RE: Kings Highway Phase II Plan Modifications — Feldman Property
Dear Ms. Thompson:
Kimley-Horn and Associates, Inc. is pleased to submit this letter agreement to provide additional design,
construction plans and permitting services to Indian River County for modifications to the Kings
Highway Phase II Roadway Improvement Plans as a result of the developers agreement between Indian
River County and Mr. David Feldman.
PROJECT UNDERSTANDING
We understand from our meeting that the County would like for us to revise the location of the proposed
Pond 400. Pond 400 is currently proposed in the northeast quadrant of Mr. Feldman's property. The
revised location is approximately 1200 feet due west from its current location to the northwest comer of
the subject property. This modification will require changes to the proposed roadway construction plans,
pond construction sheets, roadway cross sections and several quantity sheets
Our scope of services, schedule, and fee are as follows:
Task I —Survey ($3,500)
SCOPE OF SERVICES
The Consultant will provide additional topographic survey for the area between the revised pond location
and the Kings Highway right-of-way. This topographic survey will be used to design the access road and
drainage ditch between King Highway and the revised pond location. This survey will establish three
control points to be used in establishing a baseline of construction for the pond.
Task 2 — Design Analysis and Permitting ($1,400)
The Consultant will perform a hydraulic analysis for the revised proposed pond location and determine
- the impact to the proposed storm sewer system located between 0 Street SW and 0 Street. In addition
we will request a permit rnadification from St. Johns River Water Management District for the subject
revisions.

Task 3 — Construction Plan Revision ($2,300)
The Consultant will revise the existing construction plans to reflect the subject modification. This will
entail modifications to the Pond 400 construction plans, Kings Highway plan and profile sheets, effected
cross sections, drainage summary sheets and revising the construction quantities as a result of the
modification.
Schedule
We will provide our services within three weeks of the notice to proceed from the County.
Fee and Billing
KHA will perform the services described in the Scope of Services for a lump sum fee of $7,200, inclusive
of expenses. All permitting, application, and similar project fees will be paid directly by the Client.
Fees will be invoiced monthly based upon the percentage of services completed as of the invoice date.
Payment will be due within 25 days of the date of the invoice.
Closure
The scope of services identified in this Agreement is intended as an Amendment to the existing Kings
Highway Improvements Contract between Kimley-Horn and Associates, Inc. and Indian River County,
Florida.
This Amendment to the existing Kings Highway Improvements Contract regardless of where executed,
shall be governed by and construed by the laws of the State of Florida.
