19. Applicant's failure to make any of th p yments required Ar in a timely manner shall constitute a
material breach ands iall result in the irr mediate terminatiI of this License Agreement. All fees, costs, and
expenses, including, ithout limitation, ttorney's fees, ine� ed by the County in the collection of any
payment due hereon r shall be reim ur ed by Applicant.
20. Applicant aclmowlec ges that the C un may immediatily terminate the Event if the National Weather
Service issues a sevei D weather warn, g,.0 r imminent sever weather conditions develop in the area indicating
a risk to public safety, or a state of c ►criency has been dcla� ed. Applicant hereby waives any rights and all
claims for damages a jainst the Coun� t at may result from t e exercise of the rights reserved herein.

TO INDIAN RIVER COUNTY: In consideration of the opportunity afforded to me and/or my group, I, the
undersigned participant, freely agree to and make the following contractual representations and agreements.
I, the undersigned participant, do hereby knowingly, freely, and voluntarily assume all risk and liability for
any damage or injury that may occur as a result of my and/pr my group's use of the Intergenerational
Recreation Center identified herein during the time period I and/or my group are using same and further
agree to release, waive, discharge, and covenant not to s-00 Indian River County, its officers, agents,
employees, and volunteers (all for the purposes herein referre4 to as "Releases") from any and all liability
or claims that may be sustained by me or a third party directly or indirectly in connection with, or arising
out of, the use of the Intergenerational Recreation Center a1 described herein, whether caused in whole
or in part by the negligence of Indian River County or the Reltases.
I further agree to indemnify and hold harmless the Releases with respect to any and all fees, costs, expenses,
and attorney's fees arising out of or in connection with my andJor my group's use of the Intergenerational
Recreation Center as described herein.
I agree that I have read this form, fully understand its terms, and understand that I, or anyone who may
claim to have rights on my behalf, hale given up substantial rights by signing it and have signed it freely
and without any inducement or assurdnee of any nature and intend it to be a complete and unconditional
release of any and all liability to the greatest extent allowed by law and agree that, if any portion of this
Agreement is held to be invalid, the balance notwithstanding shall continue in full legal force and effect.
This acceptance is on behalf of all persons in the group with ine. If the rules are violated this permit may
be revoked and future permission may be refused. Permit holdo is responsible for the conduct of all persons
in the group.
I agree that I am at least 21 years of age and will be present 4u;•ing the period stated on this permit.

B. A damage deposit depends on the Irlumber of areas ren ed and can range from $150.00 to $1,000.00
and is refund able. An inspecton-of the property is re uired for every event. Damage Deposit are
increased at tf e sole discretio of Indian River Cour y dependent upon number of attendees and
events.
6. Any signage visible from the road in any county right of Aray requires a permit from the Indian River
County Code Enfrcement Division prior to placement. j
7. No animals are al 'owed unless assisting the handicapped.
8. Alcohol is strictly prohibited ext pt through the issuance of an Alcohol permit issued by the Parks &
Recreation Divisi l n. !
9. Under no circums antes shall any pe -son remove any e>I i pment or other items from the premises.
10. Facilities shall be restored to their o al condition and 11 activities ceased by at the time referenced
in the Agreement. For each quart r hbur after the appli4itr it will be charged a fee of $50.00 per quarter
hour.
11. Control of all lig ts, thermostats and; other equipment, aid the locking and unlocking of doors is the
responsibility of the Indian River County Intergenelr 'onal Recreation Center & Event Venue
ManagementStaff . Staff shoulde notified of any speda needs of the Applicant.

16. The Event shall be used for no oth r purpose whatsoever s, unless prior written approval is requested
in writing by Appl cant and giveny A ndian River County. Approval shall be subject to availability but
not be unreasonab y withheld, co di ioned, or delayed) long as such request is submitted at least
thirty (30) days pri r to the begina ngbeg' of the License Dura on. Such a change results in a modification
of the insurance re pfirements. i
17. Marketing:
