HomeMy WebLinkAbout2000-15940 4 ZM ' F 4 PROFESSIONAL ENGINEERING AND ARCHITECTURAL SERVICES AGREEMENT FOR JUNGLE TRAIL/PELICAN ISLAND WILDLIFE REFUGE ENHANCEMENT PROJECT TRC PROJECT NO. 9724 THIS AGREEMENT or "CONTRACT", cntcred into this 23rdiay of May 241_, by and between INDIAN RIVER COUNTY, a political subdivision of the State of Florida, hereinafter referred to as the COUNTY, and BRAI3 SMITH ASSOCIA"f ES, INC;., hereinafter referred to as the ARCHITECT, WITNESSETH The COUNTY and the ARCHITECT, in consideration of their mulual covenants, herein agree with respect to (he performance of professional arcliitcclural services by the ARCHITECT and the payment for those services by the COUNTY as set forth below. The ARCHITECT shall provide professional architectLtral, and related services to the COUNTY for the project described as Indian River County Project No. 9724, JUNGLE TRA11JPELICAN ISLAND REFUGE ENHANCEMENT PROJECT— PUBLIC USE I'ACILITIES professional ARCHITECTURAL representative for the project as set forth below and shall give professional architectural consultation and advice to the COUNTY during the perfonnance of the services to be rendered hereunder. SECTION I - PROJECT LIMITS As described in 'Exhibit "A" Scope of Services - Section 1-1).A), SECTION IT - COUNTY OBLIGATIONS The COUNTY agrees to provide the following; material, data, or services as regtrircd in connection with (lie work to be performed under this Agreement: A. B. The COUNTY shall assist the ARCHITECT in making provisions for the ARCHITECT to enter upon public or private property as required for (lie ARCHITECT to perform his services. C. The COUNTY will provide payment directly to permitting agencies for permit applications and promptly execute all permit applications necessary to expedite the acquisition of any local, state or federal permits made necessary by the project. SECTION III - SCOPE Or SERVICES A. Architectural Phase 1. A detailed description of the scope of services is given in Exhibit "A". 2. In order to accomplish the work described under this Agreement in the time frames and conditions set forth in this Agreement, the ARCHITECT will observe the following requirements: a. The ARCHITECT shall strive to complete his work on the project within the time allowed by maintaining an adequate staff of architects and technicians in the required areas of expertise, or having the services of qualified sub -consultants, approved by the COUNTY, on the work at all times. b. The ARCHITECT will comply with all federal, state, and local laws applicable to this project. The ARCHITECT will design the project in such a manner as to be in conformance with all applicable federal, state and local laws. C. The ARCHITECT will prepare necessary sketches and completed application forms to accompany the COUNTY'S applications for any required federal, state, or local permits, during the appropriate design phase of the project. d. The ARCHITECT will cooperate fully with the COUNTY in order that all phases of the work may be properly scheduled and coordinated. e. The ARCHITECT shall send a complete set of plans to all utility providers at each phase of plan development. Also, plans will be sent to every jurisdiction, or agency from which a permit, or approval, of any kind is required. The plans will be sent as directed by the COUNTY and the COUNTY shall reimburse the ARCHITECT for the cost of reproducing \\FILSSERVZR\PUBLIC\8ngineering\ximp\CapitAI Projects\9729 Agreement-Mh4.dac 2 C� C1 0 the plans at the agreed unit cost. The ARCHITECT shall coordinate the design with the jurisdiction, or agency in order to obtain the required permit, or approval. f. The ARCHITECT will identify all utilities having facilities, which could be affected by the project. g. The ARCHITECT shall report the status of this project to the Director of the Public Works Department upon request and hold all drawings, calculations and related work open to the inspection of the Director or his authorized agent at any time, upon reasonable request. 3. The drawings prepared by the ARCHITECT will be of sufficient detail to permit the actual location and construction of the proposed improvements within the project's right- of-way, or property boundaries. 4, The ARCHITECT acknowledges that preparation of ail applicable permits for the COUNTY'S submittal through governmental regulatory agencies are included within the scope of basic compensation as defined by Exhibit "A" Scope of Service. Any additional work required by laws, or regulations established after the date of this Agreement shall be an additional service and the COUNTY shall compensate the ARCHITECT in accordance with Section VI - Additional Work, of this Agreement. SECTION IV » TIME FOR COMPLETION A. The ARCHITECT understands and agrees that TIME IS OF THE ESSENCE and that the time for completion and tine schedule for performance will be governed by Section 2 of EXHIBIT "A" Scope of Services, B. The Services under the construction phase shall run concurrently with construction, beginning with the notice to proceed being issued to the Contractor and ending with issuance of the final payment to the Contractor. C. The ARCHITECT understands that timeliness of performance is a factor which wit] be evaluated in determining the award of future professional services in accord with FS287.055 and that failure to meet the time for completion may disqualify the ARCHITECT from award of future professional services work with the COUNTY. 11€1LSSERVER\PU',)1C\Engineering\Ximp\Capital Frojecta\9724 Agreement -MG, doc 3 CA if SECTION V —COMPENSATION The COUNTY agrees to Pay and the ARCHITECT agrees to accept for services rendered pursuant to this AGREEMENT, Fee Compensation in an amount Lump SUm as established herein, unless authorized as Additional Services, the following: $154,022.00 - ONE HUNDRED FIFTY FOUR THOUSAND TWL'NTY'TWO DOLLARS The compensation above is based on the following conditions and understanding: A. Section on Reimbursable, Travel shall not be compensated unless out of state and pre -approved by the Public Works Department. Cost of Reimbursable expenses is included in Lump Sum contract price. SECTION VI - ADDITIONAL WORK In the event changes are requested by the COUNTY or extra work is imposed on the COUNTY by the demands of certain regulatory agencies ager the approval by the COUNTY of this Agreement, and upon the issuance of a subsequent work order by the Director of Public Works Department, and approved by the Board of County Commissioners, said extra work may commence in accordance with the fee schedule as shown in Section V, Paragraph 1, or a lump sum amount based on that fee schedule, SECTION VII - PARTIAL PAYMENTS The COUNTY shall make periodic partial payments to the ARCHITECT for all authorized work according to the "Schedule of Deliverable Items". Invoices