Tuesday, July 9, 1996
The Board of County Commissioners of Indian River County,
Florida, met in County Commission Chambers, 1840 25th Street, Vero
Beach, Florida, on Tuesday, July 9, 1996, at 9:00 a.m. Present
were Carolyn K. Eggert, Vice Chairman; Richard N. Bird; Kenneth R.
Macht; and John W. Tippin. Vice Chairman Eggert announced that
Chairman Fran B. Adams was in Tallahassee appearing before the
Cabinet on County business. Also present were James E. Chandler,
County Administrator; Charles P. Vitunac, County Attorney; and
Patricia Ridgely, Deputy Clerk.
The Chairman called the meeting to order, and Commissioner
Macht led the Pledge of Allegiance to the Flag.
ADDITIONS TO THE AGENDATMERGENCY ITEMS
Vice Chairman Eggert requested the addition of the following:
• Item 8., report on Hurricane "Bertha" and discussion of
a resolution.
• Item 13.B.1., Appointment to Building Code Board of
Adjustment.
• Item 13.B.2., Council on Aging request for support.
ON MOTION by Commissioner Bird, SECONDED by
Commissioner Tippin, the Board unanimously
added the above items to the Agenda.
APPROVAL OF MINUTES
The Vice Chairman asked if there were any additions or
corrections to the Minutes of the Regular Meeting of June 11, 1996,
and the Special Meeting of June 13, 1996. There were none.
ON MOTION by Commissioner Bird, SECONDED by
Commissioner Tippin, the Board approved the
Minutes of the Regular Meeting of June 11,
1996, and Special Meeting of June 13, 1996, as
written.

Sandpoint West Phase II (SD -94-05-04)
It is requested that the data herein presented be given formal
consideration by the Board -of County Commissioners at its regular
meeting of July 9, 1996.
DESCRIPTION AND CONDITIONS:
Sandpoint West Phase II is a 4 lot subdivision of a 2.42 acre
parcel of land located on south SR A -1-A between Sandpoint West
Subdivision and St. Edwards Upper School. The subject property is
zoned RS -3, Residential Single Family District (up to 3 units per
acre) and has a land use designation of L-1, Low -Density 1 (up to
3 units per acre). The density for the subdivision is 1.6 units
per acre.
On March 24, 1994, the Planning and Zoning Commission granted
preliminary plat approval for .Sandpoint West Subdivision. The
developer has subsequently obtained a land development permit and
has completed construction of most of the subdivision improvements.

The developer is now requesting final plat approval and has
submitted the following:
1. A final plat in conformance with a portion of the approved
preliminary plat.
2. A contract for construction for remaining required
improvements.
3. An engineer's certified costestimate.
4. Financial security acceptable to the county attorney's office.
.ANALYSIS:
All required subdivision improvements have been completed by the
developer with the exception of some minor improvements and a
double frontage buffer along West Sandpoint Lane. This buffer was
a condition of preliminary plat approval (see attachment #3).
Consistent with the preliminary plat approval condition, a buffer
has been constructed along West Sandpoint Lane by St. Edwards.
This buffer can satisfy the developer's requirement for the double
frontage buffer, provided the developer can document the legal
ability to guarantee maintenance of the buffer.
It- is anticipated that, prior to the July 9th Board of County
Commissioners meeting, the developer will secure a landscape
easement over the existing buffer, which will satisfy the
preliminary plat condition. It is staff's understanding from
conversations with the parties involved: that the provision of the
landscape easement will result in additional plantings in the berm.
The easement will be dedicated to the Sandpoint Property Owners
Association and will provide the right but not the obligation to
maintain the buffer. The buffer will be maintained by St. Edwards.
An engineer's certified cost estimate for completion of the
remaining improvements has been reviewed and approved by the public
works department. Besides the cost estimate, the developer has
submitted a Contract for Construction of Required Improvements and
posted suitable security, approved by the county attorney's office,
to guarantee the contract. The contract, which is on a standard
form approved by the county attorney's office, is to be executed by
the developer prior to the July 9, 1996 Board meeting date.
RECOMMENDATION:
Given the above analysis, staff recommends that the Board of County
Commissioners grant final plat approval for Sandpoint Phase II
Subdivision and authorize the Chairman of the Board of County
Commissioners to sign the contract for construction.
In response to Vice Chairman Eggert's inquiry, Community
Development Director Bob Keating advised that the condition had
been satisfied and the item could remain on the Consent Agenda.
ON MOTION by Commissioner Bird, SECONDED by
Commissioner Tippin, the Board unanimously approved
Sandpointe West L.C.'s request for final plat
approval for Sandpointe West Phase II, as
recommended in the memorandum.

