BUTLER, CLERK RELEASE OF PERPETUAL BEACH MANAGEMENT AND ASSESSMENT EASEMENT WHEREAS, this Release of Perpetual Beach Management and Assessment Easement between Indian River County, a political subdivision of the State of Florida, whose mailing address is 1801 27th Street, Vero Beach, Florida 32960 (hereinafter "County"), and ITC Properties, LLC, a Florida Limited Liability Company, whose mailing address is 6050 SW 1141h Street, Miami, FL 33156, (hereinafter "Property Owner") agree as follows: WHEREAS, the County received from the Property Owner a Perpetual Beach Management and Assessment Easement (hereinafter "Easement") dated July 7, 2020; and WHEREAS, the Property Owner has requested that the County release the Easement that was granted for the purpose of beach renourishment on the Property Owner's property; and WHEREAS, there were no beach renourishment activities that took place on the Property Owner's property, nor are there any future renourishment projects planned as of the date of signing of this document. The County has determined that the retention of the easements serves no public purpose. NOW, THEREFORE, Indian River County does hereby release and abandon any rights or grants given to it pursuant to the Perpetual Beach Management and Assessment Easement that is recorded at O.R. Book 3323, Page 1361, Public Records of Indian River County, and is more particularly described on Exhibit "A" attached hereto.
