RESOLUTION NO. 2024-03
A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF
ORCHID, FLORIDA, RELEASING A PORTION OF A
CONSERVATION EASEMENT RECORDED IN OFFICIAL
RECORDS BOOK 846, PAGE 132 OF THE PUBLIC RECORDS OF
INDIAN RIVER COUNTY; PROVIDING FOR LEGISLATIVE
FINDINGS, RELEASE OF EASEMENT, RECORDING IN PUBLIC
RECORDS OF INDIAN RIVER COUNTY CLERK OF COURT;
AND AN EFFECTIVE DATE.
WHEREAS, Orchid Island Associates Limited Partnership, a Connecticut limited partnership,
as Grantor, granted a Conservation Easement to Indian River County and the Town of Orchid as
Grantees on October 16, 1989; and
WHEREAS, the Conservation Easement was recorded on October 25, 1989, in Official Records
Book 846, Page 136, Public Records of Indian River County, Florida; and
WHEREAS, the Orchid Island Golf & Beach Community Association, Inc., a Florida Not -for -
Profit Corporation (the "Owner") in July 2024, at the request of the Florida Department of
Transportation ("FDOT") in connection with the pursuit of a traffic signal to be installed on the
intersection of Orchid Island Drive and State Route AIA, sought from Indian River County and the
Town of Orchid a partial release for that portion of the Conservation Easement located on Parcel 1811C,
lying within Tract C of Orchid Island - - - Plat 6 recorded in Plat Book 13, Page 15B, Public Records of
Indian River County, Florida; and
WHEREAS, representatives of Indian River County and the Town of Orchid, whose jurisdictions
are co -Grantees of the Conservation Easement, reviewed the request from the Owner prior to the public
meeting of the Town Council held on September 16, 2024, at which the Town Council received detailed
information about the request for partial release and sought public feedback from interested parties; and
WHEREAS, on August 20, 2024, the Board of County Commissioners of Indian River County
Commission held a public meeting to consider releasing and abandoning all right, title, and interest that
it may have in that portion of the Conservation Easement located on Parcel 1811C, lying within Tract C
of Orchid Island - - - Plat 6 recorded in Plat Book 13, Page 15B, Public Records of Indian River County,
Florida; and
WHEREAS, the Town Council of the Town of Orchid after review and consideration has
determined that, subject to an authorized representative of the Indian River County Board of County
Commissioners executing the partial release of easement on behalf of Indian River County, the release
of that portion of the Conservation Easement Iocated on Parcel 1811C, lying within Tract C of Orchid
Island - - - Plat 6 recorded in Plat Book I3, Page 15B, Public Records of Indian River County, Florida,
would be in the best interest of the public health, safety and welfare of the Town and the general public,
as it furthers the ability of the Owner to cause to be installed a traffic signal on the intersection of Orchid
Island Drive and State Route AIA which the Owner has determined will increase the safety ofthe general
public.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
ORCHID, INDIAN RIVER COUNTY, FLORIDA, AS FOLLOWS:
SECTION 1- LEGISLATIVE FINDINGS. The foregoing recitals are hereby fully incorporated
herein by reference as legislative findings of the Town Council of the Town of Orchid.

SECTION 2. RELEASE OF EASEMENT. Subject to an authorized representative of the Indian
River County Board of County Commissioners executing the partial release of easement on behalf of
Indian River County, the Town Council hereby releases, and abandons all right, title and interest that it
may have in that portion of the Conservation Easement located on Parcel 1811C, lying within Tract C
of Orchid Island - - - Plat 6 recorded in Plat Book 13, Page 15B, Public Records of Indian River County,
Florida, as depicted and described in the application materials attached as Exhibit "A", "B" and "C"
hereto and hereby incorporated herein.
SECTION 3. RECORDING. The Mayor and Town Clerk are authorized to sign the partial
release of conservation easement attached hereto as Exhibit "A" only following the execution of the
partial release of conservation easement for the same parcel by an authorized representative of the Indian
River County Board of County Commissioners on behalf of Indian River County, after which the Town
Clerk shall cause to be recorded in the Public Records of Indian River County this Resolution, its
executed Exhibit and Indian River County's release in a single packet, all at the expense of the Owner,
in the Public Records of Indian River County, Florida.
SECTION 4. EFFECTIVE DATE. This Resolution shall take effect immediately, but its Exhibit
shall become effective only upon its execution by the Mayor and Town Clerk, following the execution of
the partial release of conservation easement for the same parcel by an authorized representative of the
Indian River County Board of County Commissioners on behalf of Indian River County.

Subject: Orchid Island Traffic Signal
Justification for ROW Donation for Mast Arm D
For the placement of Mast Arm D in the northwest corner of the intersection of Orchid
Island Drive and SR AiA, several design criteria had to be met:
1. Clear Zone requirements from Florida Department of Transportation Design
Manual Table 215.2.1 Minimum Width of Clear Zone requires 24 feet from the
travel lane and 14 feet from the auxiliary lane to be free of obstacles such as
mast arms.
2. The Florida Power & Light overhead utilities rest at the edge of the Clear Zone
and require a minimum io' horizontal clearance from mast arm structures to
allow for safe construction and operation. This pushed the mast arm to the west
even further.
3. This area determined acceptable due to Clear Zone and Overhead Utility
Clearance was also explored for underground facilities and found to be occupied
with utilities running north -south along State Road A1A to the point that the
mast arm foundation (5'D) needed to be adjusted further west.
4. Several utilities, including a gas line, were identified running east -west along
Orchid Island Drive's west approach, and required Mast Arm D to be moved
more to the north to allow for safe construction and operation.
5. Soft digs were completed in an area which appeared to be clear of marked
utilities. This area is where Mast Arm D is shown on the signalization plans.

right, title and interest in the Conservation Easement recorded in O.R. Book 846, Page 132 of the Public
Records of Indian River County, Florida, as it affects title to that portion of Parcel 1811 C lying within Tract
C, of Plat No. 6, said land, situate, lying and being in Indian River County, Florida.
