FIRST EXTENSION OF LICENSE AGREEMENT
This first extension (hereinafter referred to as "First Extension") of the original license
agreement (hereinafter referred to as "License Agreement") entered into on this 8th day of
May , 2024 by the BOARD OF COUNTY COMMISSIONER OF INDIAN RIVER
COUNTY, FLORIDA, a political subdivision of the State of Florida, 1801 27th Street, Vero
Beach, Florida 32960 (hereinafter referred to as "County") and The Florida Institute of
Technology, a private Not for Profit University, 1500 W. University Boulevard, Melbourne, FL
32901, (hereinafter referred to as "FIT"), in consideration of the mutual promises and agreements
set forth below, hereby agree as follows:
WITNESSETH:
WHEREAS, County and FIT entered into a license agreement for FIT to use and occupy
approximately 900 feet x 30 feet (along the dune line), located at Treasure Shores Park, 11300
Highway A1A, Vero Beach, FL 32963 (hereinafter referred to as "Premises"); and
WHEREAS, the License Agreement, which was for three years and authorized two
additional one-year terms, expired on January 19, 2024; and
WHEREAS, the County and FIT wish to extend the License Agreement for the first one
year extension beginning January 24, 2024; and
NOW THEREFORE, in consideration of the mutual undertakings herein and other good
and valuable consideration, the receipt and adequacy of which is hereby acknowledged, the parties
agree, as follows:
Recitals. The above recitals are true and correct and are incorporated herein.
2. Renewal ,of the License Agreement. The License Agreement is renewed until January
19, 2025, with one (1) additional one (1) year renewal period remaining.
3. All other provisions of the License Agreement, as amended, shall remain in full force
and effect.
