DAMAGE DEPOSIT
1 o ensure that your Damage Deposit is returned,the following requirements must be met

•:. Removal of ALL personal property from the facility at the end of your event

..:. Do not incur any damage to mom.furnishings or equipment in any morn or area rented or
telonging to Indian River County_
Please note that failure to comply with any of these policies will result in the loss of your Damage
Deposit_Occupying the building in excess of the times stated on the permit application will result
in a charge of the hourly rate for the additional time or the loss or your deposit, whichever is
greater.

RESERVATION AGREEMENT TERMS
L No mom shall be considered"reserved"until a signed Agreement and 25% deposit are received.
2 A Damage Deposit will be required for some Reservations The final payment,along with the damage deposit
(if required) is due forty-five (30) prior to the Reservation. Reservations within the thirty (30) days will
require full payment of all charges at Agreement signing.
3. No Agreement shall be valid unless it is signed by the designated Indian River County Parks,Recreation and
Conservation Department approved staff member.
4 Agreements for groups cnmpnced of minors will he issued only to adults who accept responsibility for them
and will supervise them throughout the period covered
5_ No tickets,for any event,shall he sold at the door mid no admission charges shall be made except as authorized
by the Agreement.The Applicant shalt proside to the County information as to the total ticket sales at 30 15,
7 and 3 days prior to the Event. The County reserves the right to cap ticket sales depending on the capacity
of the Premises and the iG Center or because of law enforcement. sanitation, traffic control or due to other
public safety issues.
b. Renter shall maintain the area rented in a safe,clean.and am-active condition and at the end of the event, the
area shall he in substantially same condition as it was at the beginning of the event.
7. Renter shall not exceed the posted occupancy of the rented area.

accepted for payment of the Damage Deposit and may be used to pay the facility Reservation fee.Indian River
County accepts VISA.MasterCard and Discover as forms of credit card payment.

Service issues a severe weather warning.,or imninent severe weather condirinns develop in the area indicating
a risk to public safety.or a state of emergency has been declared. Applicant hereby waives any rights and all
claims for damages against the County that may result from the exercise of the rights reserved herein.
21.The County and its officers.agents and employees engaged in the operation and maintenance of the
Premises reserve the right to enter upon nod to have free access to the Premises at any and dl times,which
reservation is hereby acknowledged and agreed to by Applicant.
22.Any notice,request. instruction.demand,consent,or other c n m micaation required or permitted to be given
under this Reservation Agreement shall he in writing and shall be given in writing and delivered by email to:

23.Applicant acknowledges receipt of and agrees to comply with the iG's Rules and Regulations which are
attached hereto as Exhibit C and incorporated by reference.
24. Animals will not be permitted onto the iG Center property during an event unless they are considered a
Service Animal. The Americans with Disabilities Act(ADA)2010 Regulations define a service animal as
"any dog that is indir iduaaly trained to do work or perform tasks for the benefit of an individual with a
disability,including a physical,sensory.psychiatric.intellectual,or other mental disability.Other species of
animals,whether wild or domestic,trained or untrained,are not service animals for the purposes of this
definition." C.F.R.p 35.104 and# 36.104(2010). This paragraph does not apply to organizations hosting

TO INDIAN RIVER COUNTY:In consideration oldie opportunity afforded to me Lormy group,1,the
undersigned participant,freely agree to and make the following contractual representations and agreements.
1,the uridersigned participant,do hereby knowingly, freely, and voluntarily assume all risk and liability
for any damage or injury that may occur as a result of my andlor my group's use of the Intergenerational
Recreation Center identified herein dining the time period I andior my group are using same and further
agree to release. waive_discharge,and covenant not to sue Indian River County,its officers.agents,
employees,and volunteers(all for the purposes herein referred to as"Releases')from any and all liability
or claims that may he sustained by me or a third party directly or indirectly in connection with, or arising
out of. the use of the Intentenerstional Recreation Center as described herein, except if caused in
whole or in part by the negligence of Indian River County or the eleas-es.
I further agree to indemnify and hold harmless the Releases with respeci to any and all fees,costs.expenses.
and attorney's fees arising out of or in connection with my andt'or my group's use of the Inters
Retreat km Center as described herein.
I agree that I have read this form. fully understand its terms. and understand that 1. or anyone who may
claim to have rights on my behalf, have given up substantial nghts by signing it and have signed it freely
and without any inducement or assurance of any nature and intend it to be a compkte and unconditional
release of any and all liability to the greatest extent allowed by law and agree that_ if any portion of this
Agreement is held to be invalid,the balance notwithstanding shall continue in full legal Imre and effect.
