INTERLOCAL AGENCY AGREEMENT
BETWEEN THE COUNTY OF INDIAN RIVER, FLORIDA
AND
THE SCHOOL BOARD OF INDIAN RIVER COUNTY, FLORIDA
IN RE: PELICAN ISLAND ELEMENTARY SCHOOL
SCRUB JAY LOT ACQUISITION
WHEREAS, the City of Sebastian and County of Indian River, Florida (hereafter
"County") created a Habitat Conservation Plan which identifies significant parcels of
xeric upland habitat that will perpetually be protected and managed for the benefit of
the threatened Florida Scrub -.lay in northern Indian River County; and
WHEREAS, the School Board of Indian River County, Florida (hereafter "Board"),
through Pelican Island Elementary School (hereafter "School"), by the ECO Troop,
initiated a campaign to raise funds to buy up to eighteen (18) lots surrounding the
School so as to enlarge the existing outdoor environmental classroom of School, since
the School is included in the Habitat. Conservation Plan; and
WHEREAS, the School obtained a Grant in the amount of $218,000.00 from the U.S.
Fish and Wildlife Service for the purpose of acquiring land to be included in the Habitat
Conservation Pian; and
WHEREAS, the School has been advised by the U.S. Fish and Wildlife Service that the
issuance of the funds will take approximately 180 days; and
WHEREAS, the School is desirous of negotiating with the owners of the designated 18
lots for purchase through an option agreement; and
WHEREAS, the County has agreed through its Commissioners to loan to the Board the
sum of $50,000.00 (hereafter "Loan") for the purpose of making available option money
for the negotiation of contracts with the potential sellers of the designated 18 lots; and
WHEREAS, the Board is in agreement to reimburse County for the Loan from the
proceeds of the Grant from the U.S. f=ish and Wildlife Service; and
WHEREAS, the Board has adopted a resolution authorizing a loan under the provision
of Florida Statute 237.161;
NOW, THEREFORE, for and consideration of the sum of One Dollar ($1.00) in hand
paid by the Board to the County, receipt whereof is hereby acknowledged, and in
further consideration of the covenants and agreements herein contained, the County
and the Board agree as follows:

1. The County will loan the Board the sum of $50,000.00 for the purpose of making
available option money for the negotiation of contracts with the potential sellers of
the designated 18 lots;
2. The Board agrees to reimburse the County for the Loan upon receipt of the U.S.
Fish and Wildlife Service Grant, or no later than June 30, 2001. In the event the
loan is not repaid before June 30, 2001, interest shall accrue at the rate authorized
under provisions of Florida Statute 21 5.84,
3. This agreement shall become effective upon filing with the Clerk of the Circuit Court
of Indian River County.
IN WITNESS WHEREOF, the parties have duly executed this Interlocal Agency
Agreement between the County of Indian River and the School Board of Indian River
County and have set their hands and seals the 12th day of, December. 2000.
