HomeMy WebLinkAbout1999-1957/28/99(d eeds\humanesoc)Ow 37 COUNTY DEED INDIAN RIVER COUNTY, FLORIDA THIS DEED, made this 27 day of july , 1999, by INDIAN RIVER COUNTY, FLORIDA, a political subdivision of(the State of Florida, party of the first part (grantor), whose mailing address is 1840 25th Street, Vero Beach, Florida 32960, and HUMANE SOCIETY OF VERO REACH AND INDIAN RIVER COUNTY, INC., a Florida non profit corporation, party of the second part (grantee), whose mailing address is P.O. Box 644, Vero Beach, Florida 32961. WITNESSETH that the said party of the first part, for and in consideration of the sum of Ten Dollars ($10.00) to it in hand paid by the party of the second part, receipt whereof is hereby acknowiedged, has granted, bargained, and sold to the party of the second part, its heirs and assigns forever, the following described lands lying and being in Indian River County, Florida: See Exhibit "A" attached hereto and made a part hereof This conveyance is made on the condition that if grantee or grantee's heirs or assigns fails to use the above-described land for Humane Society activities, then all rights conveyed herein shall revert to the grantor and grantor's heirs and assigns, and grantee, grantee's heirs or assigns shall forfeit all rights thereto. This deed is made and accepted on the condition and understanding that the land hereby conveyed was a former landfill and grantor assumes no responsibility or obligation for the condition of the property now or in the future or for any liability that may attach or be associated with the former landfill. All risk shall vest with grantee or grantee's heirs or assigns. IN WITNESS WHEREOF the said party of the first part has caused these presents to be executed in its name by its Board of County Commissioners, acting by the Chairman of said Board, the day and year aforesaid. LESS the North 30 feet for canal right-of-way. Now lying in Indian River County. 2. "The North 660 feet of the West 10 acres of the East 20 acres of Tract 10, Section 28, Township 32 South, Range 39 East, according to the last general plat of the lands of the Indian River Farms Company recorded in Plat Book 2, Page 25 of the Public Records of St. Lucie County, Florida. LESS the North 30 feet for canal right-of-way. Now lying in Indian River County, Florida. `This is part of an assessed 10 -acre unit, according to the 1999 tax map.