REPORT ON HURRICANE "BERTHA"
Emergency Services Director Doug Wright reported that at 11
p.m. last night "Bertha" took a northwest turn. He advised the
healthy category 3 storm was approximately 1,840 miles south of
Vero Beach, with sustained winds at 115 mph, gusting to 138 mph,
and was moving at approximately 17 mph to the northwest. The
National Hurricane Center forecasted the storm to be about 250
miles east of the Treasure Coast by tomorrow afternoon. He
emphasized that our area is still not out -of -the -woods and people
must remain vigilant. There will be beach erosion, rough seas and
severe rip currents. He explained current weather influences on
the storm and where it could make landfall. While he had a high
confidence in the forecast that the storm would continue on a
northwesterly course, a margin of error does exist. Staff will
continue to monitor the storm; there is a possibility of a tropical
storm watch being issued for some east coast counties of Florida
this afternoon or evening.
Director Wright suggested the Board consider authorizing a
resolution, as a precautionary measure, declaring a state of local
emergency if something should change during the night when it is
difficult to get the Board together.
Vice Chairman Eggert stressed she would like to have the Board
give her permission to sign the resolution should the need arise.
County Attorney Vitunac advised the proposed resolution was
the same as was passed last year for Hurricane "Erin".

STATE OF LOCAL EMERGENCY
WHEREAS, the National Hurricane Center recognizes the danger
to coastal residents of Florida from Hurricane Bertha, by
posting a hurricane from

WHEREAS, Indian River County has high evacuation times to
evacuate residents from the hazards of a hurricane; and
WHEREAS, the current forecast error of the National Hurricane
Center does not allow for a confident prediction of the track
of Hurricane Bertha at that point in time, coinciding with
Indian River County's high evacuation times; and
WHEREAS, Hurricane Bertha has the potential for causing
extensive damage to public utilities, public buildings, public
communication systems, public streets and roads, public
drainage systems, commercial and residential buildings and
areas; and

WHEREAS, Section 252.38(3), Florida Statutes, provides
authority for a political subdivision such as Indian River
County to declare a State of Local Emergency and to waive the
procedures and formalities otherwise required of political
subdivisions by law pertaining to:
1. Performance of public work and taking whatever
action is necessary to ensure the health, safety,
and welfare of the community.
2. Entering into contracts.
3. Incurring obligations.
4. Employment of permanent and temporary workers.
5. Utilization of volunteer workers.
6. Rental of equipment.
7. Acquisition and distribution, with or without
compensation of supplies, materials and facilities.
8. Appropriation and expenditure of public funds.
NOW THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Indian River County, Florida, this 9th day of
July 1996, that:
1. Hurricane Bertha poses a serious threat to the
lives and property of residents of Indian River
County and that a State of Local Emergency shall be
declared, effective immediately, for all of Indian
River County, including, all unincorporated and
incorporated areas.

The attached ordinance is required under state law for a county to levy
special assessments within a municipality.
This ordinance would allow the County to levy assessments for water
and sewer line extensions within the City of Sebastian. The City has
adopted an ordinance approving of such a district.
Recommendation: Staff recommends adoption of this ordinance so that
utility services can be provided. by assessment to the City of Sebastian.
Vice Chairman Eggert opened the public hearing and asked if
anyone wished to be heard in this matter. There being none, she
closed the public hearing.
ON MOTION by Commissioner Macht, SECONDED by
Commissioner Tippin, the Board unanimously adopted
Ordinance No. 96-13 creating a municipal services
benefit unit for the City of Sebastian; authorizing
the levy of special assessments to fund water and
sewer line extensions.
ORDINANCE NO. 96- 13
AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA,
CREATING A MUNICIPAL SERVICES BENEFIT UNIT FOR
THE CITY OF SEBASTIAN; AUTHORIZING THE LEVY OF
SPECIAL ASSESSMENTS TO FUND WATER AND SEWER

WHEREAS, by interlocal agreement between the City of Sebastian and Indian
River County, the Indian River County Department of Utility Services is
authorized to provide water and sewer services to the City of -Sebastian; and
WHEREAS, as part of that interlocal agreement, the City and County
agreed that certain areas of the City would be provided water and sewer line
extensions to be paid for by special assessment against the benefited
properties; and -
WHEREAS, the agreement indicated that if the City chose not to hold
these special assessment hearings itself that the City would authorize the
County to hold such hearings; and

