FIRST AMENDMENT TO THE AGREEMENT BETWEEN
THE STJOHNS RIVER WATER MANAGEMENT DISTRICT
AND INDIAN RIVER COUNTY
FOR THE STORMWATER MANAGEMENT COST -SHARE. AGREEMENT
THIS AMENDMENT is entered into this 1 St day of August , 2000, by and
between the GOVERNING BOARD of the ST. JOHNS RIVER WATER MANAGEMENT
DISTRICT, whose mailing address is Post Office Box 1429, Palatka, Florida 32178-1429
("DISTRICT'), and INDIAN RIVER COUNTY ("ENTITY"), whose address is 1840 25th Street,
Vero Beach, Florida 32960.
WHEREAS, DISTRICT and ENTITY entered into an Agreement on April 6, 199'9, to assist
Indian River County in the implementation of the Roseland area stormwater detention lakes.
WHEREAS, DISTRICT and 'ENTITY desire to modify the Agreement.
NOW, THEREFORE, in consideration of the mutual covenants contained herein and for
other good and valuable consideration, DISTRICT and ENTITY hereby agree to the following
amendments:
1. Item 3 The DISTRICT shall: Paragraph B shall he deleted and replaced with the
following:
"Obligate moneys to fund a portion of the stormwater management projects in an amount
not to exceed $50,000, or 13% of the total cost of the Gifford Project; and an amount not to
exceed $185,000, or 32% of the Roseland Project. If, upon completion of all the tasks
identified for reimbursement, the ENTITY's actual expenditure for the tasks) identified for
reimbursement is less than originally projected in Project Budget, Exhibit B-1, attached, the
DISTRICT's obligation shall be reduced proportionately."
2. Item 4 The ENTITY shall: Paragraph B shall be deleted and replaced with the following:
"Obligate moneys to fund these two stormwater management projects. ENTITY shall
provide a minimum amount of 87% of the funding for the Gifford Project; and a minimum
amount of 680 of the funding for the Roseland Project, and agrees to provide funding for
any other costs above amount budgeted; if any, required to complete this project."
3. Item 7: shall be amended as follows:
I'he Completion date of the Agreement shall he October 6, 2002."
DISTRICT and ENTITY agree that all other terms and conditions o; the original Agreement
are hereby ratified and continue in full farce and effect.

EXHIBIT"B — REVISED SCOPE OF WORK
ROSELAND AREA EAST''.TORMWATER IMPROVEMENTS PROJECT
I. INTRODUCTION:
Indian River County is preparing a detailed construction scope of work and permit application for the
creation of two wet detention lakes. The South Lake shall be approximately 5 acres providing, treatment
for an $0 acre drainage basin with an estimated 72.4% actual treatment efficiency rate. The North Lake
shall be approximately 3 acres providing treatment for a 44 acre drainage basin with an estimated 55%a
actual treatment efficiency rate.
The County has completed surveys of the wetlands limits and a general topography of the drainage area.
Preliminary environmental site assessments have been completed, and a tentative acquisition agreement
has been reached with the owner of the South Lake property. Conceptual approval on the North Lake
location has been granted from the second property owner. Final negotiations are proceedings, and
acquisitions are conditioned upon permit approvals.
When construction is completed in September 2001, this project shall reduce the nuisance flooding and
road access problems created from the overflowing natural slough south of Bay Street. The creation of
additional flood storage in two wet detention lakes with the construction of control structures to bleed
down the lakes shall improve the quality discharge.
11. WORK DESCRIPTION:
DISTRICT's IRL Program has budgeted funding for this project through the Water Management District
Trust Fund to be applied towards the construction of two wet detention sites to treat stormwater runoff
from the 195 acre basin south of Bay 'Street in northern Indian River County. These wet detention ponds
shall be located in upland areas and incorporated into the drainage system to minimize wetland impacts.
Inlet structures shall divert water from the natural drainage slough into the adjacent wet detention ponds.
Outlet structures with bleed down devices shall return water to a point downstream in tlse slough at a
reduced rate.
COUNTY's contractor shall be responsible to construct these detention ponds in accordance with
DISTRICT and COUNTY requirements.
The South Lake shall be approximately 5 acres providing treatment for a 80 acre drainage basin with an
estimated 72.4%n actual treatment efficiency rate. The North Lake shall be approximately 3 ,acres
providing treatment for a 44 acre drainage basin with an estimated 65% actual treatment efficiency rate.

Final Design, construction documents and permits. The COUNTY shall provide copies of the final
design drawings, specifications and construction documents, scope of work, subconlractor sub -
agreements, and the M.S.S.W. E.R.P. to the DISTRICT prior to initiating construction activities. Proof
of successful land acquisition completion shall also be provided.

Task 2
Construction - Erosion control, during construction, shall consist of placement of hay bales anchor
turbidity barriers on the down slope of disturbed areas at points of concentrated ronoff. A mid -project
and final project report shall be prepared and submitted for review and comment to DISTRICT's Project
Manager. The mid -project report (March 2001) shall provide the current project status and percentage of
project complete. The final project report (October 2001) shall provide completed project description
and photography of completed detention ponds and project works.

efficiency's realized shall be reported.
