This AMENDMENT by and between the Florida Department of Environmental
Protection thereinafter referred to as the "DEPARTMENT") and Indian River
County (hereinafter referred to as the "LOCAL SPONSOR"), serves to amend
that Project Agreement between the DKPARTMFNT and LOCAL SPONSOR dated August
28, 1998, as amended April 12, 1999, pertaining to the AmbersandiWabasso
Beach Restoration Project thereinafter referred to as the "PROJECT").
The DEPAR'Td4ENT and LOCAL SPONSOR hereby agree to the following changes
and additions:
Paragraph 5 of the PROJECT Agreement is herezy revised to read as
follows:
5. The DEPARTMENT and LOCAL SPONSOR agree that the estimated costs
of the project are:

Paragraph 6 of the PROJECT Agreement is .hereby revised to read as
follows;
6. The DEPARTMENT,s financial obligation shall not exceed the sum
of $1.20,855, or 75% of the total cost, whichever is less, for Task 3 of this
PROJECT. The DEPAR'TMENT'S financial obligation shall not exceed the sum of
$413,738, or 50% of the total cost, whichever is less, for the remainder of
the specific eligible PROJECT items listed above. The DEPARTMENT and the
LOCAL, SPONSOR agree that any and all activities associated with the PROJECT
that are not shown in the above eligible PROJECT items list are the
responsibility of the LOCAL SPONSOR and are not a Part of this Agreement.
The LOCAL SPONSOR agrees that any costs for the specific eligible PROJECT
items which exceed the estimated PROJECT costs for that item shall be the
responsibility of the LOCAL SPONSOR. Any modifications to the estimated
PROJECT costs shall be provided through amendments to this Agreement.

Paragraph 7 of the PROJECT Agreement is hereby revised to read as
follows:
7. The State of Florida's performance and obligation to pay under
this Agreement is contingent upon an annual appropriation by the
Legislature. Funding for this PROJECT is subject to the release of funds
appropriated to the DEPARTMENT for the fiscal years 1997-1998,1998-1999 and
1999-2000.
Paragraph 13 of the PROJECT Agreement is hereby revised to read as
follows:
13. 'Phis Agreement shall begin on August 28, 1998 and end on October
15, 2001,
Paragraph 17 of the PROJECT Agreement is hereby revised to read as
follows:
17. The DEPARTMENT,s Project Manager is Russell Snyder, or his
successor.
Exhibit A, Scope of Work; Exhibit B, Payment Request forms: and
Exhibit t, Progress and Financial Reporting Forms, are hereby revised as
attached.
All. other terms and conditions of that PROJECT Agreement dated August
28, 1998, as amended April 12, 1999, remain the same.

SCOPIC OF WORK
The AmbersandMabasso Reach Restoration Project shall be conducted in
accordance with the terms and conditions set forth under DEP Contract No.
98IR1, and will consist of the tasks described below. Indian River County
shall develop a detailed Scope of Work for each project: task. Written
authorization to initiate each task must be obtained from the Department of
Environmental Protection prior to the initiation of each task.
Feasibility Study
Conduct studies necessary to determine the feasibility of
implementing one or more beach restoration projects along the
critically eroding Atlantic ]leaches located in northern Indian
River County. Investigations shall include the following.
1.1 Environmental Assessment
Conduct environmental analyses of the project area located
between FDEP reference monuments R-1 and R-45, and between
R-1414 and R-107. The assessment shall identify potential
impacts to hardbottom and protected species habitat.
1.2 Sand Search Investigation
Conduct a sand search investigation to identify suitable
material for future beach restoration projects located in
Indian River County. The study shall encompass the entire
county and include the following; geological investigation,
sub -bottom mapping, sediment identification, core sampling
and sediment analysis, and geotechnical report.
1.3 Pre -engineering Design
Baser] on environmental and economic analyses, conduct
preliminary engineering design of potential beach
restoration projects.
II. Design and Permitting
Professional services required to facilitate acquisition or
modification of environmental permits necessary for the
construction of the project. Included in this item is the
establishment of an erosion control line.
III. Habitat Conservation Plan for Sea Turtle Protection
Pursuant to the interim Agreement and Memorandum of Agreement
between Indian River County and the State of Florida,conduct a
complete review of all existing documentation related to this
project; develop a Habitat Conservation Plan for sea turtle
protection within the Project limits; provide all NEPA-required
information required by the National Environmental Policy Act and
apply for an incidental take permit pursuant to Section 10 of the
Endangered Species Act from the U.S. Fish and Wildlife Service.

Project Deliverables
A. Reports - Unless otherwise noted above, two copies of all written
reports developed under this Agreement shall be forwarded to the
Department upon completion of the project.
B. Additional. Data - Two sets of all data (i.e., aerial photography,
survey data, etc.) developed as a result of this Agreement shall
be provided to the Department upon completion of the project.
Schedules- Project schedules shall be submitted concurrently with
quarterly progress reports and shall be provided in .MPP or tab
delimited .TXT format. Information provided shall be the best
available and shall represent the most accurate forecast of
future events. Specific information to be included: tasks to be
completed, start and finish dates, task duration, actual start.

Data Development
All data developed as a result of this Agreement shall be developed in
accordance with standard formats acceptable to the Department.
Survey work to be performed shall meet the minimum technical standards
for surveys in accordance with Chapter 61G-17, Florida Administrative
Code. All monumentation set or points of origin established shall be
based upon those control markers designated on the most recently
recorded lege l description of the Coastal Construction Control Line,
except that any First or Second Order federal or state horizontal
control marker may be used to establish or confirm position and
direction and any First, Second, or Third Order federal or state
vertical control marker shall be used to establish or confirm
elevation. G.P.S., 'Traverse, and Level Loop information shall be
adjusted by Compass, Crandell, or Least Square Method. Detailed field
notes and computation records shall be kept of the survey and copies
shall be made available to the Department upon request. Abstracts of
all monumentation or points of origin shall be submitted in digital
form and contain at a minimum all field requirements for the
Department's Monument Information Tracking System. All profile data
shall be submitted in digital form and conform to the standard formats
acceptable to the Department.
All information submitted shall also be in electronic format, and
shall be based on thy:+ 1983/1990 North American Datum and State Plane
Coordinate system. This information shall be submitted in a .DXF
format.