WHEREAS, the City has indicated that it does not wish to hold these
special assessment hearings itself; and
WHEREAS, Section 125.01.1(q), Florida Statutes, authorizes counties to
create municipal services taxing or benefit units for any part of the -unin-
corporated area of the county and any part or all of the municipality if the
governing body of the municipality gives consent by ordinance either annually
or for a term of years; and
WHEREAS, the City has adopted such an ordinance; and
WHEREAS, the creation of such an MSBU is required to empower the County
to assess the costs of the necessary water and sewer works within the City
boundaries;
NOW,- THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS
OF INDIAN RIVER COUNTY, FLORIDA, that:
SECTION 1. SHORT TITLE
This ordinance shall be known and may be cited as the "Sebastian Area
MSBU Water and Sewer Line Extension Ordinance."
SECTION 2. CREATION OF MSBU AND GOVERNING BODY
Pursuant to the authority of Section 125.01(1)(q), F.S., there is hereby
created a Municipal Services Benefit Unit composed of all property within the
City of Sebastian. The governing body of the MSBU shall be the Board of
County Commissioners.
SECTION 3. PURPOSE OF MSBU
.The MSBU shall have the power to assess specially benefited property for
the cost of water and sewer line extensions, through which water and sewer
service will be provided by the Indian River County Department of Utility
Services. The assessments shall be handled as provided by County ordinance.
The MSBU shall not have the power to levy ad valorem taxes.
SECTION 4. SEVERABILITY
The provisions of this ordinance are intended to be severable. . If any
one or more sections, paragraphs, sentences, clauses or provisions shall be
held to be illegal or invalid, the remaining sections, sentences, clauses and
provisions of this ordinance shall nevertheless stand and be construed as if
the illegal or _invalid sections, sentences, clauses or provisions had not
been included herein. -
SECTION S. EFFECTIVE DATE
A certified copy of this ordinance, as enacted, shall be filled by the
Clerk with the Office of the Secretary of State of the State of Florida
within 10 days after enactment, and this ordinance shall take effect upon
such filing.

DESCRIPTION AND CONDITIONS:
The structures described in the attached detail have been condemned and ordered
repaired or removed. Said structures have been inspected by staff, and are considered
unsafe and detrimental to the health, safety, and welfare of the general public.

As per county code requirements, the owners of the properties were issued notices to
repair or remove the structures, and advised of their right to appeal the condemnation
order before the Indian River County Building Code Board of Adjustments and Appeals.
In addition, condemnation cards were posted on the properties. Because staff could not
obtain legal service for the condemnation notice on the property owned by Curtis Lee
Brown, Sr. (#2 on attached list), and property -owned by Eddie R. Jordan (#7 on
attached list) , a public notice was posted at the Indian River County Courthouse.
ANALYSIS:
The subject structures have been vacant for a considerable time. During that time, the
buildings have continued to deteriorate and have been frequented by vandals and
transients. Not only have the owners failed to maintain the structures in compliance with
the Minimum Standard Codes, they have failed to bring the structures into compliance as
required by posted notice. Since the owners have not filed an appeal to the condemnation
order, the county may now proceed with demolition of the structures.
RECOMMENDATION:
Staff recommends that the Board of County Commissioners declare said structures a
nuisance, and order the buildings demolished with related debris removed from the
property. This would be done by awarding a contract to a private company selected
through standard procurement practices.
Staff further recommends that the Board adopt the attached resolution authorizing the
Building Official to report the county's demolition and debris removal cost for each
structure to the county attorney for the preparation and recording of a lien to be placed
on the real property of the owner of each demolished unsafe structure for the purpose
of recovering the county's costs.
Director Rymer offered to explain each building individually,
whereupon Vice Chairman Eggert asked if there was anyone present to
challenge action on any of the structures. There was no response.
Commissioner Macht inquired if there was an environmental
assessment on any of the properties, and Director Rymer replied
they were all single family homes.
Commissioner Macht asked if there was any history of possible
environmental problems, and Director Rymer responded she was not
aware of any.
MOTION WAS MADE by Commissioner Bird, SECONDED by
Commissioner Tippin, to adopt Resolution No. 96-76
providing for demolition of unsafe structures and
recovery of costs on properties set forth on
Addendum "A", as recommended by staff.
Under discussion, Commissioner Bird voiced concern about
removal of LP gas tanks, and Director Rymer advised that tanks
would be disconnected by the gas company and removed.
THE CHAIRMAN CALLED THE QUESTION and the motion
carried unanimously.

