Dear Mr. Doyle:
Pursuant to our meeting on site, i have prepared a draft of our project understanding,
scope, and fee for the above project. This information can be presented in any format
suitable to you and the Board. Any resultant contract will comply with the terms and
conditions of the master agreement between Indian River County and Kimley-Horn &
Associates, Inc. Please call to discuss.
PROJECT UN-DERSTALNI)ING
It is our understanding that you require a topographic survey to be used as the base
mapping for the civil engineering design and construction of a water line over the
following described corridor situate in the City of Sebastian, Florida:
One: Beginning at the south property line of the KFC Restaurant on Jackson
Street and US Highway 1; thence south to tite south right-of-way line of Main
Street, said corridor's east and west limits being the center line of US Highway
1 and a line 30 feet west of the west right-of-way line of US Highway 1,
respectively.
Two: Beginning at the north line of Sebastian Business Supply and the Florida
East Coast railroad, thence south to the south right-of-way line of CR 512
(Eastbound), said corridor's east and west limits being the centerline of the
Florida 'East Coast Railroad right-of-way and a line 30 Feet east of the cast
right-of-way line of the Florida East Coast Railroad right-of-way.
Three: The entire right-of-way of Main Street from the centerline of US
Highway I to the centerline of the Florida East Coast Railroad right-of-way.
Four: The entire right-of-way of CR 512 (Eastbound), from the centerline of
US Highway 1 to the centerline of the Florida East Coast Railroad right-of-
way.
Five: The entire right-of-way of North Central Avenue from Main Street to US
Highway l including 30' beyond each side of said right-of-way.
The Topographic Survey shall meet the Indian River County Department of Utility
Services Survey Requirements as modified and attached hereto as "Exhibit A".

Our scope of services, schedule, and fee are as follows:
SCOPE OF SERVICES
Task I: Research and Recovery
Site reconnaissance for the recovery of horizontal and vertical control
(NGVD 1929) and ties to the State Plane Coordinate System, Florida East
Zone (NAD 83190). Establish the right-of-way of US Highway 1 from Main
Street to Jackson Street. Establish the right-of-way of the Florida East Coast
railroad from CR 512 (Eastbound) to a point 100 feet north of the Sebastian
Business Supply.
Task 2: Records Research
Research at the Indian River County Courthouse, Property Appraisers' Office,
Utilities, Engineering, Surveying, and Right -of -Way Departments for
applicable records in an effort to establish road and canal right -of --ways,
existing easements, horizontal and vertical project control, property lines, and
ownership. Obtain copses of the most recent recorded deeds for those parcels
lying between the Florida East Coast Railroad and US Highway 1 from CR 512
(Eastbound) north to Jackson Street (± 95 parcels).
Task 3: Establish Boundary Lines and Location of Constructed Improvements and
Utilities within the Project Limits
This task will include the field location of the improvements within the
proposed corridors (± I [.0W), Cross-sections will be obtained at 1440'
intervals and elevations will be shown at potential conflict areas. Boundary
lines for those parcels identified in Task 2 above (:t 95 parcels) will be
established.

Upon completion of the field data acquisition, field note reduction, and position
computations, the final topographic surveyo base map will be prepared at a scale

DELIVERABLES PROVIDED TO THE CLIENT
Upon completion of the Topographic Survey, we will provide the Utilities Department the
Topographic project mapping in digital AutcCadd R14 format at a scale of I" = 44',
accompanied with a Final signed/sealed Surveyors Report.
SCHEDULE
We will provide our services in an expeditious and orderly manner to meet the schedule
mutually developed by the Client and Consultant for the various elements of the project.

Dear Mr. Sparks,
We thank you for the opportunity to offer the expertise and experience of Masteller, Moler &
Peed, Inc. relative to the proposed referenced project. Upon field investigation of the site,
Masteller, Moler & Reed, Inc. ;proposes to furnish the following:

Scope of Services.
Task 1) Research and Recovery:

'task 4) Preparation of Final Survey ReportfBase Map
Upon completion of the field data acquisition, field note reduction, and position
computations, the final topographic survey/base map will be prepared at a scale of V'=
40'.
We propose to perform the above described scope of services for a hump sum fee of $8,360.00.
All additional services as authorized and not specifically a part of this proposal will be invoiced at
the hourly rates as provided within this proposal. The fee for our services does not include any
recording or Fling fees.
If at any time information must be forwarded to you by express mail, these charges will be
invoiced to you monthly. Items not specifically outlined in this proposal are not to be considered
a part of this contract.

a) Payment of Fees
Payment of all fees for services rendered shall be paid within thirty (30) days of billing.
Commencing on the thirty-first day, interest shall be added to the unpaid balance at the rate of one
q� and on -half percent (1-1/2%) per month or a total of eight cc percent (18%) per annum. In the
event that the matter of delinquent payments shall be turned over to legal counsel for collection,
there shall be added the amounts due for reasonable legal fees.
The surveys prepared by Masteller, Moler & Reed, Inc. shall be the sole property of that firm until
payment on any unpaid balance is made in full. Owner/Client agrees that until payment is
made in full, he, she, or it shall have no proprietary interest in the surveys prepared by Masteller,
Moler & Reed, Inc. Masteller, Moler & Reed, Inc. shall have the absolute right to request return
of any and all drawings submitted to ,governmental bodies or other parties on behalf of the
Owner/Client in the event of non-payment of outstanding fees by Owner/Client.
b) Additional Work Performed
Any and all work performed, other than that specifically contracted for within this general
contract, shall be billed at the following job classification and rates:

c) Representations Relating to Work Performed
The surveys which are subject to this contract shall be prepared in a professional, good and
workmanlike manner.
Nevertheless, no representations or warranties are made as to the success, approval or the
issuance of permits on any application submitted by O%Nwr/Client based in whole or in part upon
the surveys prepared by Masteller, Moler & Reed, Inc.
Backcharges will not be accepted by Masteller, Moler & Reed, [tic. unless we provide a written
agreement covering all corrective action and the total amount of the backcharge necessary to
accomplish the corrective action.

d) Print Costs
Print costs include five (5) copies of each phase of each survey as part of the surveying fee. Ail
other prints and Xerox copies requested by the client shall be billed to the client based on a charge
of$0.831SF for prints, $1.50/SF for sepias, $8.80/SF for mylars, $0.50 for each 8 112 x 11" copy,
$0.70 for each 8 112 x 14" copy, and $1.00 for each oversized copy..
c) Price Guarantee
Prices quoted are firm for sixty (60) days from the date of this proposal.
fj Contract Assignmeat
While binding upon the parties, their successors or assigns, this Contract may not be transferred
or assigned without the consent of both parties. The Owner/Client reserves the right to terminate
this Contract within ten (10) days written notice. Masteiler, Moler & Reed, Inc. shall be
compensated for services performed to termntation date.

referenced project located in Sebastian, Florida.
We propose to perforin the topographic route survey meeting the Indian River County
Department of Utility Services survey requirements, and as modified in "Exhibit A" of
your letter to Dean Luethje, dated August 21, 2000.
Please note the cost and fee detailed scope of services as follows:
Task 1: Research and recovery — field and office tasks, site reconnaissance for

Task 2: Records research — clerical and prc fessional staff researching public
records of various departments regarding rights-of-way, easements,