will be submitted on forms furnislied for that purpose by the ARCHITECT to the COUNTY periodically for work products delivered and expenses incurred pursuant to this Agreement. The ARCHITECT shall submit duly certified invoices in duplicate to the Director of tine Public Works Department. The amount of the invoices submitted shall be the amount due for all work delivered to date. The amount of the partial payment due for the work item delivered to date shall be an amount calculated in accordance with the Schedule of Deliverable Items, Exhibit "A" attached hercto, less ten percent (101/6) of the amount thus determined which shall be withhold by the COUNTY, as retainage, and less previous payments. The ten percent (10%) retainage withheld through the design phase, shall he paid in full to the ARCHITECT upon award of a construction contract, but in no case shall the amount be retained longer than four (A) months alter the date of final acceptance of the design phase by the Director of Public Works. Payment of invoices shall be in accordance with the Florida Prompt Payment. Act, FS 218.70 et seg. 1\FILESERYP.h'NPIIALIC\Engineering\Kimp\C!apita1 Frofectd\9724 Agreement-MAC.doa 5 ti i 0 SECTION VIII - INSURANCE AND INDEMNIFICATION During the performance of the work covered by this Agreement, the ARCHITECT shall provide the COUNTY with evidence that the ARCHITECT has obtained and maintains the insurance listed in the Agreement. All insurance policies shall be occurrence form not claims made policies. If an occurrence form is unavailable for a specific coverage, the County Risk Manager may give approval for claims made policy. A. Statutory Workers' Compensation and Employer's Liability are included in the same policy. The standard limit of liability as required by the Florida Worker's Compensation Law shall be insured against. B. Commercial general liability is carried in the amount of 1,000,000.000 combined single limit for bodily injury and property damage. The coverages designed for a general contractor (x.c.u. coverage, broad form property damage, contractor's protective liability) are not included or required by an architectural firm. Contractual liability is included in the policy. C. Commercial automobile insurance for all owned, hired or borrowed vehicles are covered in the amount of $1,000,000 combined single limit and $500,000 uninsured motorists coverage. D. Professional Liability Insurance providing coverage for negligent acts, errors, or omissions committed or alleged to have been committed by ARCHITECT with a lunit of $500,000 per claim/annual aggregate. This insurance shall extend coverage to loss of interest, taming, profit, use and business interruption, cost of replacement power, and other special, indirect and consequential damages subject to the limitation regarding consequential damages described in Paragraph 5 below. If the COUNTY requests the ARCHITECT" to obtain additional insurance coverage, the cost of such additional insurance not otherwise reimbursed to the ARCHITECT under this Agreement shall constitute an additional direct charge to the project. E. For specialized services not performed by the ARCHITECT, the ARCHITECT shall require each of its subcontractors to take out and maintain during the life of such subcontract work the insurance coverages set forth in Paragraphs 1, 2, 3 and 4 above; provided however, the following limits shall apply:. 1. Employer's Liability Insurance (bodily injuries) with limit of $100,000 per occurrence, and Employer`s Liability Insurance (occupational disease) with limits of $100,000 per \\FILESERVER\PUDLIC\EnginceriiigNHimpjeapitai Project.a\4724 rirjreement-MAC.dac 6 411 40 40 person and $500,000 in the aggregate. 2. Commercial General Liability Insurance, with limits of 5500,000 each person $1,000,000 each occurrence for bodily injuries, and $1,000,000 each occurrence for property damage. F. The limits under Paragraph 5 shall be the same for any subcontractor. G. The ARCHITECT shall furnish the COUNTY with two (2) copies of a. Certificate of Insurance evidencing policies required in Paragraphs 1, 2, 3, 4, 5 and G above and evidencing policies of insurance required above for subcontractors. Such Ccrtiftcatcs shall give the COUNTY at least thirty (30) days written notice in the event of cancellation of or material change in any of the policies. The Certificate of Insurance shall give a brief description of the work being performed under this Agreement. All insurance companies provided shall be companies rated at least A + VII per Bests Key Rating Guide and licensed to do business in the State of Florida. H. To the extent of the insurance benefits under the insurance policies required by this Article, or for any loss, damage or expense falling within the deductible portion of Architects Professional Liability Insurance described in Paragraph 4 hereof, whether indemnity payment, defense costs, or otherwise, the ARCHITECT shall save the COUNTY harmless from and against all costs and losses, and all claims, demands, suits, actions, payments and judgements arising from personal injuries or otherwise, brought or recovered against the COUNTY arising out of any negligent error, or omission of the ARCHITECT, its agents, servants or employees, in execution or guarding of the work, including any and all expense, legal or otherwise, incurred by the COUNTY or its representatives in the defense of any claim or suite. SECTION IX - OWNERSHIP OF DOCUMENTS All plans, specifications, calculations and other work products paid for under this contract shall be the property of the COUNTY and shall be delivered to the COUN"fY at its direction. The COUNTY shall have the right to re -use drawings of the structural details in it manlier consistent with law and the State of Florida Department of Professional Regulation rules. The COUNTY shall indemnify and hold harmless the ARC141TECT from all claims, damages, losses, and expenses, including attorney's fees, arising out of, or resulting from any such re -use. I\PILR96RVBR\Pi113LIC\engineering\Kimp\Capitan Projactal\9724 Agreement -MO.doc 7 40 40 SECTION X - CERTIFICATION AGAINST CONTINGENT I+EES The ARCHITECT warrants that he has not employed or retained any company or person, other than a bonafide employee working solely for the ARCHITECT to solicit or secure this agreement and that he has not paid or agreed to pay any person, company, corporation, individual, or firm, other than a bonafide employee working solely for the ARCHITECT any fee, commission, percentage, gi#i, or other consideration contingent upon or resulting from the award or making of this agreement. SECTION XI - PUBLIC ACCESS The COUNTY may unilaterally cancel the contract for refusal by the ARCHITECT to allow public access to all documents, papers, letters, or other material subject to the provisions of