RESOLUTION NO. 96- 76
A RESOLUTION OF THE BOARD OF COUNTY' CoMaSSIONERS OF
INDIAN RIVER COUNTY, FLORIDA, PROVIDING FOR THE
DEMOLITION OF 13NSAFE STRUCTURES AND THE RECOVERY OF
COSTS.
AREAS, Indian River County has adopted the Standard Unsafe
Buildings Abatement Code (SUBAC), 1985 Edition (at Section 401.01, Indian
River County Code); and
WBEREAS, Section 701 of the Standard Unsafe Buildings Abatement
Code provides for the recovery of the costs of repairs to and/or demolitions
of unsafe structures by policies and procedures established by the local
governing body; and
WBMU AS, Section 100.080 of the Indain River County Code provides
that the Board of County Commissioners may cause, by resolution, a lien to be
filed in the Official Record Books of the County against the owner of
property or person responsible for compliance with the Code for the costs
incurred by the County; and
SEAS, pursuant to Chapter 162, F.S., notice of intent to adopt a
lien resolution has been given to the proposed lienee,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY CONNISSIONERS
OF IRIDIAN RIVER COUNTY, FLORIDA, that the unsafe structures on the properties
described on the attached Addendum "A" be demolished; and that any costs
incurred by County government as a result of such demolition undertaken at
the direction of the Board of County Commissioners shall be recovered from
the owner of the property upon which each unsafe structure is located, as
identified in the attached Addendum "A". The costs of such demolition shall
be reported to the Building Director who shall notify the County Attorney's
Office to prepare lien(s) for the recovery of those costs, to be placed upon
the real property of the owners of the unsafe structures as listed in the
attached Addendum "A", any such liens bearing interest at the rate of ten
percent (10%) per annum from the date the lien is recorded in the Public
Records of Indian River County, Florida, until such time as the lien,
including interest, is paid.

BACKGROUND:
Following is a summary of each policy requiring revision.
Revisions _are indicated by crossing through deletions and
underlining added wording. In addition two new policies are
submitted for Board approval.
Outside Employment. AM -209.1
The County Attorney's office is recommending revision of this
policy based on an employee's constitutional right to seek
employment as held by the Florida Supreme Court.
Temporary. Part -Time. and Student Employees AM -210.1
Wording is added to this policy to explain employee category of
"student". Students are temporary employees of the county, but may
work of longer duration than the maximum six months of a temporary
employee.
Payroll/Salary Administration AM -301.1
Revisions are proposed to indicate the new method of reporting in
the payroll documents Temporary Assignment pay and Standby and Crew
Leader pay.
Overtime and Compensatory Time AM -301.3
Wording is changed to reflect policy as approved by Board effective
October 1, 1995.

Workplace Violence. AM -905.1
Events occurring around the Country and in our own state indicate
the need -for this policy.
Use of Grant Funds, AM -906.1
During the County's annual audit, it was recommended by the
Auditors that the County have a written policy concerning the
expenditure of grant funds for political purposes. The County
Attorney's office proposes this wording.
Vehicle Guidelines. AM -1000.7
Wording is deleted so policy is in compliance with Fair Labor
Standards Act.
Incident/Accident Reporting. AM -1000.10
Authorization form is being revised to agree with policy as
approved by Board effective October 1, 1995.
RECOMMENDATION:
Staff recommends that the Board of County Commissioners approve the
new and revised policies to the Administrative Policy Manual.
Personnel Director Ron Baker advised that the revisions are
administrative changes to bring the policy manual into compliance
with either Commission actions or Federal law, and as recommended
by the County Attorney's•office.
Administrator Chandler pointed out that on page 37 (page 2 of
2, second paragraph, on subject of Workplace Violence) wherever the
word "search" is used, the appropriate form of "inspect" will be
substituted.
Director Baker specified that County Attorney Vitunac had
suggested the change, and Vice Chairman Eggert remarked it sounded
less threatening.
Commissioner Bird pointed out that there has to be reason for
an inspection, and Director Baker agreed, adding that it must be
conducted by a sworn police officer.

Staff recommends that the final payment be released. Funding is from Account

Public Works Director Jim Davis advised that the construction
sign has been removed and a permanent sign will be installed.
Commissioner Tippin remarked that it is a very nice facility.

