A" to the left of the number.
1. Screen the inmates for the work to be performed to
provide a reasonable basis to believe that none present
a danger to property or pernona.
2. Provide up to "veer inm tes each workday for th(�r�

X3. Provide one vehicle and one Correctional officer
each workday to transport inmates assigned to the Agency
and to provide supervision as agreed herein.
X _4. provide food and drinke for inmate lunches.
x S. Be. responsible for the apprehension of an escapee and
handling of problem inmates. provide transportation
from the work site to the correctional facility for
inmates who ref+.rse to work, become unable to work, or
cause a disruption in the work schedule.
6. Be responsible for administering all disciplinary action
taken against an inmate for infractions committed while
under the supervision of the Agency.
x 7. Provide for medical treatment for ill or injured
inmates and transportation of such inmates..
N/A B. Conduct a background check, which includes a criminal
history check, and obtain approval by Lite
institution/facility Superintendent or designee prior to
authorizing Non --Corrections personnel to participate in
training to supervise inmates.
H/A 4. Provide orientation and training to non -corrections
personnel approved to supervise inmates prior to their
assuming supervisory responsibility of an inmate squad.
Training will he in accordance with Corrections'
guidelines for non -corrections personnel supervising
offenders. Provide refresher training each successive
training year.
NlA 10. Notify the Agency in the event one of their employees
fails to provide proper supervision of inmates.
x„11. Provide inmates with all personal items of clothing
appropriate for the season of the year.
�t 12. Provide inmates for transportation/work at the
appropriate time regardless of temperature or inclement
weather, unless notified by the; Agency of suspended work
operations, or the Department determines that a squad
should not check out.

II.
The Agency agrees to provide for those items so indicated with a
chick ( x ) to the left of each appropriate number. All other
items are to be marked "N/A" to the left of the number.
N/A 1. Provide Corrections with a schedule of hours which
inmates will be worked in accordance with the
established workday for the Agency and the
transportation time required. Any deviation from the
established schedule must be reported to an agreed to by
Corrections.
_E12„2. Provide supervision of inmates in accord with Department
of Corrections Rules and Regulations. Non-Correcti_ona
personnel may oaupervi.se minimum and medium custody
inmates. Each such parson must have a background check,
which includes criminal history check, and be approved
by the institution/ facility Superintendent or designee
and complete required orientation/training in the
supervision of inmates.

Provide transportation of inmates to and from work if
such is not provided by Corrections as agreed to in
Section I of this Agreement.

Provide all tools, equipment, materials and personal
items such as gloves, rubber boots, hard hats, etc.,
necessary and appropriate to perform the required work.
9.
Ensure that when licensing or permits are obtained if
required for the work to be performed. Provide
necessary supervision and guidance for projects which
require a permit which require technical assistance to
complete the project.

while the inmate is under supervision of the Agency.
Report any inappropriate behavior displayed by inmates
or any inmate who fails to perform his tasksi in an
acceptable manner.

Record daily the number of hours worked by inmates using
forms provided by Corrections and submit the form an a
weekly basis to Corrections.
IIIA S.
Report all .inmate injuries to Corrections.
Report all innate injuries, regardless of how minor in
nature, to Corrections as soon as practical.
Medically related complaints made by an inmate shall be
reported Corrections as soon as practical.
In cases of emergency, first aid, within the scope of
the supervisor's medical training, shall be provided,
request emergency health care assistance, and assistance
rendered to Corrections.
NIA 4.
Provide inmates with a fifteen minute rest break in the
morning and afternoon. Lunch breaks shall normally

breaks.
NIA 14. Provide an employee of the same sex as the medium
custody inmate(s) to be immediately available to render
assistance in cases where the squad supervisor i;a of the
opposite sex as the inmate.
111. Require each non -Correction person approved to supervise
inmates and other appropriate staff members to attend
orientation/ training in the supervision of inmates prior
to assuming supervision of inmates, and to attend annual
orientation/training to be provided by the Department.
x_12. Agency hereby agrees to be liable for, and shall
indemnify, defend and hold Corrections harmless from all
claims, suits, judgments or damages including court cosi
and attorney's fees arising out of intentional acts,
negligence or omissions by the Agency in its supervision
of inmates pursuant to this Agreement. If agency is an
agency or subdivision of the State of Florida, this
paragraph shall not be interpreted as altering the
state's waiver of immunity in tort pursuant to Section
766.28, Florida Statutes, or to otherwise impose
liability on Agency for which it would not othetwise by
law be responsible.
X13.
*This agency requente the use of a work squad three times
a week or on an as needed basis.
III.
The Department or the Agency may suspend this agreement or
terminate this agreement with immediate notice, in whole or in
part, when the interests of the Department or Agency requires such
termination.