Chapter 119, Florida Statutes, and made or received by the ARCHITECT in conjunction with the contract. S'ECT'ION XII -- SEVERABILITY If any portions of this Agreement shall be held invalid or unenforceable, such invalidity or unenforceability shall not affect any other provisions hereof, and this Agreement shall be construed and enforced as if such ;provisions had not been included. SECTION XIII -- TERMINATION The obligation to provide further services tinder this Agreement may be terminated by either party upon 30 days' written notice by either party. In the event of any termination, ARCHITECT will be paid for all services rendered to the date of termination, all reimbursable expenses and termination expenses. SECTION XIV — GENERAL A. B. The contact person in the COUNTY"S behalf shall be the Indian River County ENGINEER, Christopher J. Kafer, Jr., P.E, The ARCHITECT" shall take directions for the work from the Indian Diver County ENGINEER, exclusively, or whom the Indian River County Public Works Director might otherwise designate in writing. C. This Agreement, regardless of where executed, shall be governed by and construed according to the laws of the State of Florida. And Indian River County Board of County Commissioners 1820 25th St. Vero Beach, Florida 32960 PROJECT ]NAME AND LOCATION; Jungle Trail/Pelican Island Refute Enhancement Proicct Indian River County Florida DEFINITIONS As used in the entire Agreement, the following; words and their derivative words or phrases have the meanings indicated, unless otherwise specified in the various sections of this agreement. CERTIFY, CERTIFICATION: A design Professional's opinion based on his or her observation of conditions, knowledge, information and beliefs. It is expressly understood that the Design Professional's certification of a condition's existence relieves no other party of any responsibility or obligation he or she has accepted by contract or custom. ESTIMATE: An opinion of probable construction cost made by the Design Professional. The accuracy of a probable construction cost opinion cannot be guaranteed. INSPECT, INSPECTION: The visual observation of construction to permit the Design Professional to render his or her professional opinion as to whether the contractor is performing the Work in a manner indicating that, when completed, the work will be in accordance with the Contract Documents. Such observations shall not be relied upon by any party as acceptance of the Work, nor shall they relieve any party front fulfillment of customary and contractual responsibilities and obligations. SCOPE /SERVICES: 1. PROJECT OVERVIEW: The project consists of professional planning and design. services for the development of 3 public use sites along; .lung;le "frail. and portions of the Pelican Island National Wildlife Refuge. The 3 specific public use sites which will be developed to receive restrooms, access, parking, and trails are: AHach rnent - l 40 40 • The County easement portion of the I.isser/Kennedy site, located between Jungle Trail and S.R. AIA (owned by U.S. Fish & Wildlife Service, portion leased by Indian River County) • The County easement portion of the Surman site, located West of Jungle Trail (coned by U.S. Fish & Wildlife Service, portion leased by Indian River County), • The "development zone" i.e. non -preservation zone of the western portion of the Cairns Jungle 'frail Conservation Area, a.k,a. Cairns Tract, (owned by tte State of Florida, leased by Indian River County -CARL purchase). Mote: The existing homestead remnants (limestone and brick chimney, foundation, stairs, and wood debris is intended to remain undisturbed. In addition, the Royal Palms and Canary Island Date Palms remaining from the Forster homestead are intended to remain undisturbed. In addition to the "development zone" of the Cairns site, a master plan will be prepared for interpretive trails throughout the entire Western portion of the "preservation zone", a.k.a. the hammock area. Wort: at the Pelican Island National Wildlife Refuge site shall involve the following: • Preparing an overall site master plan for the entire Ken Kennedy site (cast of Jungle Trail), the entire Surman site, and the entire Ken Kennedy site (West of Jungle. Trail, lying between the Surman site and the Lisser/Kennedy site). • Preparing construction documents and permit applications for the observation tower, infor=mation kiosk, and boardwalk. • Preparing construction documents and permit applications for the new roadway connecting the Lisser/Kennedy site through tiee Ken Kennedy site, to the Surman site parking area, and back to Jungle Trail. The Landscape Architect shall provide an overview which Will serve to achieve the Client's objective that the properties be developed in a manner Which is sensitive to the natural environment, and respects cath site's unique "'sense of place", Considering the fact of the inter -governmental cooperation involved in this project (i.e. Indian River County and U,S. Fish and Wildlife Service), whenever the term "County, is used in terms of review and comment on the Consultant's Work, it is understood that the U.S. Fish and Wildlife Service will be reviewing documents, providing comments, and attending meetings as well. It is acknowledged that work under this Agreement associated with the planning and design of public use areas (ori all but the Cairns parcel) will be clone in a manner that is coordinatcd with habitat restoration work being undertaken by Lewis Environmental Services, Inc„ under separate Agreement lvitlr the U.S.. Fish and Wildlife Service. Care shall be taken to avoid duplication of efforts, and to collaborate by sharing information among the two consultants (Brad Sntith Associates, Inc. and LewisEnvironmental Services, Inc.) to assure an integrated cllort on the project. Specifically, the following distinctions will be made between the work of the two consultants: A. Permitting responsibilities (ore all but the Cairns parcel) will be broken into two separate packages: Attachnimit - 2 40 i 1) Permit Package "A" shall involve all wetland restoration/cnvironmental permitting. Lewis Environmental Services, Inc, shall be responsible for this permit package. 2) Permit Package "B" shall involve all stormwater Management permitting for public use facilities. Brad Smith Associates Inc. shall be responsible for this permit package. 3) All permitting on the Cairns parcel shall be handled by Brad Smith Associates (and its design team). 