Chandler, County Administrator FROM: Doug Wright, Director ,� Emergency Services DATE: August 4, 1999 SUBJECT: Termination of Tower Space Lease Agreement with PrimeCo Personal Communications On July 28, 1997, the Board of County Commissioners approved three Tower and Ground Space Lease Co -Location Agreements with PrimeCo Personal Communications at three different locations, one of which was the Hobart Tower. On March 31, 1998, after PrimeCo had a study and survey completed on Hobart Tower (405'), they determined the tower was insufficient for their needs and the Board approved an amendment to the Tower Space Lease which provided for the company to replace the 150' tower (Hobart #2) adjacent to Hobart Tower for certain consideration. The Board also approved on July 14, 1998, a Modification of Memorandum of Tower Space Lease, which correctly and specifically reflected the legal description of the access easement, lease parcel, and utility easement for the site. On July 16, 1999, staff received a letter dated July 14, 1999, from PrimeCo advising the site had become unsuitable for their operations due to changes in network design. Pursuant to Paragraph 6(E) of the lease agreement, the Company has provided the required written notice to the County that they are terminating the Lease. RECOMMENDATION: Staff recommends Board approval of the PrimeCo Tower and Ground Space Lease termination as relates to the Hobart #2 site effective September 14, 1999.
