We have completed construction of the 12" diameter waterline in accordance with
the Developers Agreement with Indian River Cty. Utility Dept. All construction has
been accepted by the Dept. of Utilities Services.
We are requesting payment in the amount of $27,750.00 in accordance with the
agreed upon Developers Agreement.

AN AGREEMENT BETWEEN
INDIAN RIVER COUNTY, FLORIDA
AND
LONE CABBAGE TRADING COMPANY
FOR
WELTON CONVENIENCE STORE
For the construction of off-site utilities
THIS AGREEMENT made this 27th day of J I 11 y , 1999 by and between
INDIAN RIVER COUNTY, a political subdivision of the State of Florida, 1840 25th Street,
Vero Beach, Florida 32960 (County) and Lone Cabbage Trading Company (Developer), 5180
67th Street, Vero Beach, Florida 32967.
WITNESSETH:
WHEREAS, the Developer, in conjunction with the construction of improvements at Welton
Convenience Store is providing water facilities to serve the subject property, and
WHEREAS, the County has required the Developer to provide the utility improvements to serve
the regional area and has agreed to reimburse the Developer for the cost of providing these
off-site utilities.
NOW, THEREFORE, for and in consideration of the premises and other good and valuable
considerable, the County and Developer agree as follows:
Master Planned 12' Diameter Water Main Construction
A. The Developer shall construct the necessary off-site utilities described
herein, per the Indian River County Utilities Department, The County shall
reimburse the Developer for over -sizing of the off-site utilities as outlined below:

Construction of a 12 inch PVC Water Main from the east side of U.S. 1
to the developer's property along the north side of 53rd Street to the east
right-of-way line of Old Dixie Highway for a total of 440 linear feet (see
attached Exhibit A).
The County shall reimburse Developer based on an itemized invoice of
installed materials on a complete basis at the time the above referenced
facilities are dedicated to and accepted by the County. Reimbursements
shall be in the form of a check from the County, and shall not exceed the
total amount of $27,750.00 (see attached Exhibit B).
2. The Developer agrees to complete a final set of construction drawings and submit a
utilities construction permit to the Indian River County Utilities Department and
Florida Department of Environmental Protection. Prior to construction, all permits
must be approved.
3. The Developer agrees to convey all rigbte title, and interest in the aforementioned
force main to Indian River County, Florida, and provide a one-year, 25% maintenance
bond to cover the one-year period after final payment by the County.
4. The Developer agrees to diligently seek all required permitting, construction, and
dedication of the facilities referred to herein, it being understood that timeiof the
essence.
5. The Indian River County Department of Utility Services shall review and approve bid
proposals and engineering costs related with the work described herein. At least (3)
bid estimates from qualified contractors must be submitted to the Department of Utility
Services for review. Approval of project costs will be a condition of the Utility
Department's reimbursement for construction. Furthermore, no work shall commence
until the Utility Department provides written approval of the final construction cost.
6. Developer agrees to ensure that the selected Contractor for the project provides
„aucc cwcrage in accordance with indian River County Utilities Department
requirements. In addition, Indian River County will be names as additional insured.