'Che intent is to avoid impacting existing Wetlands on the Cairns parcel, and limiting development to" upland" areas only. B. Master planning and design work shall be coordinated in such a manner that the illustrative master plan doetunent prepared by Brad Smith Associates Inc. under Task 2 below will reflect the general intent of the habitat restoration Work being undertaken by Lewis Environmental Services, Inc. This illustrative plaster plan will be prepared in digital format for use by the U.S. Fish and Wildlife Service in presenting the project in various public relations publications. C. Grades for the proposed loop road will be set by Brad Smith Associates (to meet criteria for stormwater permitting), and coordinated with Lewis Environmental Services, Inc. (so that grades can be properly transitioned into wetland restoration areas, and that site restoration cut/fill quantities can be balanced). Note: total site earthwork calculations (cut/ftl) shall be done under the habitat restoration project prepared by Lewis Environmental Services, Inc. D. Plant palette for use in the public use areas shall be coordinated with palette selected by Lewis Environmental Services, Inc. E. Existing wells on the Ken Kennedy grove site shall be used to provide temporary irrigation for wetland restoration plantings by Lewis Environmental Services, Inc. These wells shall also be utilized to ,provide temporary irrigation to plantings specified by Brad Smith Associates for the public use areas. PROJECT PROGRAMMING, GOALS AND OBJECTIVES: CONSUI,TAN"f team met with the County's representatives and other interested parties in a Pre - Design Workshop to discuss their goals for the project. (This occurred on 2/21/00.) Minutes of this meeting are attached, The contents of the ntinotes shall be used throughout the planning process to provide a clear understanding of County expectations. Any significant deviations rrorn the direction established during the pre -design workshop may result in the need for Additional 'Services. CONSULTANT TEAM: BRAD Smith Associates, [tic. shall be the Prime Consultant, and shall be responsible for master planning and design of the park. The firm will be coordinating the efforts of the following sub-consuhatlls which will be serving in support roles: A. Carter Associates, Inc. (surveying, stonmwvatcr, tuld civil engineering) B. Environmental Consulting Group (environmental consulting) C. Ldlund and Dritenbas, Architects (architectural design) l) Garrison & Frohlich, (inechanical, electrical, plumbing, lighting design engineers) 2) Jerkins and Charland, (structural engineers) Auitchrnrnt - 3 40 40 40 D. DrDavid Cox (ecological and educational services) 4. PROFESSIONAL SERVICES; The professional service of the consultant team shall be as follows: A. Task I — site InventoEy (serve int, and environmental assessment) I) Visit the sites to become farniliar with existing conditions, and to record on- site observations for use in future planning and engineering activities. Analyze existing vegetation, and identify any areas of specific concern, and areas of exceptional value that should be preserved. Coordinate with survey crew as required to locate certain portions of the site which may be designated as "preservation zones", and others designated as "development zones" which would be better suited to construction. Note: work on the Cairns site shall comply with the approved Land Management Plan that indicates tile Majority of the site as being a "preservation zone", due to the fact that it is vegetated byaMaritime llammock. 2) All boundary surveys required for site planning and for permitting purposes shall be provided by Indian River County. 3) Carter Associates, Inc. shall provide topographic survey data (for engineering design) for each of the 3 County sites and the loop road to include the following: a) Lisser/Kennedy Site Topographic survey (for engineering design) of a portion of the site described as "Easement I" for Pelican Island National Wildlife Refuge, Indian River County, Florida, containing 2.16 acres more or less. Area to be surveyed will be a 200' wide -1 swatch within which the proposed access road will be sited, and the area for the proposed restroom, as determined by project Landscape Architect. This area will be referred to as the " development zone". Topographic survey of the "development zone" portion of the site on a 100 foot grid, more or less and cross sections Of Jungle Trail, right- of-way 100' on either side of the access point adjacent to site. Location of all improvements on tile "development zone" portion of the site and within jungle rraii right-of-way 100' on either side or the access point adjacent to the site. Location of significant trees outside of heavily wooded areas with a diameter of 4 inches or greater at chest height within the " development zone'. Topographic survey to include water service, gravity sewer and force main routing to be determined by project engineer. ♦ Miscellaneous topography and/or location as directed by tinid Smith. Landscape Architect. Miscellaneous topography and location to be performed with Brad Smith shall not exceed 4 hours field thlic, including travel time. ► Establish State Plane Coordinates (North American Datum of 1983, adjustment of 1990) and Vertical Benchmarks (National Geodetic Vertical Datum of'1929) for site, as required by IRCDUS, b) surmall site: survey (for engineering design) of a portion Or tile site described as "Easement 11" for Pelican Island National Wildlife Refuge, Indian River County, Florida, containing 11.9 acres, more or less. B. Task 2 — Master Plan Preparation 1) Prepare Preliminary Master Plan of each site for the County's review, highlighting (lie County's objectives within tlne context of the existing site conditions. This plan shall indicate the gencral location of the proposed restroom building sites, trails, boardwalks, observation to%k,,.*r, contmon open space, site amenities, entrance, and the pedestrian and vehicular circulation systems. The stormwater management system will consist of vegetated swales meeting the requirements of the St. Johns River Water Management District (SJRWMD). The stormwater management system, as well as other proposed improvements will be laid out so that the construction} and operation will compliment efforts li,r onsite wetland and Habitat restoration. a) Plan shall use the site survey with the ,jurisdictional wetland delineation, and the proposed wetland restoration areas dcsignatcd by Lewis Environmental Services, Inc. overlaid upon the County's grayscale aerial photo -imagery as a base map. Auachmenn - 6 40 40 i b) Restroom building footprints developed by Edlund & Dritenbas Architects (based on proto-type designs provided by the U.S. Fish and Wildlife Service) will be utilised in the planning process. c) The site design for the proposed boardwalks, observation tower, and kiosks will be indicated, including nature trails, driveways, parking areas, and vegetated areas d) Alternative pavement sections shall be analyzed for use on the U.S. Fish and Wildlife Service roads, and projected costs presented in a summary report discussing considerations for each alternative. Surface treatment selected shall be coordinated so that similar surfaces will be used for both County and USFWS roads/driveways. e) Coordinate one Design Team workshop session to review the master plan prior to its submittal to the County staff. f) Review the Preliminary Master flan with County staff. g) Revise the Preliminary Master Plan, incorporating review comments received from County Staff. h) Prepare an illustrative color rendering of the approved Master Plans for presentation purposes. The rendering shall be mounted on "gator board". 2) Dr. David Cox will assist with the planning and design of interpretive trails and educational signage on the Cairns site. This work will be governed by sensitivity to the natural and cultural resources of each site. C. Task 3 — Pre -Application Meetings 1) Submit a request to the St. John's River Water Management District (SJRWMD), for pre -application meeting to present the Master Plan and to obtain staff input as to: a) the desirability of the scheme b) the feasibility of obtaining hermits for construction c) issues and staff concerns regarding the scheme d) standards and requirements necessary to obtain permits 2) Prepare a conference report summarizing the results of the pre -application meetings. D. Task 4 — Preliminary Design 1) Based on the approved Master Plan, prepare preliminary design drawings at an appropriate scale, using site survey as a base map. a) Geotechnical Coordination ♦ Coordinate the services of County's geotechnical consultant (who will be working directly for the County under separate Agreement) to provide the following: • Soil borings as required to perform stortnwater drainage planning, to design paving improvements, and to site the proposed structures. • Prepare a geotechnical report to include rec commendations for site preparation procedures, pavement section design, and foundation. design parameters for the proposed structures. General comments concerning; anticipated performance or tate proposed stormwater management system, and parking; improvements shall also be included. • Perform Geld density testing during; the construction phase of the project. 4 The wetland restoration project (hy Lewis Environmental Services, Inc.) will result in excess sand/shell material that can be used to elevate roadways, parking areas, etc. Coordinate with County's Auachimmnt - 7 f 40 geotechnical consultant who will evaluate the suitability of the material for use as fill under paved surfaces. b) Architectural Design — Edlund and Dritenbas Architects will provide the following services, coordinating with their mechanical, electrical, and structural consultants as necessary: # Review the geotechnical report prepared by County's geotechnical consultant (outlined above). # Review architectural drawings to be re -rased and/or modified. Prepare report regarding the adequacy of the existing designs relative to the geotechnical Findings. Also, the restrooms will be examined for compliance with the Florida Potty Parity Act and Standard Plumbing Code, 1994, which has been adopted by the State. Outline any modifications rcquired to be made to the existing design drawings. Note: Any such work (i.e. modifications to existing drawings) will be included in the Scope of Work. * Review proposed public use area designs for compliance with the ADA of 1991, the Florida Accessibility Act of 1993, and the current modifications as provided through the Florida Department of Community Affairs. i On the basis of the reviews identified above, prepare preliminary design drawings for all architectural features of the project. c) Civil Design --- Prepare preliminary site design drawings on the basis of the approved Master Plan. These will include information of site layout, paving, and grading. ♦ Carter Associates will coordinate soils investigation (by others) required for design. # 'fhe stormwater management systems will incorporate dry grassed (or vegetated) retention swales meeting the requirements of SJRWMD and I RC. # Carter Associates Inc. will prepare preliminary on-site and off site water and sewer design drawings. It is anticipated that packaged grinder pump lift station will be required at the Surman and Cairns sites. Tile Lisser/Kennedy site will be served a gravity system, which will tie to a master planned lift station to be constructed through a developer's agreement — not in this contract) located on the Lisser/Kennedy site adjacent to S.R. AIA. The Surman site will utilize a force main to be constructed within Jungle Trail from the Surman site to the proposed gravity system on the Lisser/Kennedy site. The Cairns site will utilize a force main tying to the gravity collection system within the Sea Oaks Development (to [lie north). An existing water main within SR A -I -A will be tapped to provide water service to the Lasser/Kennedy site, then routed down Jungle Trail to the Snrman site. The Cairns site will obtain water service by lapping the existing water main within Jungle Trail. No fire protection appurtenances or fire lines will lie provided at any of the three (3) sites. # Consultant will prepare preliminary roadway design drawings. Consultant will define drainage conveyance and stonnwater management system requirements, evaluate stornnvater manag,enncnt options and prepare preliminary drainage conveyance and stormwater management design drawings. The roadway centerline will be provided by the Landscape Architect, prior to Carter Associates performing topographic survey as described under 'Cask 1.3.d. This alignment will serve as Carter Associates' basis of survey baseline Attachment - 8 i • 40 stationing and design. Consultant will evaluate up to two different roadway pavement/stabilization options. The options to be evaluated shall be provided by the Landscape Architect. Carter Associates will verify permitting requirvincnts. `1'hc Consultant and Carter Associates will prepare it preliminary estimate of probable construction costs based on the preliminary design of roadway and drainage improvements. 2) Working together with the Consultant Team, prepare a Preliminary Opinion of Probable Construction Costs based on the proposed Preliminary Design. 3) Meet with the County to review the Preliminary Design work, and to receive authorization to proceed with the Final Design Phase ofthe project. E. Task 5: — Permittinf; 1) Carter Associates will prepare applications and required exhibits for submittal by the County toward obtaining the following permits associated with the development of the public use sites: a) St. Johns River Water Management District - Stornwater ERP b) IRCDUS - Domestic water and sanitary sewer construction e) Indian River County - Stormwater permit d) Florida Dept. of Environmental Protection - Domestic water distribution system extension e) Florida Dept. of Environmental Protection - Sanitary sewer collection and transmission system extension 2) It is assumed that the loop roadway, parking areas, other public use improvements and associated drainage conveyance and stormwater management system will be located in "Uplands" and will not require ally wetlands permitting. Should wetlands permitting or any other environmental permits (other than St. Johns River Water Management District - Stormwater ERP) be required, they shall be negotiated its an additional service.. 