PARTIAL RELEASE OF RESERVED RIGHT TO UTILIZE EASEMENTS
This instrument is Heade this 18th day of Apr•i 1 - -_ 2000, by Indian River
County, Florida, a political subdivision of the State of Florida, hereinafter referred to as "County".
WITEREAS, the City of Sebastian, Florida assigned to the County all of its right, title and
interest in and to certain platted utility easements located within Sebastian Highlands, a subdivision,
as set forth in the document titled Assignment of Plat and Other Easements, dated September 29,
1995, and recorded in Official Records Book 1074, Page 140 of the Public Records of Indian River
County, Florida; and
WHEREAS, circumstances have now changed wherein certain of those platted utility
easements are no longer needed by the County, because portions of those plats where said utility
easements are shown are being replatted into acreage and sold to the St. John River Water
Management District for water management purposes. and
WHEREAS, those portions of the Sebastian Highlands plats that are being replatted into
acreage are described in Exhibit "A" attached hereto and by this reference made a part hereof.
WHEREAS, since said portion of Sebastian Highlands plats are being replated into acreage
for the purpose of being sold to the St. Johns River Water Management District, it is no k ager
necessary to retain the right to rewire lot owners to connect to a central water distribution system
or sewer service facilities as required in paragraph 10 of the Declaration of Restrictions for
SEBASTIAN HIGHLANDS, UNIT SIXTEEN, recorded in Official Records Book 389, Page 160
of the Public Records of Indian River County, Florida and paragraph 12 of the Declaration of
Restrictions for SEBASTIAN HIGHLANDS, UNIT SEVENTEEN, recorded ill Oficial Records
Book 389, Page 164 of the Public Records of Indian River County, Florida.
NOW, THEREFORE, by this instrument, Indian River County releases all of its right, title
and interest in and to those certain platted utility easements located on those portions of the plats for
Sebastian Highlands as set forth on Exhibit "A". Leaving in place the remainder of the platted utility
easements described in the Assignment of Plat and Other Easements recorded in Official Records
Book 10714, Page 140, Public Records of Indian River County, Florida. Indian River County also
hereby releases, disclaims and waives any and all right, title and interest Indian River County may
have pursuant to paragraph 10 of the Declaration of Restrictions for SEBASTIAN HIGHLANDS,
UNIT SIXTEEN, and pursuant to paragraph 12 of the Declaration of Restrictions for SEBASTIAN
HIGHLANDS, UNIT SEVENTEEN, recorded in Official Records Book 389, Pages 160 and 164,
respectively, of the Public Records of Indian River County, Florida.
