IQ TO THE PROFESSIONAL E �wii:i iii nND ,' G T ii`Ih SERVICES AGREEMENT BETWEEN KIMLEY-HORN AND ASSOCIATES, INC. AND INDIAN RIVER COUNTY, FLORIDA. This is an amendment to the existing Engineering/Land Surveying Services Agreement (AGREEMENT) dated November 1, 1994, between Kimley-Horn and Associates, Inc. (ENGINEER) and Indian River County (COUNTY). This amendment addresses changes in "Section I - Project Limits and Description" and "Section V - Compensation", of the AGREEMENT. Amendment Description This Amendment includes the following: "Section 1 - Project Limits and Description" is being modified to incorporate the following: 1) Modification to 8th Street for the Overby Property 2) Designing of a Retaining Wall for the Stough's Property 3) Emmanuel Baptist Church Pond Analysis 4) Overby Pond Design and Plan Modifications 5) Basins C and D Pond Modifications 6) Basin B Pond Modification 7) Side Street Compensating Treatment 8) SJRWMD Permit Modification 9) Force Main Relocations on 1 st and 4th Streets 10) Preparation of 5th Street S.W. Construction Plans 11) Additional Survey 1) The revisions to the plans for 8th Street will include the addition of a westbound left turn - lane into the Overby property. In addition, it will require modification of the typical section, a drainage analysis, the addition of cross-sections, modifications of the striping plan and the addition of drainage structures to the summary sheet. 2) Preparations of retaining wall details for purposes of discussion with the property owner. Pagel of4 3) Emmanuel Baptist Church pond was impacted by the proposed expansion of Kings Highway from a two-lane to a 4 -lane divided roadway. The analysis required evaluating the existing permit for the existing retention pond on the church property, evaluating the impacts from the roadway and performing the hydraulic analysis. This information will be included in the St. Johns River Water Management District Permit Modification. 4) A new pond location has been established on the Overby property. I�lo� ., 1 C ti iv�utivii i� ........., wib.. a„a.j„a v. tuC r�C'rr wi � be performed as well as modification to the proposed storm sewer system in the Kings Highway construction drawings. 5) The two ponds within Basin C and Basin D have been relocated within their respective blocks. This effort includes the design analysis and the revisions to the storm sewer system in the plan/profile sheets and cross sections. 6) The Basin B pond has been reshaped within the property to accommodate a portion of Laurel Homes. This effort includes the design analysis and changes to the construction plans. 7) In an effort to reduce right of way acquisition, analysis was performed to determine if compensating treatment for the side streets could be undertaken outside of the side street locations as previously permitted by St. Johns River Water Management District. This effort included coordination with St. Johns River Water Management District, hydraulic analysis, and modification of the retention ponds to accommodate the additional required treatment volumes. 8) All of the modifications mentioned above have been summarized, compiled and included in a narrative in-depth report to be submitted along with an application for permit modifi ,ation to St. Johns River Water Management District. This will include the preparation of drainage basin schematics, formatted analysis of each basin, description of modifications from original permit, preparation of the permit application and follow up on request for additional information from the District. 9) Construction plans will be prepared for the relocation of a force main on I st Street and 4th Street. These six -incl[ force mains must be kept in service during the construction of the bridge replacements on these respective streets. The utilities have been installed since the original scope of work was contracted. This effort will include coordination with the utility companies, insertion of the existing utilities into the construction plans, preparations of construction plans to include plan view and utility adjustment details. This effort will also include permit applications to FDEP. 10) The proposed development east of the 5th Street intersection with Kings Highway is proposing a bridge crossing over the Lateral "B” Canal. This crossing will require that the structure meet the clearance requirements of the Indian River Farms Water Control District. In order to accommodate this bridge elevation, the intersection must be elevated to a finished grade elevation of the bridge. This effort will include modification of the Kings Highway profile grade line, modifications of inlet locations in the vicinity of the intersection, and the modification of cross sections. Page 2 0174 40 Cts 40 Construction plans will be developed for 5th Street S.W. for construction of a three -lane section at the 58th Avenue intersection. These plan sheets will propose 200 feet of storage and 180 feet of declaration length for the left turn lane. The design will propose 565 feet of transition from the three -lane section to the existing two-lane roadway. A striping plan will also be developed, as well as cross sections every 200 feet. Drainage analysis will be performed and the modification included in the SJRWMD Permit Modification. 11) Additional topographic survey data will be collected for the areas proposed for the new retention pond locations on the Laurel Homes site and the Largo Ray site. Both areas are approximately 1.5 acres in size. Cross-sectioned data and topographic data will be collected along 5th Street S.W. for design of 1000 feet of roadway improvements along 5th St. S.W. i In addition to the above mentioned survey, we will obtain additional topographic data at locations where six cross drain culverts and 2 pond discharge culverts are proposed to oufall into the sublateral located adjacent to the 58th Avenue side streets. "Section V — Compensation" is being revised in response to the Scope modifications. The charges associated with the change in project scope are as follows: I ) Modification to 8th Street for the Overby Property $3,500 2) Designing of a Retaining Wall for the Stough's Property $ 500 3) Emmanuel Baptist Church Pond Analysis $3,000 4) Overby Pond Design and Plan Modifications $4,800 5) Basins C and D Pond Modifications $7,200 6) Basin B Pond Modification $ 800 7) Side Street Compensating Treatment $1,700 8) SJRWMD Permit Modification $6,900 9) Force Main Relocations on I st and 4th Streets $9,300 10) Preparation of 51h Street S.W. Construction Plans $8,200 11) Additional Survey $5,500 Total $51,400 Expenses will be charged at a lump sum of 61/6 of labor cost for a total of $3,084. The section of the original AGREEMENT entitled "Section V - Compensation" shall be revised to include compensation due the ENGINEER in the amount of $54,484. Page 3 of 4 The AGREEMENT is hereby amended as specifically set forth herein. All other sections of the AGREEMENT shall remain in full force and effect, and are incorporated herein. This Amendment No. 10 to the AGREEMENT regardless of where executed, shall be governed by and construed by the laws of the State of Florida.