3) Based on the Landscape Architect's design drawings, Edlund and Dritenbas will prepare applications and required exhibits (foundation structural review, windload calculations, electrical service) l'or submittal by the County toward obtaining the require(] signage permits. 4) Make informal contact with the staffs or the above agencies to answer questions, to clarify the proposed construction, and to expedite the proccssing of the permits. Task 6: — Final Design Phase 1) On the basis of the approved Preliminary Design, prepare final construction drawings: a) Site Plan: b Coordinate with Carter Associates to develop a site plan drawing including layout anti dimensioning, and loeati-in or ,ill proposed improvements. ♦ Coordinate with County start' who will prepare and submit applications for Indian River County site plan approval including Lotti clearing, tree removal and concurrency applications. 4 Attend the 'lechnteal Review Committee (f.lt.C:.) meeting all([ prepare responses and site plan modifications its required by the 'ER.C. comments. Provide coordination and follow-up work nccesz;aiy to obtain site plan approval. b) Infrastructure Design: Attadunent - 9 40 4D M * Prepare construction drawings for paving and grading, including details and specifications. + Carter Associates will prepare construction drawings for drainage, water and sewer improvements including details and specifications. + Carter Associates will coordinate required geotcchnical investigations with County's geotechnical consultant. + The Wastewater pump stations will be prefabricated grinder pump systems meeting the minimum requircments of the Indian River County Dept. of Utility Services (IRCDUS), and Florida Department of Environmental Protection (FDEP). c) Loop Roadway Design: Based on approval of the preliminary design drawings by the Landscape Architect, U.S. Fish & Wildlife and the County, Carter Associates will prepare final construction drawings including details and specifications for roadway, drainage conveyance and storrawater management system improvements. d) Architectural Design: Edlund and Dritenbas will prepare final construction drawings For all architectural features identified in the Preliminary Design Submittal. e) Landscape Design: + Prepare final construction drawings for all landscape improvements. Note: the primary objective is to use a naturalistic theme to blend with the conservation areas, and to mininii7e maintenance requirements. + Prepare performance specification requiring the contractor to provide for temporary irrigation during the establishment period. Since native vegetation will be used (which will not require supplemental irrigation subsequent to establishment), the irrigation objective will be for the contractor to provide a temporary method of watering during the establishment period. Site Amenities and Passive Recreational Design: + Prepare final construction drawings for project identification signage, site directional and informational signage (all with a common theme), the boardwalk, kiosk, and site lighting. g) Jungle Trail Signage: ♦ Prepare typical design detail drawing for signage to be used along the entire Jungle Trail corridor at the following locations: • One at the north terminus • One at the south terminus -one • 'rhe S.R. 510 intersection (one on the north side, and uric on the south side) • One at each site being developed under this project (i.e. Lisser/Kennedy, Sumian, & Cairns) * Sign design sliall be based on that used at Roun(1- Island Oceanfront Park. + Atypical planting plan shall be prepared for use at cacti sign site. 2) Prepare a final Opinion of Probable Construction Costs, along with bid schedule for paving, grading, drainage, water, sewer, lighting, structures, landscape, site ftirnighings, signage, boardwalks, kiosk and other miscellaneous improvements. 3) Meet with County to review pre -final (90%) drawings, revised opinion of probable construction costs, to receive review comments, and authorization to finalize the construction drawings. Attachment- 10 M • ft 4) Meet with County to present final construction drawings and specifications, and to discuss the bidding phase of the project. G. 'Task 7: — Bidding and Construction Phase Services 1) Prepare bid and construction documents by providing a bid form and specifications for site improvements. 2) Attend pre-bid conference to be coordinated by County staff. 3) Review bids received by the County and provide comments and recommendations to the County. 4) Attend pre -construction meeting to be coordinated by County staff. 5) Observe the work of the contractor on an intermittent Basis not to exceed a total of eight (8) site visits as requested by County to observe work progress and to determine if the construction is proceeding in general accordance with the contract documents. 6) Notify the County of observed deficiencies in the work. 7) Review and approve: a) Shop drawings and samples. b) Results of tests and inspections. c) Other data which the contractor or subcontractors are required to Submit. 8) Monitor contractors progress relative to established schedules and report status to County by preparing field reports for each site visit. 9) Project close-out shall begin upon notice from the Contractor that his work, which is believed to be acceptable to the County, is substantially complete and in general accordance with the contract documents. At this point in time, the Landscape Architect and the Consultant Team shall conduct a walk-through with the County's representative to verify that the work conforms to the contract documents, and to establish a "punch list" of items to be completed or corrected. 10) Upon notice by the contractor that the "punch list" has been completed, and that the work is ready for final inspection anti acceptance, the Landscape Architect and the Consultant 'team shall conduct a walk-through to verify "punch list" completion for final acceptance of the work by the County. 1 l) If deficiencies are found, these will be itemized and a follow-up walk-through will be made to verify final completion of the work. 12) Visits tar the purpose of project -close out as described above, are included in the eight (8) site visits indicated above. 