Professional Expenses
58th Avenue Improvements

DESCRIPTION ,AND CONDITIONS
The Indian River Farms Water Control District (IRFWCD) has adopted
a policy to bill professional and administrative expenses to cover
the District's in-house and overhead permitting costs that are over
and above permit fees.
At the County's request, the IRFWCD has provided the County with
copies of their contracts and fee schedules for Engineering and
Legal Services. (see attachment)
The attached invoices are for expenses incurred by the District for
Improvements on 58th Avenue from Oslo Road to north of 26th Street. .
The first invoice in the amount of $4,613.75 is for expenses from
June 22, 1995 through March 25 1996. The second invoice in the
amount of $47.50 is from April 1 1996 to April 30, 1996. The
District intends to continue Lillin for professional and
administrative expenses for 58th Avenue �rovements on a monthly
basis.
REQMNENDATIONS AND FUNDING
Staff recommends that the Board approve payment of the attached
invoices totaling $4,661.25. Staff also recommends that the Board
authorize payment of all future invoices from IRFWCD for 58th
Avenue Improvements.
Funding is from Account 101-158-541-067.30.
Commissioner Macht observed that, although a small matter,
this is an example of a tax -funded government entity shifting costs
(ultimately paid by the taxpayer) which does not demonstrate an
accountable representation to the taxpayer.
Commissioner Bird understood Commissioner Macht's point, but
thought, in this instance, that the charges were incurred because
of the County's project and need for IRFWCD's cooperation.
Commissioner Tippin described the project as unusual in size
and complexity and suggested preplanning with IRFWCD if the County
does a similar project in the future.
ON MOTION by Commissioner Tippin, SECONDED by
Commissioner Macht, the Board unanimously approved
payment in the amount of $4,661.25 to Indian River
Farms Water Control District (IRFWCD) and authorized
payment of all future invoices from IRFWCD for the
58th Avenue improvements, as recommended in the
memorandum.

DESCRIPTION AND CONDITIONS
Additional right-of-way is required on 4th Street for the paving
and widening improvements.
The property owner has executed a contract at the appraised value
of $3.75 per squre foot. The contract price is $22,570.00 for the
C -H zoned land.
The appraised value of neighboring properties range from $2.95 to
$3.75 per square foot. The county has purchased several other
properties on this project at $2.95 and at $3.75 per square foot.
RECOMMENDATION
Staff review appears that the contract is equitable and requests
the Board of County Commissioners approve the $22,570.00 purchase
and authorize the Chairman to execute the contract.

4th Street, Parcels #109 and #110 - Funding to be from District 6
Traffic Impact Fee Account No. 101-156-541-067.29.
Director Davis reported the County will probably need four or
five more parcels in order to accomplish the 5-laning of 4th Street
from just west of Old Dixie Highway to US -1. He specified that
staff negotiated the purchase of these two parcels in an arms -
length manner. He estimated the right-of-way on the north side of
the street would be widened about 15 feet, and mentioned the County
also will be acquiring right-of-way on the south side of the street
in the future.
ON MOTION by Commissioner Bird, SECONDED by
Commissioner Tippin, the Board unanimously approved
the $22,570 purchase of Parcels #109 and #110 from
Julian H. and Betty J. Washburn, as recommended by
staff.

The County property affected is surplus right-of-way acquired for Indian River
Boulevard. 'No adverse impacts are foreseen. If the County has to use the
property for future expansion of Indian River Boulevard, the count clut3 would

APPOINTMENT TO THE BUILDING CODE BOARD OF ADJUSTMENT

Subject: Appointment to Building Code Board of Adjustment
The Press Journal ran an item in their newspaper at my request asking for
resume's from Contractors interested in serving on the Building Code Board
of Adjustment. The attached resume's were submitted.
It is requested that the Board review the resume's and, if it is your desire to do
so, appoint one of the applicant's to the Building Code Board of Adjustment.
Chairman Eggert advised resumes were received from George R.
Childers and Frank M. "Pete" Clements for consideration. There is
one vacant seat.
Commissioner Tippin advised he knew both gentlemen and was
pleased to have this caliber of people willing to serve.
NOMINATION WAS MADE by Commissioner Tippin, SECONDED
BY Commissioner Bird, to appoint Frank M. "Pete"
Clements to the Building Code Board of Adjustment.
In seconding, Commissioner Bird agreed with Commissioner
Tippin's remarks and emphasized that if there is a future opening
on that board, that Mr. Childers be given an opportunity to serve.
THE CHAIRMAN CALLED THE QUESTION and the motion
carried unanimously.
COUNCIL ON AGING - LETTER OF SUPPORT - TITLE MB
Commissioner Eggert explained that the Council on Aging wanted
to apply for Title IIIB Federal funding as they do every 3 years,
and they have requested a letter of support for the various
programs. Commissioner Eggert requested permission to provide them
with a letter of support from the Board.

Commissioner Bird, the Board unanimously approved a
letter of support for Indian River County Council on
Aging concerning their Title IIIB application, as
requested.
EMERGENCY SERVICES DISTRICT
Vice Chairman Eggert announced that immediately upon
adjournment, the Board would reconvene sitting as the Commissioners
of the Emergency Services District.
Those Minutes are being prepared separately.
There being no further business, on Motion duly made, seconded
