C THIS AGREEMENT, made this 21st Day of S e p t e qi U @ r 9 9, by and between INDIAN RIVER
COUNTY, a political subdivision of the State of Florida hereinafter known as the "COUNTY", and HARBOR
STORAGE, LTD, located at 5697 US Highway # 1, Vero Beach, Florida, hereinafter known as the "OWNER".

WHEREAS the OWNERS desire to have temporary water service made available to the property located..

in Indian River County, Florida (See "EXHIBIT A"), from a new connection to an extension of an already existing watetty
line, (the "Temporary Expedited Line"), before the COUNTY is ready to construct a new water line, (the "Specia -"
Assessment" line). Said new line to be paid for by special assessment of the OWNER'S property, as well as other

properties in the Special Assessment Project, and
WHEREAS the COUNTY requires the OWNERS, at the time of the installation of the Temporary
Expedited Connection, to pay certain fees immediately, and to participate in certain costs of the Special Assessment Line
when the COUNTY undertakes the Special Assessment Project.
NOW THEREFORE, for and in consideration of mutual covenants contained herein, the receipt of which
is acknowledged, COUNTY and OWNERS a. -Cc as follows:
1. Upon signing this Agreement, the OWNERs shall pay the following amount,
per Equivalent Residential Unit, (ERU's):
(6 ERU's) - Capacity Charges .....................$ 7,800.00
Inspection Fee ........................ 25.00
Security Deposit ...................... 300.00
Recording Fee ......................... 24.00
Meter Fee .............................. 130.00
TOTAL ............................... .$ 8,279.00
The OWNER agrees to extend water service from the EAST side US I, to the site located along the WEST
Side of US I. The OWNER agrees to bear any costs associated with construction , and shall be responsible for all
Permitting associated with construction.
r 5 The COUNTY shall connect the OWNER'S property to a Temporary Expedited Connection point of

theCOUNTY'S choosing. When service is available from the Special Assessment Line, the OWNERS may be required to
disconnect fiom the Temporary Expedited Connection, and reconnect to the Special Assessment Line. Any such U0
reconnection would be at the expense of the OWNERS, with the exception that the OWNERS would not be required to -0

pay the Capacity Charge, Security Deposit, or Meter Fee, again. M

2. Whether the OWNER is required to reconnect to the Special Assessment Line, or remain —
connected to the Temporary Expedited Connection, the OWNERS shall participate in the cost of the Special Assessment

Project for line extension charges, and other costs as related to the assessment. By accepting the Temporary Expedited
Connection, the OWNERS waive any right to contest the Receipt of Special Benefit from the Special Assessment Project.
In addition, the OWNER'S signatures of this Agreement shall be considered to be an affirmative vote for construction of
the Special Assessment Line.l