13)The Consultant upon the consensus of his salt-consuhants will review and approve for payment the Contractor's pay requests. The Consultant will review and make recommendations on the Contractors progress schedule and work plan. Six (6) pay requests (one per month) and a final payment request are expected. It is anticipated that the project(s) will be built on the basis of a 180 -day contract for construction. 14) `flee County recognizes that construction review is a vital element of a Design Professional's complete service, provided to minimize problems during construction. Should the County for any reason not relaill the Consultant Team to review construction, the County waives any claim against the Consultant, and agrees to indemnify, defend and hold the Consultant Team harmless from any claim or liability f'or injury or loss arising front problems during construction that allegedly result l'roin findings, conclusions, recommendations, plans or specifications developed by the Consulmnt `fe:tin. We assume the existing waterlines in the S.R. AIA right-of-way has adequate capacity to serve this project and that off-site utility extensions will be needed. C. Sign permitting is included. D. All permi(ting, application, impact and testing fees will be paid for by the. County, E. The Consultant will provide technical specifications to the County. County will be responsible for non-technical specifications and contract documents, as well as bidding phase duties. Preparation of a Bid Schedule is included. F. Indian River County Land Development perinit waivers will be obtained. G. Infrastructure improvements shall be a single design for one phase inclusive. H. All required archeological studies have been completed and detailed data will be provided to the Consultant Team. 1. Prototypical standard design drawings for site features to meet U.S. Fish and Wildlife Service guidelines will be provided. J. All computer-aided design data will be provided in AutoCAD readable format, K. U.S. Fish and Wildlife Service will provide preliminary design drawings and typical sections prepared by Lewis Environmental Services, Inc. (under separate contract). L. Two separate sets of construction drawings will be prepared: 1) One set for the County's project consisting of the three sites (Lisser/Kennedy, Surman, and Cairns) with restrooms, access, parking, and trails. 2) One set for the U.S. Fish & Wildlife Service's project consisting of the observation lower, information kiosk, and boardwalk, and the loop road. M. The County does not desire to provide permanent irrigation system(s) at the site(s). N. Loop Rd. design shall consist of plan view only, with a typical cross-section. Individual profiles shall not be provided. O. Proposed loop road alignment shall be indicated over aerial site photo. Once approved by County and U.S. fish & Wildlife Service, alignment shall be calculated, field -staked, and cross-sections surveyed. P. Proposed loop road elevations will be estahlished by the Landscape Architect, and Lewis Environmental Services, Inc. will coordinate grade transitions to tale wetland restoration areas to accommodate the required loop road elevations. The loop roadway, parking areas, other public use improvements and associated drainage conveyance and stormwatcr management system:. will be located in "uplands" and will not require any wetlands permitting. Meeting #6: One meeting with County to review pre -final (90%) drawings, revised opinion of probable construction costs, to receive review comments, and authorization to finalize the construction drawings, G. Meeting 47: Meet with County to present final construction drawings and specifications, and to discuss the bidding phase of the project. 1I. The County shall provide to the Consultant its standard General Conditions, Contract for Construction, and other non-technical Contract 'Specifications typically used for construction project, in digital (M5 Word) format. D. The County will make blueprints of the final design drawings provided by tile:. Consultant, and will reproduce the contract documents provided by the Consultant. The County will also advertise for competitive bids, issue bidding packages to prospective bidders, and receive bids for the construction of tile. project. L. The County shall provide a qualified construction review specialist to daily visit the site, observe the work of the Contractor, to coordinate with the Contractor's superintendent, and to determine if the construction is proceeding in general accordance with the contract documents. It will be the responsibility of tllc County's construction review specialist to coordinate with the Consultant to schedule the site visits provided in the scope or Work. In addition, The County's construction review specialist will observe utility construction activities per IRCDUS requirements. F. I ) One of (lie U.S. Fish and W ildliFc Service objectives is the restoration of the site to create habitat For wildlife. a) Robin Lewis, a wetlands specialist, is developing plans for created wetlands our the grove sites. Portions of the site will be devoted to the creation of maritime hamnrock communities. We will synchronize our project with this Page 2 i 40 !s . b) The design should be completed by the end of this summer c) Dorn prefers that construction of Robin's project be completed prior to commencement of tine recreational improvements to be constructed under this project. 2) The primary U.S. Fish and Wildlife Service objective is habitat restoration. Recreational use is secondary. "See„ but don't impact wildlife." 2. Background Information A. Commissioner Stanbridge, Doris Whitmore, Jens Tripson, and many others have been involved in an extended period of planning and public meetings to establish the basic direction and intent for the use of these properties. All work tinder this project is to be consistent with the groundwork that has already been laid, Therefore, additional rounds of public meetings are not envisioned as a part of this scope. B. Jungle Trail itself has a long history, including a good bit of public input during the last 10 years or so. 1) Some controversy was associated with the "Maintenance Map" prepared in the 1970'x. a) Now, the County only has a prescriptive right-of-way for the actual roadbed, and a few drainage swales. b) There is a 30' wide landscape buffer associated with the Trail. 2) Jungle Trail is promoted as a linear park, and managed as such. 3) Most adjacent developments have their ingress/egress other than to Jungle "Grail. However, there are some property owners who depend on Jungle Trail for their only access. 