AMENDMENT NO. I TO THE PROFESSIONAL
ENGINEERING SERVICES AGREEMENT
NORTH COUNTY REGIONAL PARD
IRC PROJECT NO. 9926
THIS is an amendment to the existing AGREEMENT dated June 13, 2000, between
BRAD SMITH ASSIOCIATES, INC. (ENGINEER) and INDIAN RIVER COUNTY
(COUNTY). This amendment address changes in "SECTION I - PROJECT LIMITS",
"SECTION III - SCOPE OF SERVICES" and "SECTION V - COMPENSATION", of the
AGREEMENT.
SCOPE OF SERVICES

Review proposed master plan project components to be funded through tine T-21
Enhancement Program.
Prepare draft resolution for support for the Indian River County Board of County
Commissioners to endorse the grant application and authorize its submittal to the Florida
Department of Transportation (FDO`/').
Prepare a staff information report on the grant program and applicability to North County
Regional Park (to be given to County Engineer, Chris Kafer for preparing a Board of County
Commissioners Agenda Item).
Complete grant application package for submittal to the FDOT.

This scope provides services necessary to develop an appropriate mitigation plan and
prepare and follow-up with related per Hitting application. It sloes not provide construction
services relative to mitigation work. 'rile following is work to be completed under this task:
• Meet with St. John's River Water Management District to discuss mitigation
strategy. (This occurred on 04/17/00 and IllinUICS of this lllecting are attached.)
• Meet with Kcith Fischer to discuss buffer preserve mitigation strategy. (This
occurred on 04/25/00 and minutcs of this meeting are attached.)

• Attend site walk-through with Mark Gronceski and Keith Fischcr to evaluate,
negotiate, and coordinate Jurisdictional wetland boundaries and mitigation
options. (This occurred on 04128/00 and ntun tcs orthis meeting are attached.)

delineation.
Meet with Keith Fischer to coordinate mitigation plan with Buffer Preserve.
o Make modifications to mitigation plan. Prepare and submit mitigation plan report

Task 3 — Bound a Survey Discretiancics
On 04118100, discrepancies were discovered between the lease agreement legal
description and the existing boundary survey provided by the County. Since that time, the design
team has researched, reviewed and coordinated with the County to rectify the discrepancies.
Attached is a detail account of additional services that the design tcam has performed due to this
discovery.
COMPENSATION
This section of the AGREEMENT entitled "SECTION V - COMPENSATION" shall be
revised in response to the Scope modifications set out herein. The charges associated with
Section V above are $9,500.00. AGREEMENT shall be increased from $2.49,070.00 to
$258,570.00
The AGREEMENT is hereby amended as specifically set forth herein. All sections of the
AGREEMENT shall remain in full force and effect, and are incorporated herein. This
Amendment No. 1 to the AGREEMENT regardless of where executed, shall be governed by and
construed by the laws of the State of Florida.

This scope provides services necessary to develop a appropriate mitigation plats, prepare
and follow up with related permitting applications. It does not provide construction
services relative mitigation work. The following is work to be completed under this tusk:
• Meet with St. Johns River Water Management District to discuss mitigation strategy
(This occurred on 4117100).
• Meet with Keith Fischer to discuss buffer preserve mitigation strategy. (This occurred
on 4125100).
• Attend site walk-through with Murk Gronceski and Keith Fischer to evaluate,
negotiate, and coordinate jurisdictional wetland boundaries said mitigation options
("This occurred on 4/28100).
• Meet with St. Johns River Waster Management District to finalize wetland delineation.
• Meet with Keith Fischer to coordinate mitigation plan with Buffer preserve.
■ Make modifications to mitigation plan. Prepare and submit mitigation plan report to
County.

Task 3 - Boundary Survey Discrepancies

FEE ARRANGEMENT:
The Client agrees to pay the Landscape Architect for professional services as follows:
A lump sunt of Nine Thousand Five Hundred Dollars and 001100 ($9,500.00), according
to the following schedule of values:
Task 1 —T-21 Enhancement Grant Application $1,280.00
Task 2 — Buffer Preserve Miligation/Permitting Strategy $6,920.00
Task 3 -- Boundary Survey Discrepancies $1,300.00
SUMMARY:
Original Fee Amount $249,070.00