4) While an appropriate surface treatment is needed to reduce erosion and sedimentation, and to minimize ongoing maintenance requirements, it was determined that this anti other long-term strategies for Jungle Trail would not be addressed until the master planning and construction of improvcnients under this project were successfully completed. Such planning work may be provided as Additional Services tinder this consulting agreement at a later date. 5) It was agreed that U.S. [lark Service standards would be much more appropriate than those of the FH WA and FDOT (the intrinsic resources should be enhanced and protected, not destroyed by applying uniform highway standards). G) Visual continuity of the whole Trail is an important component of this project. Signage used along all of Jungle Trail, and facilities used at each separate site should be of a unified thermic. It was agreed that a "turn-of=the century" look would be appropriate. 3. Review of Existing Plans A. Dorn has plans for: 1) Kiosk 2) Restrooms 3) Observation tower 4) Boardwalks B. 'rhe County has plans for the observation tower used at Round Island C. Mans prepared by Robin Lewis (described above) are available l'or review. D. While design work under this project may be basal on one of the above, the f inil produce will be a new design, meeting all current code requirements (rather than simply re -using an existing set of drawings). Environmental Issues, Permitting A. Lengthy discussion centered on permitting strategies. whether or not work under this project should be combined with the other environmental permitting associated with habitat restoration. B. The final decision was to handle permitting of each site separately, without combining them with tate habitat restoration prosect. 1) By permitting each site separately, the thresholds will be lower, and easier to meet. C. U.S. Fish and Wildlife Service anticipates wetland permits for habitat restoration to be in hand by this time next year. S. Archeological Issues A. A good bit of work has already been done in terms of archeologicallhistorical inventory. B. Work under this project will take into account the findings of the prior archeological services. C. Florida Bureau of l-listoric ['reservation has areas " tied down". Commissioner Stanbridge will provide master site file numbers. D. Our only scope of archeological services will be to have Bob Johnson (and his staff) available during [lye construction phase should any finds be made, 6. Site Development (utilities, access, pavement alternatives, stormwater management A. Septic tanks and drainfaelds will not be an option. B. Sewer and water service will need to be provided at each site. C. Some discussion centered on the possibility of using shallow well(s) for service at the Surman site, and providing water treatment (water must be of potable quality from lavatories). However, it was agreed that the best solution most likely be to extend a water line from the Kennedy site. D. Since the surface treatment of JungleTrail will not be addressed, all sites will be accessed from an unpaved road. However, Jim Davis was insistent that some type of surface treatment was needed for each access road and parking drives (rather than using a motor grader). He indicated that reports he has read state that more water quality problems arise from unpaved roadways than those with surface treaumean. It was noted that perhaps manufacturers of innovative alternative paving systems would he willing to provide significant price reductions considering that their systems) would be considered as proto- types for consideration as eventual solutions for Jungle Trail. E. Grassed parking is the preferred type of tri atmertt for individual parking spnces. F. Access for the north end at the Kennedy site will be across lion the Sea View entrance (to avoid the acute angle it (lie north end of Jungle `frail). Although[ access will be planed this way, it may be implemented [luring a subsequent phase of construction, with aeccss to the Kennedy site being from directly from Jungle 'frail. C. Infiltration of stormwater should be encourage([. Grassed swales would be appropriate, although native vegetation is desired. (Note: vegetated swales may be considered for use.) Page 4 40 7. Architectural Features A. FEMA base flood elevation + 6" is required by Indian River County. Therefore, stun wall construction is envisioned to avoid excessive fill requirements. B. Structures will meet 130 -mph windload standards. C. Florida Vernacular style will be used. "fin roofs and Flardic-plank horizontal siding would be appropriate. D. Both ADA and Title 2 requirements must be stet. E. Class "A" material will be used (fire-resistant), due to the remote nature of the sites, F. Average Daily Use numbers are required to properly sizc the restroom facilities. Note: Most likely, the restrooms will be small, with only 1 toilet on the men's side, and 2 on the women's side (due to "Potty Parity Act"), G. Restrooms will be CBS construction. 1) Self -ventilating 2) Screened to keep insects out H. Crews bring cleaning supplies with them -no need for storage inside restroom buildings. 1. Each site will be bated at night (controllcd access dawn `till dusk) 8, Other Design Features A. A cohesive signage package will be developed under this project. B. Landscape enhancements consisting of native vegetation will be a part of each site development package. 9. Budget A. Indian River County has $700,000 budgeted for construction costs through ISTEA funding. B. U.S. Fish and Wildlife Service has approximately $200,000 budketed for construction of- t) Observation Tower 2) Kiosk. 3) Boardwalks 4) Access ramps and pathways C. U.S. Fish and Wildlife Service has separate monies budgeted for: 1) Access loop road from the Kennedy site to the Surnan site 2) Road from AIA into parking at Kennedy site D. Total construction cost budget is close to $1 million E. Budget for proressional services (approximately $150,000) is separate from that for construction costs. F. The construction documents will be divided into 2 separate bid packages: 1) l for the Indian River County portion 2) 1 for the U.S. Fish and Wildlife Service portion 10. Schedule A. Completion of construction is anticipated by November 1, 2.00 1. B. The project schedule will be updated, based on the final scope orservices. 11. Grants A. Other grants may be sought through the Greenways and "trails program as Additional Services. 12. Summary A. U.S. Fish and Wildlife Service will most likely administer their own construction contract. B. U.S. Fish and Wildlife Service Engineers will need to review and approve our design work. C. 1 Bid package will be prepared, with separate Notices to Proceed: 1) Kennedy 2) Surman 3) Cairnes D. l Public hearing at the County Commission Meeting for site plan approval will suffice. E. Michelle Gentile will rill out application for site plan approval. F. Concurrency -related issues will be handled by Michelle Gentile and other County staff members. G. County staff (Chris Mora) will handle the traffic study (or traffic statement) that will be required. H. Life Safety review will be handled by Lt. Mellitti (fire department). 1.
